Perry, who is white, was convicted of shooting and killing Garrett Foster, also white, after protesters reportedly surrounded Perry\u2019s car, and Foster, who was carrying an AK-47 across his chest, attempted to talk to him.<\/p>\n<p>A jury found Perry guilty in early April.<\/p>\n<h3>Prosecutors Stand by Jury\u2019s Decision<\/h3>\n<p>\u201cOur office continues to stand by the jury\u2019s unanimous decision to convict Daniel Perry for the murder of Garrett Foster,\u201d Travis County District Attorney Jos\u00e9 Garza said in a statement on Wednesday, according to CNN.<\/p>\n<p>Perry, who also drives for Uber, said he had just dropped off a customer when he received a text from a girl he liked. He told investigators shortly after he shot Foster that he was texting her while driving and that she had asked him for money, \u201cand when I looked up, the protesters were right there.\u201d<\/p>\n<h3>Controversy Surrounding the Shooting<\/h3>\n<p>Perry claimed that he didn\u2019t realize what was being protested, but prosecutors have provided text messages from two months before the shooting showing Perry talking about killing protesters.<\/p>\n<p>\u201cI might have to kill a few people on my way to work, they are rioting outside my apartment complex,\u201d Perry wrote to a friend in June 2020, according to the Austin Chronicle. Perry also spoke to his friend two weeks before the shooting about how to get away with killing a protester \u2014 by claiming self-defense.<\/p>\n<p>Other protesters have claimed that Perry sped up into the crowd and that Foster never raised his rifle at Perry.<\/p>\n<h3>Defense Team Requests New Trial<\/h3>\n<p>Perry\u2019s defense team had requested a new trial on the grounds that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-man-convicted-of-fatally-shooting-black-lives-matter-protester-wont-get-new-trial-judge-rules\/\" title=\"Texas man who killed Black Lives Matter protester won't receive new trial, judge decides.\">district attorney prevented exculpatory evidence<\/a> from being presented to the jury.<\/p>\n<p>\u201cI had several conversations with the District Attorney\u2019s Office regarding the presentation of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-governor-greg-abbott-working-swiftly-to-pardon-daniel-perry\/\" title=\"Texas Governor Greg Abbott Working \u2018Swiftly\u2019 To Pardon Daniel Perry\">exculpatory evidence related<\/a> to Daniel Perry,\u201d David Fugitt, the lead investigating detective in the case, said in an affidavit presented by the defense. \u201cIt became clear to me that the District Attorney\u2019s Office did not want to present evidence to the grand jury that would be exculpatory to Daniel Perry.\u201d<\/p>\n<p>\u201cOn more than one occasion I was directed by the Travis County Attorney\u2019s Office to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-governor-greg-abbott-working-swiftly-to-pardon-daniel-perry-after-soros-prosecution\/\" title=\"Texas Governor Greg Abbott Working \u2018Swiftly\u2019 To Pardon Daniel Perry After Soros Prosecution\">remove exculpatory information<\/a> that I had intended to present to the grand jury during my testimony,\u201d he said. \u201cOf my original 158 slide powerpoint presentation, the presentation was reduced to 56 slides with almost all of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pressure-grows-for-governor-greg-abbott-to-act-after-daniel-perry-convicted-in-case-led-by-soros-da\/\" title=\"Pressure Grows For Governor Greg Abbott To Act After Daniel Perry Convicted In Case Led By Soros DA\">exculpatory evidence ordered removed<\/a>.
