This gives the state GOP a chance to come up with new congressional lines that favor Republicans.<\/p>\n<h3>New Ruling<\/h3>\n<p>In a 5\u20132 ruling (<a href=\"https:\/\/appellate.nccourts.org\/opinions\/?c=1&#038;pdf=42284\">pdf<\/a>), the state\u2019s highest court struck down an order that was previously issued by the same court. The prior 4\u20133 Democrat majority on the state Supreme Court had struck down a Republican-drawn congressional map in an early 2022 ruling.<\/p>\n<p>The new majority opinion was penned by Chief Justice Paul Newby, joined by the four other Republican members of the court. Democrat Justice Anita Earls wrote a dissent that was joined by fellow Democrat\u00a0Justice Michael Morgan.<\/p>\n<h3>No Judicially Manageable Standard<\/h3>\n<p>The North Carolina Supreme Court wrote in its new opinion that there is \u201cno judicially manageable standard by which to adjudicate partisan gerrymandering claims\u201d and said that courts\u00a0\u201care not intended to meddle in policy matters.\u201d<\/p>\n<p>\u201cOur constitution expressly assigns the redistricting authority to the General Assembly subject to explicit limitations in the text,\u201d the court\u2019s majority wrote. \u201cThose limitations do not address partisan gerrymandering. It is not within the authority of this Court to amend the constitution to create such limitations on a responsibility that is textually assigned to another branch. Furthermore, were this Court to create such a limitation, there is no judicially discoverable or manageable standard for adjudicating such claims.\u201d<\/p>\n<h3>Impact on Democrats<\/h3>\n<p>North Carolina Democrats stand to lose up to four seats the U.S. House of Representatives via the GOP-drawn maps, according to\u00a0<a href=\"https:\/\/www.cookpolitical.com\/analysis\/house\/north-carolina-house\/north-carolina-remap-could-cost-democrats-four-seats-2024\">The Cook Political Report<\/a>.<\/p>\n<p>\u201cFollowing decisions such as this, we must remember that, though the path forward might seem long and unyielding, an injustice that is so glaring, so lawless, and such a betrayal to the democratic values upon which our constitution is based will not stand forever,\u201d Earls wrote in her dissent.<\/p>\n<h3>Controversial Decision<\/h3>\n<p>Attorney Marc Elias, who formerly represented the Democratic National Committee on a range of election issues before <a href=\"https:\/\/www.reuters.com\/world\/us\/us-democratic-national-committee-lawyer-elias-part-ways-2023-04-12\/\">parting ways<\/a> this month, claimed in a Twitter thread the state Supreme Court\u2019s decision was troubling. The reversal means that the U.S. Supreme Court won\u2019t decide on what he called the\u00a0<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-ripped-for-bizarre-distortion-of-clarence-thomas-dissent-in-pa-election-case\/\" title=\"CNN Ripped For \u2018Bizarre Distortion\u2019 Of Clarence Thomas Dissent In PA Election Case\">independent state legislature<\/a> (ISL) theory on what entity has the power to set rules for federal elections.<\/p>\n<p>\u201cThis will almost certainly mean SCOTUS will not decide the controversial ISL theory this term,\u201d he wrote, linking to his Democracy Docket website. \u201cThis is bad news for voters of North Carolina.
