Jason Smith (R-Mo.), who chairs that committee.<\/p>\n<p>Fox News <a href=\"https:\/\/www.foxnews.com\/politics\/congress-gears-up-smack-down-president-bidens-solar-handout\">reports<\/a> the resolution could receive a vote on the House floor next week. The Epoch Times has reached out to the committee for confirmation.<\/p>\n<p>A June 2022 <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/FR-2022-06-09\/pdf\/2022-12578.pdf\">proclamation<\/a> by President Joe Biden declared an emergency over the need for more solar energy capacity. It used that emergency to waive tariffs on solar panels from Thailand, Cambodia, Vietnam, and Malaysia for 24 months.<\/p>\n<p><div class=\"morearticles\"><strong>Read More<\/strong><\/p>\n<div class=\"post_list\">\n<div class=\"article\"><a href=\"https:\/\/www.theepochtimes.com\/massive-number-of-waste-pv-panels-in-china-raising-concerns-over-high-cost-of-recycling-environmental-pollution_5180753.html\">Massive Number of Waste PV Panels in China Raising Concerns Over High-Cost of Recycling, Environmental Pollution<\/a><\/div>\n<\/div>\n<\/div>\n<p>The proclamation came amid a Department of Commerce <a href=\"https:\/\/www.theepochtimes.com\/solar-panels-bidens-buy-china-plan_4532841.html?utm_source=News&#038;utm_medium=email&#038;utm_campaign=breaking-2021-06-19-2&#038;mktids=1b4fadfc3245d7b05449dc65b\">investigation<\/a> into China\u2019s actions to circumvent tariffs.<\/p>\n<figure id=\"attachment_4149533\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2021\/12\/10\/2021-12-09T020755Z_2_LYNXMPEHB801P_RTROPTP_4_CHINA-ECONOMY-INFLATION-1200x800.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> Workers at a production line manufacturing solar photovoltaic components at a factory in Zhejiang Province, China on Feb. 12, 2019. (Lin Yunlong\/Zhejiang Daily via Reuters)<\/figure>\n<p>Putting that proclamation into effect, a September 2022 <a href=\"https:\/\/www.federalregister.gov\/documents\/2022\/09\/16\/2022-19953\/procedures-covering-suspension-of-liquidation-duties-and-estimated-duties-in-accord-with\">rule<\/a> from Commerce referenced panels completed in those four countries with \u201cparts and components manufactured in the People\u2019s Republic of China.\u201d<\/p>\n<p>In a December 2022 preliminary finding, Commerce <a href=\"https:\/\/www.commerce.gov\/news\/press-releases\/2022\/12\/department-commerce-issues-preliminary-determination-circumvention\">concluded<\/a> that four companies that produce panels in China \u201care attempting to bypass U.S. duties by doing minor processing in one of the Southeast Asian countries before shipping to the United States.\u201d<\/p>\n<p>The <a href=\"https:\/\/waysandmeans.house.gov\/wp-content\/uploads\/2023\/04\/BILLS-118hjres39ih1.pdf\">resolution of disapproval<\/a>, which targets Commerce\u2019s September 2022 rule, passed the committee 26-13. The votes can be read <a href=\"https:\/\/waysandmeans.house.gov\/wp-content\/uploads\/2023\/04\/V1-H.J.RES-39-Passage.pdf\">here<\/a>.<\/p>\n<p>Rep. Terri Sewell (D-Ala.) joined Republicans in voting in favor of the resolution. Reps. Richard Neal (D-Mass.), Lloyd Doggett (D-Texas), Bill Pascrell (D-N.J.), and Dan Kildee (D-Mich.) didn\u2019t vote. Kildee was missing because he was undergoing <a href=\"https:\/\/thehill.com\/homenews\/house\/3956004-rep-dan-kildee-undergoes-cancer-surgery\/\">cancer surgery<\/a>.<\/p>\n<p>Sewell, Kildee, and Pascrel co-sponsored the resolution alongside several other Republicans and Democrats, running the gamut from Rep. Garret Graves (R-La.) to Rep. Judy Chu (D-Calif.), the committee\u2019s ranking member, said she thinks the resolution \u201cis not the right solution at this time.\u201d<\/p>\n<p>\u201cWhile the administration\u2019s emergency order is not perfect, it is a short-term intervention that gives solar projects in the pipeline a needed bridge,\u201d she said.<\/p>\n<p>Rep. Mike Thompson (D-Calif.) said the legislation \u201cwould cost American jobs.\u201d<\/p>\n<p>\u201cThe fact of the matter is, the U.S. domestic solar industry cannot at this time meet demand. Our domestic market is saturated,\u201d he said.<\/p>\n<p>Sewell defended the bill.<\/p>\n<p>\u201cAt the end of the day, this resolution is about enforcement of our trade laws,\u201d she said.