Zooey Zephyr is partnering with the American Civil Liberties Union (ACLU) in an attempt to force reentry to the state House floor this week after Republicans punished the freshman lawmaker over his \u201chate-filled\u201d comments and a disruptive demonstration he inspired.<\/p>\n<p>On Monday, Zephyr, a man who calls himself a woman and the first <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hey-kids-look-at-these-naked-trans-adults-could-a-disturbing-new-tv-trend-hit-the-u-s-next\/\" title=\"Could A Shocking New TV Style Hit The U.S. Now, Children? Look At These Naked Trans Adults.\">trans-identifying member<\/a> of the Montana House of Representatives, announced a lawsuit with the ACLU to reclaim access to the lower chamber after he was temporarily expelled. Pro-trans demonstrators flooded the public gallery and demanded Zephyr have debate privileges restored after he was stripped of them for violating decorum the week prior. First, Republicans barred Zephyr from engaging in floor debate until he issues an apology. He responded by encouraging protests that compelled police in riot gear to clear the lower chamber\u2019s public gallery. <\/p>\n<p><strong>Republicans Stand Firm Against Zephyr&#8217;s Actions<\/strong><\/p>\n<p><a href=\"https:\/\/thefederalist.com\/2023\/04\/25\/montana-legislature-shut-down-by-trans-activists\/\" target=\"_blank\" rel=\"noreferrer noopener\">Montana Legislature Shut Down By Trans Activists<\/a><\/p>\n<p>Republican House Speaker Matt Regier <a href=\"https:\/\/thefederalist.com\/2023\/04\/26\/montana-house-cancels-floor-session-over-trans-disruptions\/\" target=\"_blank\" rel=\"noreferrer noopener\">canceled<\/a> the following floor session altogether.<\/p>\n<p>\u201cCurrently all Representatives in the Montana House are free to participate in debate while following House rules,\u201d Regier <a href=\"https:\/\/twitter.com\/MTHouseGOP\/status\/1650930857954385920?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a>\u00a0in a statement. \u201cThe choice to not follow House rules is one that Rep. Zephyr has made. The only person silencing Rep. Zephyr is Rep. Zephyr. The Montana House will not be bullied.\u201d<\/p>\n<p><strong>Zephyr Banned from House Floor<\/strong><\/p>\n<p>On Wednesday, the Republican majority <a href=\"https:\/\/thefederalist.com\/2023\/04\/27\/montana-democrat-banned-from-house-floor-after-transgender-insurrection\/\" target=\"_blank\" rel=\"noreferrer noopener\">banned<\/a> a defiant Zephyr from the floor of the lower chamber while allowing the Missoula representative to vote remotely. Montana Republican Gov. Greg Gianforte <a href=\"https:\/\/montanafreepress.org\/2023\/04\/28\/montana-governor-signs-gender-affirming-care-ban-for-minors\/\" target=\"_blank\" rel=\"noreferrer noopener\">signed<\/a> the bill banning transgender medical interventions for minors on Friday.<\/p>\n<p><strong>Similar Incidents in Other States<\/strong><\/p>\n<p>The saga comes after Tennessee Republicans expelled a pair of Democrats who led another \u201cinsurrection\u201d by pro-transgender disruptors at the state Capitol in Nashville after a trans-identified teen murdered six Christians at a nearby school. Tennessee Reps. Justin Jones and\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/04\/12\/50-shades-of-justin-pearson\/\" target=\"_blank\" rel=\"noreferrer noopener\">Justin Pearson<\/a>\u00a0were temporarily removed from the House for using a bullhorn amid the protests. Each was <a href=\"https:\/\/www.nbcnews.com\/politics\/politics-news\/memphis-council-vote-reinstating-justin-j-pearson-tennessee-legislatur-rcna78958\" target=\"_blank\" rel=\"noreferrer noopener\">reinstated<\/a>\u00a0by local officials in their home districts.<\/p>\n<p><strong>Updates on Zephyr&#8217;s Lawsuit<\/strong><\/p>\n<p>One month after the shooting, officers have still failed to release the Nashville shooter\u2019s manifesto. <\/p>\n<p><strong>UPDATE<\/strong>: Judge Mike Menahan of Montana\u2019s First Judicial District Court denied Zephyr\u2019s motion Tuesday night citing the state constitution\u2019s separation of powers. <\/p>\n<p>\u201cThe Montana courts have recognized that the Judicial Branch has no power to revise or overrule the power expressly held by the Montana State Legislature to conduct its business,\u201d Speaker Regier said in a statement. \u201cThe House is continuing its work for the people of Montana.\u201d<\/p>\n<hr>\n<p>Tristan Justice is the western correspondent for The Federalist and the author of Social Justice Redux, a conservative newsletter on culture, health, and wellness.
