Gardner\u2019s lawyers are seeking dismissal of that case.<\/p>\n<p>Bailey asserts she neglected her duties by failing to properly staff her office and allowing thousands of criminal cases to languish. Gardner\u2019s lawyers counter that Bailey never even alleges she committed any \u201cintentional\u201d acts that would justify her ouster.<\/p>\n<p>Lawyers from Bailey\u2019s office argued that Gardner should be disqualified from holding office because of her alleged pattern of \u201cinaction\u201d and \u201cwillful neglect\u201d of her duties.<\/p>\n<p>A day before the hearing, a judge ordered Gardner to \u201cshow cause\u201d why she shouldn\u2019t be held in contempt of court for failing to ensure that prosecutors from her office show up for a murder trial on April 17. A hearing in that matter is set for April 24, <a href=\"https:\/\/www.stltoday.com\/news\/local\/crime-and-courts\/st-louis-judge-files-to-hold-kim-gardner-in-contempt-after-no-prosecutors-show-for\/article_3a7dc7bc-dd5b-11ed-a795-f734f7f7ac49.html\">the St. Louis Post-Dispatch reported.<\/a><\/p>\n<p>The contempt action comes after\u00a0a judge <a href=\"https:\/\/www.theepochtimes.com\/embattled-soros-backed-st-louis-prosecutor-sanctioned-by-judge-amid-new-complaints_5181998.html?utm_medium=social&#038;utm_source=twitter&#038;utm_campaign=digitalsub\">sanctioned Gardner<\/a> for failing to turn over evidence in a double murder case earlier this month.<\/p>\n<figure id=\"attachment_5195848\" style=\"width: 600px\" class=\"wp-caption alignnone\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2023\/04\/14\/id5195848-Bailey-Podium-1-1200x826.jpg\"><figcaption class=\"wp-caption-text\"><noscript><\/noscript><\/figcaption><\/a> Missouri Attorney General Andrew Bailey speaks to his staff in March 2023. (Courtesy of the Missouri Attorney General\u2019s Office)<\/figure>\n<p>During the hearing in Bailey\u2019s case against Gardner, a\u00a0representative of judges in St. Louis\u2019 22nd Circuit Court said: \u201cThe circuit attorney\u2019s office is now in a state of near total collapse.\u201d The man, whose name was unclear during a live broadcast of the Gardner hearing, told Visiting Judge John Torbitzky: \u201cAn expedited resolution of this matter is very important.\u201d<\/p>\n<p>Torbitzky is expected to decide within a couple of weeks whether to throw out Bailey\u2019s petition against Gardner. He ordered attorneys to file written arguments about the motion to dismiss within a week; Torbitzky said he would decide whether to dismiss the case promptly after that.<\/p>\n<p>If it proceeds, a trial likely would be held in September, based on a scheduling discussion during the hearing.<\/p>\n<p>In his original court filing (<a href=\"https:\/\/ago.mo.gov\/docs\/default-source\/press-releases\/amended-petition-in-quo-warranto.pdf?sfvrsn=e76df49e_2\" target=\"_blank\" rel=\"noopener\">pdf<\/a>) against Gardner, Bailey wrote:\u00a0\u201cShe has sacrificed the safety of the city of St. Louis. She has squandered the goodwill of the courts through misdirection and incompetence. She has turned away grieving families while murderers walk free.\u201d<\/p>\n<h2>Action Follows Outcry<\/h2>\n<p>But an attorney representing Gardner, Jonathan Sternberg, said Bailey doesn\u2019t have the goods on Gardner.<\/p>\n<p>\u201cThis is an attack on the democratic process by someone who was never elected,\u201d Sternberg said, taking a dig at Bailey, who was appointed to his position in January after the former attorney general, Eric Schmitt, became a member of the U.S. Senate. Bailey and Schmitt are Republicans; Gardner is a Democrat.<\/p>\n<p>\u201cMr. Bailey doesn\u2019t like the job Miss Gardner is doing,\u201d Sternberg said. So the appropriate remedy would be for Bailey to support an opposition candidate in the next election rather than trying to throw her out of office via a court proceeding, Sternberg said.<\/p>\n<p>Such drastic action should be reserved for cases involving intentional acts and corruption, which aren\u2019t alleged in this case, Sternberg said.<\/p>\n<h2>Janae Edmondson Case<\/h2>\n<p>Bailey filed the action against Gardner\u00a0<a href=\"https:\/\/www.theepochtimes.com\/after-teen-athlete-loses-both-legs-outside-judge-to-consider-removing-missouri-prosecutor_5086069.html\" target=\"_blank\" rel=\"noopener\">last month<\/a> following a public outcry over the tragic case of Janae Edmondson. That visiting teen athlete, who is from Tennessee,\u00a0<a href=\"https:\/\/www.theepochtimes.com\/teens-double-amputation-sparks-public-outcry-attempt-to-oust-prosecutor_5079118.html\" target=\"_blank\" rel=\"noopener\">lost both of her legs<\/a> in a pedestrian-vehicle crash.
