Kent Wetherell II, a Trump appointee in Florida, denied the Biden Justice Department\u2019s request to stay a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-grants-temporary-restraining-order-partially-blocking-texas-heartbeat-act\/\" title=\"Judge Grants Temporary Restraining Order Partially Blocking Texas Heartbeat Act\">temporary restraining order blocking<\/a> the release of illegal immigrants into the United States without court dates. The judge called the administration\u2019s request for an emergency stay \u201cborderline frivolous\u201d and \u201cChicken Little.\u201d<\/p>\n<p>The ruling left the DOJ to seek relief from the 11th Circuit Court of Appeals, a move which earlier in the day officials said they were prepared to do.<\/p>\n<p>The judge stated that the administration had no basis to release migrants into the country\u2019s interior without a court date now that the Trump-era Title 42 policy had expired. He wrote, \u201cDHS\u2019s Chicken Little arguments about the impact of it not being able to (mis)use \u2018parole\u2019 under either policy as a processing tool for the surge of aliens arriving at the border are hard to square with the DHS Secretary\u2019s recent comments that only \u2018a fraction of the people that we encounter\u2019 would be paroled into the country and that \u2018the vast majority will be addressed in our <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rubio-blasts-biden-we-are-headed-for-border-chaos\/\" title=\"Rubio Blasts Biden: \u2018We Are Headed For Border Chaos\u2019\">border patrol facilities<\/a> and our ICE detention facilities.\u2019\u201d<\/p>\n<p>Earlier in the day, the Biden Justice Department had sought an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-cancels-highly-anticipated-hearing-over-title-42-immigration-border-security-case\/\" title=\"Supreme Court Cancels Highly Anticipated Hearing Over Title 42 Immigration, Border Security Case\">emergency order allowing<\/a> it to continue releasing illegal aliens into the United States. DOJ attorneys had asked Wetherell for a two-week restraining order on the Biden administration policy. The administration informed the court that it intends to appeal Wetherell\u2019s ruling to the 11th Circuit Court of Appeals.<\/p>\n<h3>The Biden Administration\u2019s Parole Policy<\/h3>\n<p>The Biden administration\u2019s policy was described in a Border Patrol memo this week, saying that migrants can be allowed into the country on parole if CBP is facing overcrowding. The parole process is typically reserved for &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/florida-sues-biden-administration-over-illegal-border-policies-that-harm-the-state\/\" title=\"Florida Sues Biden Administration Over \u2018Illegal Border Policies\u2019 That \u2018Harm\u2019 The State\">urgent humanitarian reasons<\/a> or significant public benefit.\u201d<\/p>\n<p>The administration argues that the restraining order on its parole policy will &#8220;irreparably harm the United States and the public by frustrating measures that are necessary to secure the border and protect the health and welfare of both migrants and Border Patrol Agents,&#8221; the filing states.<\/p>\n<p>Florida Attorney General Ashley Moody argued in the state\u2019s lawsuit that the &#8220;parole with conditions&#8221; policy was materially identical to a policy blocked by Wetherell in March, and he agreed with that assessment in his order.<\/p>\n<p>Wetherell was not persuaded by the government&#8217;s arguments that blocking migrant releases will cause harm.
