In other words, our tax dollars not only funded the development of tools to silence speech that dissented from the regime\u2019s narrative. They also paid for government employees to act as sales reps pitching the censorship products to Big Tech.<\/p>\n<div id=\"fdrlst__b89e9-735798138\" class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center;\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div id=\"fdrlst__b89e9-2859fa6a40af3e9d8a5dc9e5eee27ad2\" class=\"fdrlst__b89e9-2859fa6a40af3e9d8a5dc9e5eee27ad2 fdrlst__b89e9-paragraph-2\"><\/div>\n<p>I\u2019ve been \u201ctasked with building relationships with technology companies,\u201d Samaruddin Stewart, then a senior adviser for the State Department\u2019s Global Engagement Center or \u201cGEC,\u201d <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.189520\/gov.uscourts.lawd.189520.84.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> in an early-February 2020 introductory email to LinkedIn, allegedly requesting a meeting. According to the lawsuit, his email also suggested he would be reaching out to other social media companies interested in \u201ccountering disinformation.\u201d<\/p>\n<p>On March 9, 2020, Stewart again contacted LinkedIn, referencing an earlier verbal discussion and writing:<\/p>\n<blockquote class=\"wp-block-quote\"><p>I\u2019ll send information [to LinkedIn representatives] about gaining access to Disinfo Cloud \u2014 which is a GEC funded platform that offers stakeholders an opportunity to discover companies, technology, and tools that can assist with identifying, understanding, and addressing disinformation.<\/p><\/blockquote>\n<p>These two emails are explosive. Yet because they were revealed in two passing paragraphs of the 164-page <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.189520\/gov.uscourts.lawd.189520.84.0.pdf\">complaint<\/a> filed by Missouri, Louisiana, and a handful of other plaintiffs against the Biden administration, they \u2014 and their enormous significance \u2014 have been overlooked.<\/p>\n<h2 class=\"wp-block-heading\">\u2018Cold-Calling\u2019 Big Tech<\/h2>\n<p>The Stewart emails establish that in 2020, federal government actors contacted social media giants to promote <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\">GEC\u2019s<\/a> Disinfo Cloud. GEC represented that this government platform provided \u201ccompanies, technology, and tools\u201d to \u201cassist with identifying, understanding, and addressing disinformation.\u201d Then it gave private tech companies access to Disinfo Cloud.<\/p>\n<div id=\"fdrlst__b89e9-0898a6f08c0671249565a988924d9fce\" class=\"fdrlst__b89e9-0898a6f08c0671249565a988924d9fce fdrlst__b89e9-paragraph-6\"><\/div>\n<p>Almost identical to how GEC described Disinfo Cloud in congressional <a href=\"https:\/\/nsarchive.gwu.edu\/media\/25062\/ocr\" target=\"_blank\" rel=\"noreferrer noopener\">testimony<\/a>, the State Department\u2019s <a href=\"https:\/\/www.state.gov\/wp-content\/uploads\/2021\/04\/Disinfo-Cloud-flyer-April-042921.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">webpage<\/a> marketed it as a \u201cone-stop shop\u201d to \u201cidentify and then test tools that counter propaganda and disinformation.\u201d \u201cFact checking\u201d and \u201cmedia authentication\u201d are just a couple of the types of technologies available through the dashboard.<\/p>\n<figure class=\"wp-block-image size-large\"><\/figure>\n<p>GEC didn\u2019t just promote Disinfo Cloud or give Big Tech access to what GEC <a href=\"https:\/\/nsarchive.gwu.edu\/media\/25062\/ocr\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> \u201cthe U.S. government\u2019s online repository.\u201d Government employees at GEC also offered to help private companies <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\" target=\"_blank\" rel=\"noreferrer noopener\">identify<\/a> tools to suit their specific needs. Just \u201cwrite\u201d to the GEC\u2019s Technology Engagement Division about \u201cwhat your office needs to counter propaganda and disinformation,\u201d the State Department instructed on its webpage, and the government will \u201cassist\u201d in finding \u201ca technological solution.