County, and I just have to speak on behalf of victims and speak on behalf of everyone,\u201d Villanueva explained. \u201cThe criminal justice system does not exist solely to satisfy the needs of criminal offenders. It is designed to satisfy the entire community, and most particularly, victims of crime. They need to know they\u2019re protected, that their assailant is not going through a revolving door right back on the streets, and that\u2019s not going to be accomplished under George Gasc\u00f3n\u2019s wish list.\u201d<\/p>\n<p>Gasc\u00f3n <a href=\"https:\/\/twitter.com\/BillFOXLA\/status\/1366474269371244547\">reportedly<\/a> described Sheriff Villanueva as \u201cmorally bankrupt\u201d after he endorsed the recall campaign.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">War of words brewing between LA Sheriff Alex Villanueva &#038; LA DA George Gascon. Today, Gascon called Sheriff \u201cmorally bankrupt\u201d.<br \/>Not fans of each other.<\/p>\n<p>\u2014 Bill Melugin (@BillFOXLA) <a href=\"https:\/\/twitter.com\/BillFOXLA\/status\/1366474269371244547?ref_src=twsrc%5Etfw\">March 1, 2021<\/a><\/p>\n<\/blockquote>\n<p>Gasc\u00f3n has been under fire since he issued a set of special directives after taking the oath of office on December 7. Gasc\u00f3n\u2019s orders included ending cash bail, stopping charging juveniles as adults, and banning prosecutors from seeking sentence enhancements while requiring they be withdrawn from pending matters. He later <a href=\"https:\/\/www.dailywire.com\/news\/los-angeles-countys-new-progressive-d-a-changes-policy-after-public-outcry\">amended<\/a> that policy after a public outcry, telling deputy district attorneys that they could file enhancements in a limited range of circumstances, including hate-motived crimes, child and elder abuse cases, sex abuse, and human sex trafficking. Still, a judge later <a href=\"https:\/\/www.dailywire.com\/news\/judge-issues-injunction-blocking-several-directives-from-l-a-countys-new-controversial-d-a\">issued<\/a> a preliminary injunction temporarily barring Gasc\u00f3n from directing prosecutors to drop sentencing enhancement in active cases, concluding the order violated California law. Gasc\u00f3n has said his legal team would appeal the court\u2019s decision, adding his office \u201cwill adjust its policies to be consistent with the ruling.\u201d<\/p>\n<p>There are <a href=\"https:\/\/da.lacounty.gov\/media\/news\/district-attorney-george-gascon-issues-amended-directive-sentencing-enhancements\">more than<\/a> 100 enhancements in California\u2019s penal code.<\/p>\n<p>\u201cAll of these sentencing enhancements are there for a reason: it\u2019s to keep communities safe, to keep the really, really bad people in jail as long as possible, and that is public safety,\u201d Sheriff Villanueva told \u201cThe Gary and Shannon Show.\u201d \u201cAnd this guy is absolutely not advocating on behalf of public safety.\u201d<\/p>\n<p>Villanueva said under Gasc\u00f3n\u2019s policies, hardened criminals would likely use juvenile gang members to commit offenses because \u201cthey know there\u2019s almost no consequences at all.\u201d<\/p>\n<p>\u201cThey are just going to have juveniles doing adult extortion of businesses and community members, and the D.A. is going to be laughing while the victims are suffering, and I cannot support that,\u201d he said.<\/p>\n<p>Gasc\u00f3n has repeatedly <a href=\"https:\/\/twitter.com\/GeorgeGascon\/status\/1367567441564340226\">cited<\/a> research that he says indicates sentence enhancements do not deter crime but are a primary driver of mass incarceration that disproportionately impacts people of color.<\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Sentence enhancements:<br \/>\u2013 Have never been shown to enhance public safety<br \/>\u2013 Are a primary driver of mass incarceration<br \/>\u2013 Fall disproportionately on communities of color<\/p>\n<p>In short, enhancements are unjust &#038; unnecessary.