And he&#8217;s not backing down.<\/p>\n<p class=\"text__text__1FZLe text__dark-grey__3Ml43 text__regular__2N1Xr text__large__nEccO body__full_width__ekUdw body__large_body__FV5_X article-body__element__2p5pI\" data-testid=\"paragraph-2\">\u201cThe head of the executive branch wielded his power to have one of his critics silenced, thrown back into prison, and kept in conditions dangerous to his health,\u201d Cohen\u2019s lawyers wrote in a 30-page <a href=\"https:\/\/www.courtlistener.com\/docket\/66714824\/50\/cohen-v-united-states\/\">brief<\/a> filed with the 2nd U.S. Circuit Court of Appeals in Manhattan on Monday.<\/p>\n<p data-testid=\"paragraph-2\">Cohen, who served as Trump&#8217;s attorney from 2006 to 2018 and was a vice president of the Trump Organization, was sentenced to three years in prison in 2018 for federal charges related to campaign finance violations. He reported to prison in May 2019.<\/p>\n<p data-testid=\"paragraph-2\">After being released to serve his term in home confinement in May 2020 due to the COVID-19 pandemic, Cohen was thrown back in prison on July 9, 2020, for speaking publicly about his book, &#8220;Disloyal,&#8221; which contained criticism of Trump.<\/p>\n<p data-testid=\"paragraph-2\">Fortunately, another judge ruled 16 days later that Cohen may be released from prison and serve time in home confinement, finding he had been targeted with retaliation. Cohen\u2019s prison term was completed in November 2021.<\/p>\n<p data-testid=\"paragraph-2\">But Cohen isn&#8217;t letting the matter rest. He filed a <a href=\"https:\/\/www.courtlistener.com\/docket\/61623456\/3\/cohen-v-united-states-of-america\/\">complaint<\/a> in December 2021 against Trump, former U.S. Attorney General William Barr, and Bureau of Prison officials, alleging that he was thrown back to prison in early July 2020 because the Trump administration retaliated against him for speaking about his book.<\/p>\n<p data-testid=\"paragraph-2\">In November 2022, U.S. District Judge Lewis Liman, a Trump appointee, <a href=\"https:\/\/www.courtlistener.com\/docket\/61623456\/76\/cohen-v-united-states-of-america\/\">dismissed<\/a> Cohen\u2019s lawsuit. However, Liman said his decision did \u201cprofound violence\u201d to Cohen\u2019s constitutional rights.<\/p>\n<p>\u201cCohen\u2019s complaint alleges an egregious violation of constitutional rights by the executive branch\u2014nothing short of the use of executive power to lock up the President\u2019s political enemies for speaking critically of him,\u201d Liman wrote in his ruling.<\/p>\n<p>In their Monday filing, lawyers for Cohen alleged that the judiciary has a responsibility to remediate the harm done by Trump and his subordinates.