\u201d<\/p>\n<h2 class=\"wp-block-heading\">\u2018Testbed\u2019<\/h2>\n<p>Access to Disinfo Cloud, according to the State Department\u2019s <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\" target=\"_blank\" rel=\"noreferrer noopener\">webpage<\/a>, also provides \u201ca gateway\u201d to the <a href=\"https:\/\/www.state.gov\/bureaus-offices\/under-secretary-for-public-diplomacy-and-public-affairs\/global-engagement-center\/technology-engagement-division\/\">GEC\u2019s<\/a> Technology Engagement Division\u2019s \u201cTestbed,\u201d allowing users to review and test the technology against their unique needs.<\/p>\n<p>While Stewart\u2019s emails don\u2019t expressly mention the \u201cTestbed\u201d feature, the State Department <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\">boasts<\/a> that the \u201cprivate sector\u201d uses both Disinfo Cloud and Testbed. The GEC\u2019s webpage also invites Disinfo Cloud users to ask \u201cfor assistance in identifying a technological solution or draft a test proposal for a tool.\u201d If Disinfo Cloud users can\u2019t find a tool that works for them, the GEC Technology Engagement team <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\">stresses<\/a> it \u201cis open to insights and is here to help implement ideas to move the counter propaganda and disinformation mission forward.\u201d<\/p>\n<div id=\"fdrlst__b89e9-3cd1178167c4e60f67e667316a662585\" class=\"fdrlst__b89e9-3cd1178167c4e60f67e667316a662585 fdrlst__b89e9-paragraph-10\"><\/div>\n<h2 class=\"wp-block-heading\">Infomercials<\/h2>\n<p>Deposition testimony by FBI Agent Elvis Chan suggests GEC\u2019s marketing of the censorship tools went beyond making cold calls (or emails) to LinkedIn and other Big Tech companies. It also seemingly went further than providing product advice and samples on Disinfo Cloud: The GEC\u2019s Technology Engagement Division apparently hosted infomercials to help the private vendors market their censorship software.<\/p>\n<p>Chan, the assistant special agent in charge of the cyber branch at the FBI\u2019s San Francisco field office, was \u201cone of the primary people\u201d communicating with social media companies about supposed \u201cdisinformation,\u201d and thus is one of the named defendants in <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.lawd.189520\/gov.uscourts.lawd.189520.84.0.pdf\"><em>Missouri v. Biden.<\/em><\/a> As part of that litigation, the plaintiffs deposed Chan. During questioning, Chan testified that ahead of the 2020 election, he periodically spoke with Stewart, who would meet with the social media companies separately from Chan.<\/p>\n<p>According to Chan, Stewart met with policy individuals with the various social media companies about \u201cdifferent initiatives.\u201d Those initiatives included various kinds of vendor-made software \u201cthat they would pilot to see if they could detect malign foreign influence on social media platforms.\u201d<\/p>\n<p>Chan further testified that Stewart and GEC \u201cwould provide webinars\u201d from these vendors. As Chan explained, \u201c[T]he State Department was just providing a venue where different vendors could show off their products.\u201d The presentations were open to the general public, said Chan, but the GEC \u201cwould invite all sorts of audiences, to include researchers, employees from State Department counterparts, so typically Ministry of Foreign Affairs.\u201d The intended audience, according to Chan, was \u201cState Department-equivalent personnel, social media companies, and researchers.\u201d<\/p>\n<p>Chan said he attended only a couple of the webinars because the companies took only a \u201csurface-level\u201d look at the content, and thus he didn\u2019t consider the technology useful to the FBI. But apparently, it was fine for the State Department to market the same tools to social media companies.<\/p>\n<p>From Chan\u2019s deposition testimony, it appears Stewart, the GEC\u2019s then-senior adviser, made the equivalent of sales calls and hosted infomercials, all for the purpose of pushing various censorship services to social media companies.<\/p>\n<p>It is unclear whether these webinars were in addition to the GEC\u2019s \u201c<a href=\"https:\/\/www.state.gov\/programs-technology-engagement-division\/\">Tech Demo Series<\/a>\u201d \u2014 at which private vendors showcased their knack for fighting so-called disinformation for \u201cU.S. government counterparts and foreign partners\u201d \u2014 or whether, after the GEC <a href=\"https:\/\/www.govinfo.gov\/content\/pkg\/CHRG-116shrg41862\/html\/CHRG-116shrg41862.htm\">sent<\/a> a full-time representative to Silicon Valley in December of 2019 (presumably Stewart), the Tech Demo Series was opened to the public.