He apologized on her behalf.<\/p>\n<p>Repeatedly, Noble noted Gardner\u2019s absence from the contempt hearing even though she had been informed about it.<\/p>\n<figure id=\"attachment_5079792\" style=\"width: 300px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/02\/24\/Kimberly-Gardner-1200x1360.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> St. Louis Circuit Attorney Kimberly Gardner (circuit attorney.org)<\/figure>\n<p>Instead, she sent one of her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/top-prosecutor-on-john-durhams-team-withdraws-from-case-against-steele-dossier-source\/\" title=\"Top Prosecutor on John Durham\u2019s Team Withdraws From Case Against Steele Dossier Source\">assistant prosecutors<\/a> as her representative, along with Desilets.<\/p>\n<p>The judge\u2019s accusation against Gardner comes while she is facing formal proceedings that could boot her from office.<\/p>\n<p><a href=\"https:\/\/www.theepochtimes.com\/12000-criminal-cases-dismissed-due-to-st-louis-prosecutors-inaction-missouri-ag-alleges_5141830.html\">In a petition filed in February,<\/a> Missouri Attorney General Andrew Bailey said Gardner forfeited her elected position by shirking her professional responsibilities.<\/p>\n<p>Gardner, in office since 2017, has asserted that there was no intentional neglect, but Bailey says the evidence will show she let thousands of criminal cases die because of her inaction.<\/p>\n<p>A visiting judge is considering whether to allow the case to proceed to trial as planned in September. The next hearing is set for May 2.<\/p>\n<h3>Massive Caseloads<\/h3>\n<p>Overworked staff is a factor in the case that Bailey is pressing against Gardner. Noble also cited an unmanageable caseload in the contempt case.<\/p>\n<figure id=\"attachment_5227760\" style=\"width: 300px\" class=\"wp-caption alignleft\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/04\/28\/id5227760-abhead.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> Missouri Attorney General Andrew Bailey in a photo dated 2023. (Courtesy of Andrew Bailey)<\/figure>\n<p>Noble pointed out that Desilets has been assigned to more than 100 felony cases, and it is Gardner\u2019s <strong>\u201cduty to manage the caseload of each staff member.\u201d<\/strong><\/p>\n<p><strong>\u201cAny prudent practitioner would expect such a caseload to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-accuses-no-show-missouri-prosecutor-of-contempt-calls-office-a-rudderless-ship-of-chaos\/\" title=\"Judge Accuses No-Show Missouri Prosecutor of Contempt, Calls Office \u2018A Rudderless Ship of Chaos\u2019\">create countless irreconcilable conflicts<\/a>,\u201d<\/strong> Noble wrote.<\/p>\n<p>Earlier this month, Gardner and a different assistant from her office faced a possible contempt citation after he failed to show up for a murder trial on April 17. However, after learning about a series of snafus, a judge withdrew the allegation, <a href=\"https:\/\/stltoday.com\/news\/local\/crime-and-courts\/judge-wont-hold-kim-gardner-in-contempt-but-says-murder-case-fell-through-the-cracks\/article_430d26e8-e2ba-11ed-ba47-ff3fd607e55e.html\">The St. Louis Post-Dispatch reported.<\/a><\/p>\n<h3>Attorney Defends Himself<\/h3>\n<p>Speaking in his own defense, Desilets told the judge that he had a medical issue on April 10, when the shooting case was set for trial.