<\/p>\n<p>Rep. (Drew Angerer\/Getty Images)<\/figure>\n<p>\u201cI do believe in an \u2018all-of-the-above\u2019 energy policy that supports whatever form of energy makes sense for the community, but that doesn\u2019t mean we should provide special treatment for unfairly traded solar panels that rely on supply chains dominated by our adversaries,\u201d he said.<\/p>\n<p>Josh Snead, trade counsel for the committee, described the one-sentence resolution in detail.<\/p>\n<h2>Hearing Examines Chinese Gains from IRA<\/h2>\n<p>China remained in focus for the committee in a <a href=\"https:\/\/waysandmeans.house.gov\/event\/hearing-on-the-u-s-tax-code-subsidizing-green-corporate-handouts-and-the-chinese-communist-party\/\">subsequent hearing<\/a>\u00a0on Wednesday.<\/p>\n<p>Experts testified regarding last year\u2019s Schumer-Manchin bill, dubbed the Inflation Reduction Act (IRA). It contained numerous tax credits and similar measures to incentivize renewable energy and similar technologies.<\/p>\n<p>\u201cWhile the wealthy and politically connected get a massive windfall from the Democrats\u2019 taxpayer-subsidized handouts, working families, small business owners, and farmers\u2014they\u2019re struggling,\u201d committee chair Smith said.<\/p>\n<p>He said the Biden administration\u2019s recent <a href=\"https:\/\/ustr.gov\/about-us\/policy-offices\/press-office\/press-releases\/2023\/march\/united-states-and-japan-sign-critical-minerals-agreement\">agreement on critical minerals with Japan<\/a> \u201callows benefits to flow to foreign companies.\u201d<\/p>\n<figure id=\"attachment_1795739\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2015\/09\/106002563_small.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> A machine shifts soil containing rare earth minerals to be loaded for export in Lianyungang City, Jiangsu Province, on Sept. 5, 2010. (STR\/AFP\/Getty Images)<\/figure>\n<p>Chu said the hearing was an example of Republicans \u201cus[ing] China to distract from their own policy failures,\u201d arguing that the IRA was doing a lot to reduce the United States\u2019 reliance on China.<\/p>\n<p>She also accused Republicans of rhetoric that \u201ccontributes to dangerous anti-Asian hate.\u201d<\/p>\n<p>Daniel Turner of Power the Future, an energy industry advocacy group, testified to China\u2019s <a href=\"https:\/\/powerthefuture.com\/study-the-fight-for-rare-earths-how-green-extremists-ignore-chinas-human-rights-record-and-threaten-u-s-national-security\/\">dominance<\/a> of rare earth mining even as some domestic mining projects halted under the current administration.<\/p>\n<p>\u201cThe metals and rare earths to \u2018go green\u2019 are still needed, but the jobs and the tax revenue are being outsourced rather than coming to Americans,\u201d he said in <a href=\"https:\/\/waysandmeans.house.gov\/wp-content\/uploads\/2023\/04\/D.-Turner-Written-Testimony.pdf\">written testimony<\/a>.<\/p>\n<p>Drew Horn, executive director of the rare earth supply chain company GreenMet, went into more detail regarding the threat from China.<\/p>\n<p>\u201cIt is imperative [the Department of the] Treasury close loopholes that currently enable Chinese companies to move operations to U.S. soil by partnering with U.S. companies,\u201d he said in <a href=\"https:\/\/waysandmeans.house.gov\/wp-content\/uploads\/2023\/04\/D.-Horn-Written-Testimony.pdf\">written testimony<\/a>.<\/p>\n<p>He cited <a href=\"https:\/\/www.theepochtimes.com\/fords-deal-with-chinese-ev-battery-maker-sparks-security-concerns_5072334.html\">Ford\u2019s decision to partner with a Chinese company<\/a>, Contemporary Amperex Technology Co., Limited (CATL), to build an electric vehicle battery factory in Michigan.<\/p>\n<figure id=\"attachment_4481881\" style=\"width: 600px\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2022\/05\/1.tagreuters.com2022binary_LYNXNPEI4J0V8-FILEDIMAGE-1200x800.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> FILE PHOTO: Ford logo is pictured at the 2019 Frankfurt Motor Show (IAA) in Frankfurt, Germany. REUTERS\/Wolfgang Rattay<\/figure>\n<p>Ford told The Epoch Times in February that it thinks the plant will benefit from the IRA\u2019s advanced manufacturing tax credit.<\/p>\n<p>Horn informed lawmakers that CATL and the People\u2019s Republic of China \u201care essentially the same thing.