\u00a0However, given that the official Disinfo Cloud Twitter account <a href=\"https:\/\/twitter.com\/DisinfoCloud\/status\/1336738294466490368\">promoted<\/a> the Tech Demo Series, it seems likely that GEC expanded its target audience for the series to include the private sector and other Disinfo Cloud users.<\/p>\n<p>Either way, Chan\u2019s deposition testimony reveals our government marketed censorship technology to social media companies through \u201cwebinars.\u201d And while Chan claimed he didn\u2019t think GEC endorsed the products, the government expressly represented the Disinfo Cloud technology as tools to \u201cassist\u201d with attacking so-called disinformation.<\/p>\n<h2 class=\"wp-block-heading\">The Tools<\/h2>\n<p>So what exactly were those tools?<\/p>\n<p>From open-source material, it is difficult, if not impossible, to identify the entire dataset of tech companies featured on Disinfo Cloud or participating in the Tech Demo Series. That\u2019s because Disinfo Cloud has \u201cbeen retired as [a] GEC-sponsored effort,\u201d <a href=\"https:\/\/www.state.gov\/defeat-disinfo\/\" target=\"_blank\" rel=\"noreferrer noopener\">according<\/a> to the State Department. The DisinfoCloud.com webpage has also been shuttered.<\/p>\n<p>But because GEC ran various \u201ctech challenges,\u201d giving winners State Department \u201csponsorship\u201d on the government\u2019s Disinfo Cloud Testbed \u2014 <a href=\"https:\/\/www.nsin.mil\/events\/disinfo-challenge\/\">advertised<\/a> as worth $25,000 \u2014 among other things, several censorship companies involved can be identified, including <a href=\"https:\/\/thefederalist.com\/2023\/03\/13\/newsguard-claims-not-to-be-government-funded-but-a-750k-grant-suggests-otherwise\/\">NewsGuard<\/a>, <a href=\"https:\/\/thefederalist.com\/2023\/03\/17\/dod-pays-media-rating-scammers-to-create-propaganda-and-censorship-tech-for-u-s-government\/\">PeakMetrics<\/a>, and <a href=\"https:\/\/www.newsguardtech.com\/press\/newsguard-wins-pentagon-state-department-contest-for-detecting-covid-19-misinformation-and-disinformation\/\">Omelas<\/a>.<\/p>\n<p>NewsGuard\u2019s censorship technology includes \u201cits\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/03\/14\/why-newsguard-is-just-as-bad-as-the-pro-censorship-global-disinformation-index\/\" target=\"_blank\" rel=\"noreferrer noopener\">unreliable<\/a>\u00a0reliability ratings database of thousands of news and information websites and a second database of purported hoaxes,\u201d as I <a href=\"https:\/\/thefederalist.com\/2023\/03\/21\/grants-reveal-federal-governments-horrific-plans-to-censor-all-americans-speech\/\">detailed<\/a> in March. NewsGuard\u2019s <a href=\"https:\/\/thefederalist.com\/2023\/03\/13\/newsguard-claims-not-to-be-government-funded-but-a-750k-grant-suggests-otherwise\/\" target=\"_blank\" rel=\"noreferrer noopener\">winning<\/a> tech-challenge entry built upon those databases and <a href=\"https:\/\/www.newsguardtech.com\/solutions\/misinformation-fingerprints\/\">used<\/a>\u00a0\u201cAI and social listening tools to identify the initial source of the hoax,\u201d and to find instances of the hoax being \u201crepeated or amplified\u201d online.<\/p>\n<p>The second winner, PeakMetrics, <a href=\"https:\/\/www.newsguardtech.com\/press\/newsguard-wins-pentagon-state-department-contest-for-detecting-covid-19-misinformation-and-disinformation\/\" target=\"_blank\" rel=\"noreferrer noopener\">offered<\/a> a dashboard for tracking mentions of a topic across multiple media channels with social listening technology. The third winner, Omelas, developed tools to visually map online information.<\/p>\n<p>The government gave these winners the ability to pilot their technology on Disinfo Cloud\u2019s Testbed. Then it promoted Disinfo Cloud to social media giants as offering \u201caccess to companies, technology, and tools that can assist with identifying, understanding, and addressing disinformation.\u201d<\/p>\n<p>So were NewsGuard, PeakMetrics, and Omelas among the companies GEC marketed to Big Tech? Did they participate in the government-run Tech Demos and present infomercials to the private sector? Did GEC help these vendors test their products for private companies on the Testbed?