As a result, mifepristone will be suspended from the FDA\u2019s list of approved drugs to initiate chemical abortions.<\/p>\n<p>\u201cChemical abortion is only the status quo insofar as Defendants\u2019 unlawful actions and their delay in responding to Plaintiffs\u2019 petitions have made it so,\u201d the judge wrote. \u201cThe fact that injunctive relief could upset this \u2018status quo\u2019 is therefore an insufficient basis to deny injunctive relief.\u201d <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1885240303\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div  class=\"fdrlst__b89e9-aa0bfa63ec78ad4fec5f4f6965b9babe fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-aa0bfa63ec78ad4fec5f4f6965b9babe\"><\/div>\n<p>For more than <a href=\"https:\/\/aaplog.org\/wp-content\/uploads\/2021\/01\/2002-Aug-Citizen-Petition_Mifeprex-8.20.02.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">two decades<\/a>, pro-life doctors have repeatedly asked the FDA via citizen petition to repeal its approval of chemical abortion drugs because \u201cthe agency violated federal laws by approving these drugs and ignoring the substantial evidence that these drugs harm women and girls.\u201d Despite the FDA\u2019s legal requirement to address these concerns, the agency repeatedly stonewalled petitioners\u2019 requests for years. <\/p>\n<p>Now, 23 years after the FDA rubber-stamped mifepristone,\u00a0Trump-appointed U.S. District Judge Matthew Kacsmaryk decided this week from the Amarillo, Texas federal courthouse that the FDA chose politics over safety in endorsing the widespread use of abortion pills. <\/p>\n<p>\u201cTo begin, FDA \u2018entirely failed to consider an important aspect of the problem\u2019 by omitting any evaluation of the psychological effects of the drug or an evaluation of the long term medical consequences of the drug,\u201d Kacsmaryk wrote.<\/p>\n<p>The Biden administration has seven days to appeal the decision to the State Court of Appeals for Fifth Circuit before the ruling is enforced. Meanwhile, a Washington judge issued a <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.waed.102225\/gov.uscourts.waed.102225.80.0.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">contradicting injunction<\/a> on Friday evening claiming to prohibit the FDA from changing the abortion pills\u2019 approval status. <\/p>\n<div  class=\"fdrlst__b89e9-6a6f266dae473f7882977843067ef9f4 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-6a6f266dae473f7882977843067ef9f4\"><\/div>\n<p>In November, Alliance for Hippocratic Medicine, a coalition of five pro-life medical associations and institutions, along with doctors Shaun Jester, Regina Frost-Clark, Tyler Johnson, and George Delgado\u00a0<a href=\"https:\/\/adflegal.org\/sites\/default\/files\/2022-11\/Alliance-for-Hippocratic-Medicine-v-FDA-2022-11-18-Complaint.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">formally alleged in a federal lawsuit<\/a> that in 2000 the FDA wrongfully used accelerated drug approval authority to endorse abortion pills that can cause dangerous complications. Accelerated drug approval authority is a process largely used to fast track treatments of serious or life-threatening illnesses. The coalition\u2019s pleas for injunction were supported by more than a dozen friends of the court briefs from several <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-CLIAmicusBrief.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">pro-life organizations<\/a>, <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-AmicusBriefOfSixtySevenMembersOfCongress.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">67 members of Congress<\/a>, and <a href=\"https:\/\/adfmedialegalfiles.blob.core.windows.net\/files\/AHM-AmicusBriefForStatesInSupportOfPlaintiffs.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">22 states<\/a>.<\/p>\n<p>Approval of abortion pill mifepristone was only possible, the plaintiffs argued, because the FDA characterized pregnancy as an \u201cillness\u201d and the drugs that cause infant and <a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/33939340\/\" target=\"_blank\" rel=\"noreferrer noopener\">sometimes mother fatalities<\/a> as \u201cmeaningful therapeutic benefit.\u201d There was no scientific evidence to back that classification.<\/p>\n<p>The FDA is legally tasked with studying the effects of drugs before greenlighting them. When it came to the complications chemical abortion inducers can have on babies, adolescent girls, and women, plaintiffs say the regulatory agency turned a blind eye. <\/p>\n<p>New polling found <a href=\"https:\/\/sbaprolife.org\/wp-content\/uploads\/2023\/03\/3-16-23-National-Survey-FDA.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">75 percent<\/a> of Americans think the FDA should have performed studies focused on girls under the age of 18 before approving chemical abortion for minors. Instead, the agency doubled down on its dishonesty, something 56 percent of Americans find untrustworthy, according to a March poll conducted by CRC Research for Susan B. Anthony Pro-Life America.  <\/p>\n<div  class=\"fdrlst__b89e9-e64402e973f775817a93da6ff3902d66 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-e64402e973f775817a93da6ff3902d66\"><\/div>\n<p>In 2016, the FDA expanded when girls and women could take the pill, changed its dosing, reduced the required number of doctor visits to obtain the drug, allowed more people than licensed doctors to prescribe the pill, and eradicated reporting standards for non-fatal complications from the pills. <\/p>\n<p>Mere months after pro-lifers filed their lawsuit, the FDA <a href=\"https:\/\/thefederalist.com\/2023\/01\/05\/fda-aids-bidens-abortion-for-all-agenda-by-letting-pharmacies-sell-dangerous-abortion-pill\/\" target=\"_blank\" rel=\"noreferrer noopener\">quietly modified<\/a> its already debated regulation to accommodate the <a href=\"https:\/\/www.reuters.com\/world\/us\/biden-administration-signals-fight-over-medication-abortion-2022-06-25\/\" target=\"_blank\" rel=\"noreferrer noopener\">White House\u2019s<\/a> post-<em>Roe<\/em>\u00a0activism and open the door for the nation\u2019s pharmacies to become abortion pill dispensaries. Prior to that decision, mifepristone could only be obtained via clinic, doctor, or\u00a0<a href=\"https:\/\/thefederalist.com\/2021\/12\/17\/biden-administration-endorses-more-baby-killing-by-green-lighting-mail-order-abortion-pills\/\" target=\"_blank\" rel=\"noreferrer noopener\">mail order<\/a>, a lockdown-era provision the Biden administration made permanent in 2021.  <\/p>\n<p>\u201cThe FDA never studied the safety of the drug regimen and disregarded clear evidence that the pills cause life-threatening complications. As a result of ignoring the science, women and girls became victims of the FDA\u2019s reckless agenda-driven approval,\u201d said Alliance Defending Freedom senior counsel Erik Baptist, who is representing the pro-life groups, during a Thursday press conference. <\/p>\n<h2>Abortion Pills Were Never Safe<\/h2>\n<p>Contrary to what courthouse <a href=\"https:\/\/www.yahoo.com\/gma\/why-protesters-dressed-kangaroos-clowns-155900235.html?soc_src=social-sh&#038;soc_trk=tw&#038;tsrc=twtr\" target=\"_blank\" rel=\"noreferrer noopener\">protestors<\/a>, the FDA, and CNN <a href=\"https:\/\/www.cnn.com\/2023\/03\/15\/health\/abortion-pill-safety-dg\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">claim<\/a> about the \u201csafety\u201d of abortion pills, mifepristone is responsible for a\u00a0<a href=\"https:\/\/journals.sagepub.com\/doi\/full\/10.1177\/23333928211053965\" target=\"_blank\" rel=\"noreferrer noopener\">500 percent increase<\/a>\u00a0in abortion-related emergency room visits. One longitudinal study revealed that in at least 17 states with taxpayer-funded abortion, many of which have relaxed chemical abortion laws, emergency room visits within 30 days following chemical abortions grew to nearly 34 percent of all ER visits as of 2015. <\/p>\n<p>The same study concluded \u201cchemical abortion is consistently and progressively associated with more postabortion ER visit morbidity than surgical abortion\u201d and the\u00a0risks have increase \u00a0<a href=\"https:\/\/pubmed.ncbi.nlm.nih.gov\/30253769\/\" target=\"_blank\" rel=\"noreferrer noopener\">year after year<\/a>. Most studies don\u2019t cover the <a href=\"https:\/\/thefederalist.com\/2019\/11\/07\/what-they-dont-tell-women-about-chemical-abortions-will-hurt-you\/\" target=\"_blank\" rel=\"noreferrer noopener\">emotional toll chemical abortions<\/a> often have on women either. <\/p>\n<p>Already, corporate media outlets like <a href=\"https:\/\/slate.com\/news-and-politics\/2023\/03\/ignore-judge-matthew-kacsmaryk-abortion-pill-ruling.html\" target=\"_blank\" rel=\"noreferrer noopener\">Slate<\/a> and politicians like <a href=\"https:\/\/www.opb.org\/article\/2023\/02\/16\/abortion-bills-looming-court-ruling-oregon-senator-ron-wyden-speech\/\" target=\"_blank\" rel=\"noreferrer noopener\">Sen. Ron Wyden<\/a>, D-Ore., are calling on the Biden administration, the FDA, and members of the public to ignore the Trump appointee\u2019s ruling. <\/p>\n<p>Dr. Ingrid Skop, a senior fellow and director of medical affairs for Charlotte Lozier Institute, told The Federalist that pro-abortion activists are going one step further by <a href=\"https:\/\/www.cbsnews.com\/news\/medication-abortion-texas-lawsuit-fda-providers-mifepristone-misoprostol-only\/\" target=\"_blank\" rel=\"noreferrer noopener\">promoting<\/a> the use of one part of the chemical abortion drug regimen by itself.<\/p>\n<p>Misoprostol, the stomach ulcer drug often prescribed with mifepristone to aid abortion, will remain on the market but is not approved by the FDA for abortions <a href=\"https:\/\/www.fda.gov\/drugs\/postmarket-drug-safety-information-patients-and-providers\/misoprostol-marketed-cytotec-information\" target=\"_blank\" rel=\"noreferrer noopener\">because<\/a> \u201cno company has sent the FDA scientific proof that misoprostol is safe and effective for these uses.\u201d Not only is the ulcer drug even less regulated by FDA than mifepristone, but Skop said it is linked to far more complications when used for chemical abortion alone.  <\/p>\n<p>\u201cNearly one out of four women who take misoprostol are going to need surgery. So it\u2019s even going to get worse going from <a href=\"https:\/\/lozierinstitute.org\/fact-sheet-risks-and-complications-of-chemical-abortion\/\" target=\"_blank\" rel=\"noreferrer noopener\">one out of 20<\/a> [post-mifepristone] to one out of five or one out of four,\u201d Skop said.<\/p>\n<div  class=\"fdrlst__b89e9-df9250a0aa2f7a96308acb2b9b2729fd fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-df9250a0aa2f7a96308acb2b9b2729fd\"><\/div>\n<hr class=\"wp-block-separator\">\n<div class=\"article-author-description fst-italic\">   Jordan Boyd is a staff writer at The Federalist and co-producer of The Federalist Radio Hour.
