Since then, the nation\u2019s top court has failed to address justices \u201cfalling short of the ethical standards expected of other federal judges,\u201d Durbin said.<\/p>\n<p>Testifying in public could help \u201cstrengthen faith in our public institutions,\u201d he added.<\/p>\n<p>The Supreme Court did not\u00a0immediately respond to a request for comment, including whether Roberts would obey a subpoena if one were issued.<\/p>\n<p>\u201cLet him deal with a situation in his own backyard,\u201d\u00a0Sen. Lindsey Graham (R-S.C.), the panel\u2019s ranking member, told The Epoch Times in an emailed statement. \u201cI\u2019m not saying it\u2019s inappropriate; I\u2019m just saying I would be surprised if he agreed to come. And I would support his decision not to come.\u201d<\/p>\n<p>Senior congressional reporter Andrew Desiderio reported that Durbin said he could not issue a subpoena if the invitation is turned down because of the absence of Sen. Dianne Feinstein (D-Calif.).<\/p>\n<p>Feinstein, 89, has not been in Washington since February, leaving an equal number of Republicans and Democrats on the committee.<\/p>\n<p>The aging senator asked to be <a href=\"https:\/\/www.theepochtimes.com\/feinstein-asks-to-be-temporarily-replaced-on-senate-judiciary-committee-amid-calls-for-resignation_5193154.html\">temporarily replaced<\/a> as she recovers from shingles. Still, Graham\u00a0<a href=\"https:\/\/www.theepochtimes.com\/graham-blocks-schumers-attempt-to-temporarily-replace-feinstein-on-judiciary-committee-by-unanimous-consent_5204561.html\">blocked<\/a> the effort because he didn\u2019t want to help Senate Democrats approve more judges to the federal bench.<\/p>\n<p>Democrats hold a slim 51-49 majority in the Senate, giving them control of the upper chamber and each committee. (Anna Moneymaker\/Getty Images)<\/figure>\n<h2>\u2018Needs to Change\u2019<\/h2>\n<p>Durbin, the Senate majority whip, has been among the Democrats increasingly calling on the Supreme Court to enforce a code of conduct for justices.<\/p>\n<p>He issued a fresh call after the publication of <a href=\"https:\/\/www.propublica.org\/article\/clarence-thomas-scotus-undisclosed-luxury-travel-gifts-crow\">a report<\/a> about Justice Clarence Thomas accepting free vacations from a GOP megadonor. Thomas has <a href=\"https:\/\/www.theepochtimes.com\/supreme-court-justice-clarence-thomas-vows-to-follow-new-hospitality-reporting-rules_5179138.html\">denied<\/a> wrongdoing.<\/p>\n<p>\u201cThe highest court in America should not have the lowest standards when it comes to ethics. But for too long, that has been the case with the United States Supreme Court.
