Doug Burgum\u2019s veto of legislation seeking to ban the use of ranked-choice voting (RCV) in elections.<\/p>\n<p>\u201cIt\u2019s unfortunate that Gov. Burgum would veto such commonsense legislation protecting the right to vote in free and fair elections voters can trust,\u201d Ken Cuccinelli, the national chairman of the Election Transparency Initiative and former Virginia Attorney General, told The Federalist. RCV, he went on, \u201cmust always be rejected and we call on the legislature, which backed this bill with more than two-thirds majorities in each chamber\u201d to employ \u201ca veto override without delay.\u201d<\/p>\n<p>On Thursday, Burgum vetoed <a href=\"https:\/\/ndlegis.gov\/assembly\/68-2023\/regular\/bill-actions\/ba1273.html\" target=\"_blank\" rel=\"noreferrer noopener\">HB 1273<\/a>, which seeks to <a href=\"https:\/\/ndlegis.gov\/assembly\/68-2023\/regular\/documents\/23-0371-05000.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">prohibit<\/a> the use of RCV \u201cin determining the election or nomination of any candidate to any local, state, or federal elective office.\u201d The measure passed the Senate last week (33-13) after previously clearing the House of Representatives (74-19) in February. <\/p>\n<p>Under RCV, voters rank candidates in order of preference. If no candidate receives a majority of first-choice votes in the first round of voting, the last-place finisher is eliminated, and his votes are reallocated to the voter\u2019s second-choice candidate. Such a process continues until one candidate receives a majority of votes.<\/p>\n<p>In a letter sent to North Dakota House Speaker Dennis Johnson on Thursday, Burgum claimed HB 1273 \u201cundermines local control of local political subdivisions exercising their granted powers\u201d under state law.<\/p>\n<p>\u201cHouse Bill 1273 blatantly infringes on local control and the ability of residents in home rule cities to determine which method of local city election is best for their communities based on the unique aspects of city elections, including those that often have a very large field of candidates elected at-large and not by wards, with no party affiliation and no primary or runoff elections,\u201d Burgum wrote.<\/p>\n<p>In his remarks, Cuccinelli called Burgum\u2019s analysis \u201cmisguided\u201d and blasted RCV as \u201ca scheme designed by Democrats and liberal Republicans to confuse voters, protect failed lawmakers who have long lost the confidence of their constituents, and to ultimately rig elections in their favor.\u201d<\/p>\n<p>RCV has \u201cbeen an unmitigated disaster when implemented in public elections, makes voting more difficult, reduces transparency, and puts voter confidence at risk,\u201d Cuccinelli said. \u201cUnder a Ranked-Choice Voting Scheme, liberal politicians get elected to office and conservative candidates are defeated.\u201d<\/p>\n<p>Johnson did not respond to The Federalist\u2019s request for comment on whether he intends to hold a veto override vote for HB 1273.<\/p>\n<p>States that have implemented an RCV system have shown validity to Cuccinelli\u2019s assessment. While Maine and Alaska are the only two states to employ RCV so far, their respective elections since implementing the system have produced outcomes that clearly contradict the desires of voters. <\/p>\n<p>In Maine, then-incumbent GOP Rep. Bruce Poliquin\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/maine-congressman-loses-seat-in-controversial-ranked-choice-voting-race\" target=\"_blank\" rel=\"noreferrer noopener\">lost<\/a>\u00a0to Democrat Jared Golden during the 2018 midterms, despite Poliquin winning the most votes in the first round of voting. That outcome was due to the state\u2019s ranked-choice voting system.<\/p>\n<p>Similarly, in Alaska, Democrat Mary Peltola\u00a0<a href=\"https:\/\/thefederalist.com\/2023\/01\/11\/ranked-choice-voting-keeps-rigging-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">won<\/a>\u00a0the state\u2019s at-large congressional seat last year even though \u201cnearly 60 percent of voters [cast] their ballots for a Republican.\u201d RCV also played a major role in helping Alaska GOP Sen. Lisa Murkowski fend off a challenge from Trump-backed Kelly Tshibaka during the 2022 midterms. The system allowed her to win\u00a0due to being\u00a0<a href=\"https:\/\/www.adn.com\/politics\/2022\/11\/23\/alaska-us-sen-lisa-murkowski-wins-reelection\/\" target=\"_blank\" rel=\"noreferrer noopener\">listed second<\/a>\u00a0on Alaska Democrats\u2019 ranked-choice ballots.<\/p>\n<p>\u201cNow more than ever, we need to safeguard the integrity of our elections and the confidence of voters, but disastrous Ranked-Choice Voting schemes do precisely the opposite,\u201d Cuccinelli said.<\/p>\n<p>States that have banned the use of ranked-choice voting in elections include <a href=\"https:\/\/reason.com\/2022\/04\/28\/florida-tennessee-ban-ranked-choice-voting-despite-citizen-support\/\" target=\"_blank\" rel=\"noreferrer noopener\">Florida, Tennessee<\/a>, <a href=\"https:\/\/thefederalist.com\/2023\/03\/23\/south-dakota-bans-ranked-choice-voting-in-elections-and-idaho-could-be-next\/\" target=\"_blank\" rel=\"noreferrer noopener\">South Dakota<\/a>, and <a href=\"https:\/\/thefederalist.com\/2023\/04\/03\/idaho-takes-an-axe-to-ranked-choice-voting-in-elections-and-north-dakota-and-arizona-could-follow-suit\/\" target=\"_blank\" rel=\"noreferrer noopener\">Idaho<\/a>. Other states, such as <a href=\"https:\/\/legiscan.com\/AZ\/votes\/HB2552\/2023\" target=\"_blank\" rel=\"noreferrer noopener\">Arizona<\/a>, <a href=\"https:\/\/thefederalist.com\/2023\/02\/14\/after-ranked-choice-voting-rigged-their-elections-alaska-conservatives-fight-to-reclaim-democracy\/\" target=\"_blank\" rel=\"noreferrer noopener\">Alaska<\/a>,\u00a0<a href=\"https:\/\/capitol.texas.gov\/BillLookup\/History.aspx?LegSess=88R&#038;Bill=SB921\" target=\"_blank\" rel=\"noreferrer noopener\">Texas<\/a>, and\u00a0<a href=\"http:\/\/laws.leg.mt.gov\/legprd\/LAW0203W$BSRV.ActionQuery?P_SESS=20231&#038;P_BLTP_BILL_TYP_CD=HB&#038;P_BILL_NO=598&#038;P_BILL_DFT_NO=&#038;P_CHPT_NO=&#038;Z_ACTION=Find&#038;P_ENTY_ID_SEQ2=&#038;P_SBJT_SBJ_CD=&#038;P_ENTY_ID_SEQ=\" target=\"_blank\" rel=\"noreferrer noopener\">Montana<\/a>, are considering RCV bans.<\/p>\n<hr>\n<p>   Shawn Fleetwood is a Staff Writer for The Federalist and a graduate of the University of Mary Washington.