<br \/>(2\/10) <a href=\"https:\/\/t.co\/IHfmOn68f1\">pic.twitter.com\/IHfmOn68f1<\/a><\/p>\n<p>\u2014 George Gasc\u00f3n (@GeorgeGascon) <a href=\"https:\/\/twitter.com\/GeorgeGascon\/status\/1367567441564340226?ref_src=twsrc%5Etfw\">March 4, 2021<\/a><\/p>\n<\/blockquote>\n<p>He did not campaign on eliminating most sentencing enhancements, and his plan to do so, along with other elements of his progressive agenda, was met with immediate resistance. The new directives sparked a revolt from local law enforcement groups and several deputy district attorneys within Gasc\u00f3n\u2019s office. Victims\u2019 families and prosecutors connected with media outlets, and their stories helped create support for a recall effort.<\/p>\n<p>\u201cHe promised a softer and gentler criminal justice system that would reduce incarceration rates for minor offenders and place increased focus on mental health and addiction issues that plague our communities,\u201d the <a href=\"https:\/\/recallgeorgegascon.com\/\">website<\/a> promoting the recall says. \u201cBut the moment he was sworn in as District Attorney, George Gasc\u00f3n instituted a series of directives to prosecutors in his command that have nothing to do with a progressive approach to prosecution and have everything to do with a radical agenda that ignores victims, disregards the law and endangers the lives and livelihoods of all Angelenos.\u201d<\/p>\n<p>\u201cHe didn\u2019t tell voters that a defendant\u2019s prior criminal history have no impact on how a pending case against that defendant would be treated,\u201d it continues.<\/p>\n<p>The recall group, called \u201cVictims of Violent Crime for the Recall of District Attorney Gascon,\u201d is <a href=\"https:\/\/recallgeorgegascon.com\/endorsements\">chaired<\/a> by former L.A. City Councilman Dennis Zine, who, like Gasc\u00f3n, previously worked for the LAPD. Zine co-hosted a radio show in 2015 with Randy Economy, senior advisor to the ongoing campaign to recall California Democratic Governor Gavin Newsom.<\/p>\n<p>The Gasc\u00f3n recall group\u2019s honorary chairs are former L.A. County Supervisor Mike Antonovich and Tania Owen, the widow of L.A. County Sheriff\u2019s Sgt. Steve Owen, who was killed execution-style in the line of duty in 2016. She is described on the website as a \u201csurvivor\/victims\u2019 rights activist.\u201d <a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-27\/group-plans-to-launch-recall-effort-against-newly-elected-l-a-dist-atty-george-gascon\">According<\/a> to the Los Angeles Times, \u201cOwen said the prosecutor handling her husband\u2019s murder case called her the day Gasc\u00f3n was sworn in and said the office would no longer be seeking the death penalty, life without parole or any sentencing enhancements.\u201d<\/p>\n<p>\u201cQuite honestly, it was a gut punch,\u201d Ms. Owen told The Times. \u201cAs soon as I heard that, I said absolutely not. This will not happen on my watch.\u201d<\/p>\n<p>The recall campaign\u2019s honorary co-chairs include former L.A. County D.A. Steve Cooley, Fresno County (CA) D.A. Lisa Smittcamp, and Kern County (CA) D.A. Cynthia Zimmer.<\/p>\n<p>In a statement, D.A. Gasc\u00f3n addressed concerns of victims\u2019 families.<\/p>\n<p>\u201cThe pain and trauma of losing a loved one is immeasurable and I recognize and respect that some victims want me to impose the maximum punishment in their case,\u201d he <a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-27\/group-plans-to-launch-recall-effort-against-newly-elected-l-a-dist-atty-george-gascon\">said<\/a>. \u201cOur system of justice can\u2019t continue to rely on policies that create more victims tomorrow simply because some victims want the maximum punishment imposed in their case today.\u201d<\/p>\n<p>As the L.A. Times <a href=\"https:\/\/www.latimes.com\/california\/story\/2021-02-27\/group-plans-to-launch-recall-effort-against-newly-elected-l-a-dist-atty-george-gascon\">reported<\/a>, \u201can elected county official must be in office for 90 days before a recall petition can be filed,\u201d which means the process cannot officially begin until Monday, March 8. County officials must approve the wording of the recall petition. Then the campaign will have 160 days to gather \u201cupwards of 580,000 signatures,\u201d The Times reports.
