Missouri Attorney General Andrew Bailey brought the petition against Gardner, accusing her of shirking her responsibilities and committing intentional acts that warrant her removal. Gardner, a Democrat, has accused Bailey, a Republican, of playing politics. <\/p>\n<h3>Accusations Against Gardner<\/h3>\n<ul>\n<li>Gardner willfully failed to prosecute cases<\/li>\n<li>Gardner willfully failed to make charging decisions<\/li>\n<li>Gardner willfully failed to keep victims informed<\/li>\n<li>Gardner willfully failed to ensure defendants and victims receive a speedy trial<\/li>\n<\/ul>\n<p>The judge dismissed three allegations that didn\u2019t fit the type of conduct that could lead to an officeholder\u2019s removal. During a public meeting, she declared emphatically: \u201cI\u2019m not leavin\u2019. I\u2019m not resigning. I\u2019m not doing nothing. [sic] You will have to remove me.\u201d Gardner, seeking reelection in 2024, is among many progressive prosecutors who received backing from funds from billionaire George Soros. <\/p>\n<h3>\u2018Change of Judge\u2019<\/h3>\n<p>The state Supreme Court appointed Visiting Judge John Torbitzky to preside over the case. Torbitzky granted Gardner\u2019s lawyers\u2019 request for a \u201cchange of judge\u201d under a Missouri procedural rule that allows it once in every civil case, no questions asked. Bailey is accusing Gardner\u2019s lawyers of stonewalling requests for records and stalling the proceedings. <\/p>\n<h3>Police Blamed for Failures?<\/h3>\n<p>Bailey quoted portions of Gardner\u2019s public comments in court records, stating she has telegraphed that \u201cher defense to the suit will include blaming the St. Louis Metropolitan Police Department for her\u00a0failures.\u201d Gardner has attempted to reform the system since taking office in 2017.
