Warren is appealing a lower court&#8217;s ruling to the U.S. Court of Appeals for the 11th Circuit in Atlanta, and the Yost-led coalition has filed a <a href=\"https:\/\/www.ohioattorneygeneral.gov\/Files\/Briefing-Room\/News-Releases\/60-States-Amicus-Brief.aspx\" target=\"_blank\" rel=\"noopener\">brief<\/a> asking the appeals court to reject Warren&#8217;s claim that DeSantis violated his free speech rights by removing him.<\/p>\n<p>&#8220;Government employees do not have a First Amendment right not to enforce the law,&#8221; Yost&#8217;s news release emphasized.<\/p>\n<figure id=\"attachment_3589296\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2020\/11\/22\/Elbert-P-Tuttle-US-Courthouse-01.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> Elbert P. (Eoghanacht via Wikimedia Commons\/Public Domain)<\/figure>\n<h3>Another Prosecutor Faces Ouster<\/h3>\n<p>The coalition&#8217;s efforts come as Missouri Attorney General Andrew Bailey is also <a href=\"https:\/\/www.theepochtimes.com\/as-soros-backed-prosecutor-fights-attempt-to-oust-her-judge-sets-separate-contempt-hearing_5204164.html\">attempting to remove<\/a> St. Louis Circuit Attorney Kim Gardner from her elected office. Bailey accused Gardner of mismanaging her office, resulting in thousands of criminal cases being dismissed and victims&#8217; rights being ignored. Gardner, a Democrat, alleges that Bailey, a Republican, is targeting her for political reasons.<\/p>\n<p>Unlike Warren, Gardner&#8217;s lawyers claim that she has not willfully refused to prosecute cases. However, Bailey accuses her of lax enforcement, and Gardner has received support from billionaire George Soros, <a href=\"https:\/\/themissouritimes.com\/soros-gets-involved-in-st-louis-circuit-attorney-race\/\" target=\"_blank\" rel=\"noopener\">according to The Missouri Times<\/a>.<\/p>\n<p>For years, Soros has financially supported dozens of U.S. prosecutors who embrace his &#8220;reform&#8221; agenda. Many top Republicans blame <a href=\"https:\/\/www.theepochtimes.com\/soros-funded-das-to-blame-for-violent-crime-spree-sweeping-the-nation-house-gop_5201158.html\">Soros-backed prosecutors<\/a> for the crime waves in many of the nation&#8217;s largest, Democrat-run cities.<\/p>\n<p>&#8220;Our system is rife with injustices that make us all less safe,&#8221; Soros wrote in <a href=\"https:\/\/www.georgesoros.com\/2022\/07\/31\/why-i-support-reform-prosecutors\/\">a 2022 essay<\/a>. He advocates for &#8220;preventing crime with strategies that work\u2014deploying mental-health professionals in crisis situations, investing in youth job programs, and creating opportunities for education behind bars.&#8221;<\/p>\n<h2>Discretion Versus Abdication<\/h2>\n<p>In the DeSantis-Warren case brief, Bailey and his peers assert that they &#8220;can properly remove from office prosecutors who make non-prosecution pledges.&#8221;<\/p>\n<p>&#8220;These pledges violate the traditional separation of powers between government branches,&#8221; the brief states. &#8220;As every schoolchild learns, the legislative branch, not the executive, makes law.&#8221;<\/p>\n<div class=\"page\" title=\"Page 9\">\n<div class=\"layoutArea\">\n<div class=\"column\">\n<p>The brief acknowledges that prosecutors &#8220;have considerable discretion&#8221; over whether to proceed with charges on a case-by-case basis.
