Cahill dropped the charge in October after Chauvin\u2019s defense team requested it be removed.<\/p>\n<p>Chauvin\u2019s defense attorneys can appeal the latest decision to the Minnesota Supreme Court. More from KARE 11:<\/p>\n<blockquote>\n<p><em>Third-degree murder is a\u00a0<a href=\"https:\/\/www.revisor.mn.gov\/statutes\/cite\/609.195\">complicated charge<\/a>\u00a0that has a legal history of only being applied in situations where the \u201cdeath-causing act\u201d is more broad and not directed at a single person. However, former Minneapolis police officer\u00a0<a href=\"https:\/\/www.kare11.com\/article\/news\/local\/noor-found-guilty-of-3rd-degree-murder-manslaughter-in-fatal-shooting-of-unarmed-woman\/89-b5462df2-9060-4c60-9c38-5ed0d00536b3\">Mohamed Noor was convicted on this charge<\/a>\u00a0for fatally shooting Justine Ruszczyk Damond, and the Minnesota Court of Appeals\u00a0<a href=\"https:\/\/www.kare11.com\/article\/news\/crime\/appeals-court-upholds-former-mpd-officer-mohamed-noors-conviction\/89-35034811-7690-40ce-95cd-701fd8fbc5a9\">recently upheld that charge<\/a>, saying that it can indeed apply when the death-causing act is directed at an individual.<\/em><\/p>\n<p><em>At that point, prosecutors asked the judge to reinstate the charge for Chauvin, as well.\u00a0<a href=\"https:\/\/www.kare11.com\/article\/news\/local\/george-floyd\/judge-denies-prosecutor-motion-3rd-degree-murder-against-chauvin-officers-george-floyd-death\/89-2a284414-69c7-4d86-9db5-0b1d564db60b\">But the judge denied their request<\/a>, saying that the appeals court\u2019s ruling is not precedential yet. He said the decision will not be final until Noor decides not to appeal to the state Supreme Court within the window allotted, or the state Supreme Court either hears it or declines to review.<\/em><\/p>\n<\/blockquote>\n<p>The Minnesota Court of Appeals ruled that the Noor precedent was binding and that therefore the charge should be upheld against Chauvin.<\/p>\n<p>Chauvin was charged with second-degree murder, third-degree murder, and manslaughter after video surfaced of him holding his knee to the neck of George Floyd, who eventually died in police custody. Chauvin was seen on video holding his knee to Floyd\u2019s neck for nearly eight minutes while he was handcuffed and lying on the ground, repeatedly saying he couldn\u2019t breathe.<\/p>\n<p>Floyd\u2019s death on May 25, 2020 sparked nationwide protests that turned into riots that destroyed businesses, costing property owners billions in damage.<\/p>\n<p>As The Daily Wire previously <a href=\"https:\/\/www.dailywire.com\/news\/minneapolis-courthouse-turned-into-veritable-fortress-ahead-of-george-floyd-murder-trial\">reported<\/a>, extra security measures are being taken ahead of Chauvin\u2019s trial, with the Hennepin County District Court being turned into a \u201cveritable fortress,\u201d <a href=\"https:\/\/nypost.com\/2021\/02\/28\/minneapolis-courthouse-turned-into-fortress-for-george-floyd-murder-trial\/\">according to the Post<\/a>. The Daily Wire reported:<\/p>\n<blockquote>\n<p><em>Jury selection will begin on March 8 for the trial, where ex-police officer Derek Chauvin is charged with murdering Floyd. The Post reported that Hennepin County District Court has been \u201cringed with concrete barriers, security fencing, and barbed wire.\u201d This is in addition to\u00a0<a href=\"https:\/\/nypost.com\/2021\/02\/18\/minnesota-ramps-up-security-for-murder-trial-of-derek-chauvin\/\">increased security<\/a>\u00a0in the area, including \u201cMinneapolis police, Hennepin County sheriff\u2019s deputies, Minnesota state troopers, and the National Guard,\u201d the Post previously reported.<\/em><\/p>\n<p><em>\u201cWe are not going to be caught flat-footed,\u201d Minnesota Public Safety Commissioner John Harrington\u00a0<a href=\"https:\/\/kttc.com\/2021\/02\/17\/law-enforcement-officials-highlight-safety-plan-for-chauvin-trial\/\">told<\/a>\u00a0KTTC-TV earlier this month.<\/em><\/p>\n<\/blockquote>\n<p><em>The Daily Wire is one of America\u2019s fastest-growing conservative media companies and counter-cultural outlets for news, opinion, and entertainment.