<\/p>\n<h2 class=\"wp-block-heading\">In Practice<\/h2>\n<p>Consider the implications, using NewsGuard to illustrate.<\/p>\n<p>NewsGuard rates various media outlets on a 100-point scale and provides a red \u201cunreliable\u201d rating if its \u201cexperts\u201d score the news source below 60. The company <a href=\"https:\/\/www.newsguardtech.com\/special-reports\/special-report-the-u-s-best-and-worst-of-2021\/\" target=\"_blank\" rel=\"noreferrer noopener\">rates<\/a> The Federalist \u201cred\u201d and claims it is one of the top-10 \u201cmost influential misinformers.\u201d Conversely, some of the outlets that <a href=\"https:\/\/thefederalist.com\/2022\/03\/18\/left-wing-rating-agency-grades-media-that-botched-hunter-biden-story-with-100-percent-credibility\/\">botched<\/a> the biggest political stories of the century maintain a 100 percent reliability score.<\/p>\n<p>The government awarded NewsGuard a $25,000 prize to develop new technology on Disinfo Cloud, using, in part, that ratings system as a backbone. NewsGuard would later receive an additional <a href=\"https:\/\/thefederalist.com\/2023\/03\/13\/newsguard-claims-not-to-be-government-funded-but-a-750k-grant-suggests-otherwise\/\">$750,000<\/a> from the government to advance the development of its censorship technology. PeakMetrics and Omelas also both <a href=\"https:\/\/thefederalist.com\/2023\/03\/21\/grants-reveal-federal-governments-horrific-plans-to-censor-all-americans-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">scored<\/a> additional government funding of $1.5 and $1 million respectively.<\/p>\n<p>But think about the government\u2019s other behind-the-scenes censorship entanglements. The government, via your tax dollars, funded both Disinfo Cloud, which provided the technology necessary to pilot the program, and the outside contractor, Park Advisors, that managed it.<\/p>\n<p>The State Department\u2019s GEC promoted the companies and technology featured on Disinfo Cloud, and a government liaison working for GEC personally contacted social media companies to encourage them to use the platform. The government also hosted Tech Demo Series for the vendors to market their products to the private sector.<\/p>\n<p>Disinfo Cloud regularly promoted private censorship technology on its official Twitter account and retweeted NewsGuard\u2019s announcement of its partnership with Mediabrands to \u201cbring NewsGaurd\u2019s rating work to TV news programming.<\/p>\n<div class=\"wp-block-image\"><\/div>\n<div class=\"wp-block-image\"><\/div>\n<p>Then beyond promoting the censorship tools, government employees working with GEC helped social media and private-sector businesses identify, test, and tweak the most \u201cappropriate\u201d technology for their \u201cneeds.\u201d<\/p>\n<p>And what are those \u201cneeds?\u201d\u00a0Censoring the speech of you and your fellow Americans.<\/p>\n<h2 class=\"wp-block-heading\">A Scandal Like No Other<\/h2>\n<p>This scandal far surpasses the one that formerly ensnared GEC, when it was revealed the State Department awarded the Global Disinformation Index (GDI) \u2014 another \u201cratings\u201d company that blacklists conservative outlets \u2014 $100,000 as part of the U.S.-Paris Tech Challenge. GDI also <a href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/equality-not-elitism\/disinformation-group-secretly-blacklisting-right-wing-outlets-bankrolled-state-department\" target=\"_blank\" rel=\"noreferrer noopener\">reportedly<\/a>\u00a0received money from other government-funded organizations. Those taxpayer funds helped finance GDI\u2019s blacklist of conservative media outlets, which advertisers relied upon to defund dissenters.<\/p>\n<p>But what Stewart\u2019s emails now reveal is that the government is not merely funding censorship research. It is acting as a sales rep to market censorship technology to private companies.<\/p>\n<p>The State Department isn\u2019t skirting the First Amendment. It is driving a stake through its heart.<\/p>\n<div id=\"fdrlst__b89e9-71f028efd803049262c465b074881427\" class=\"fdrlst__b89e9-71f028efd803049262c465b074881427 fdrlst__b89e9-after-post-content\"><\/div>\n<hr class=\"wp-block-separator\" \/>\n<div class=\"article-author-description fst-italic\">Margot Cleveland is The Federalist&#8217;s senior legal correspondent.
