href=\"https:\/\/nypost.com\/2023\/04\/01\/indictment-makes-trump-stronger-his-friends-say-and-foes-agree\/\">Donald Trump had been indicted<\/a> was \u201cBanana republic, here we come.\u201d\u00a0<\/p>\n<p>After seeing the instant jubilation on the left, including in the media, my second thought was, \u201cBanana republic, here we are.\u201d\u00a0<\/p>\n<p>It\u2019s a clich\u00e9 to say we\u2019ve crossed the Rubicon, but that doesn\u2019t make it less true. <\/p>\n<p>That we did it under the poisoned guise of <a href=\"https:\/\/nypost.com\/2023\/03\/30\/democratic-manhattan-da-alvin-bragg-has-a-bad-case-of-bias\/\">Manhattan District Attorney Alvin Bragg<\/a> makes the moment all the more ridiculous \u2014 and perilous.\u00a0<\/p>\n<p>There are so many persuasive arguments against the case that the sensible conclusion is that Bragg\u2019s charges represent a legal stretch, and thus were brought for political reasons. <\/p>\n<p>That happens routinely in autocracies and banana republics, and now it\u2019s happened in America.\u00a0<\/p>\n<p>The celebrations, including ones outside Trump Tower on Fifth Avenue and instant polls showing nearly <a href=\"https:\/\/nypost.com\/2023\/04\/01\/house-dems-show-hypocrisy-over-trump-stormy-daniels-indictment\/\">all Democrats favor the charges<\/a>, confirm the partisan flavor.\u00a0<\/p>\n<p>The <a href=\"https:\/\/nypost.com\/2023\/03\/31\/trump-charged-with-at-least-one-felony-in-stormy-daniels-case\/\">charges haven\u2019t been released<\/a>, but all that mattered was that Trump was being \u201cheld accountable,\u201d as one sign said, no matter what for and whether it was legitimate. <\/p>\n<p>This is score settling, not a quest for above the law, and everyone has the right to a trial to prove innocence,\u201d she wrote.\u00a0<\/p>\n<p>Is it possible she doesn\u2019t know that, in America, the burden of proof is on the government and all defendants are presumed innocent?\u00a0<\/p>\n<p>Or was she lifting the veil on a dystopian future where the left gains total power and locks up opponents and dissenters?\u00a0<\/p>\n<p>In happened 17 years ago, in 2006. <\/p>\n<p>The hush-money payments of $130,000 were made in 2016, seven years ago, during <a href=\"https:\/\/nypost.com\/2016\/11\/09\/donald-trump-is-elected-president-in-historic-upset\/\">Trump\u2019s successful run for the presidency<\/a>.\u00a0<\/p>\n<p>Had Trump lost, the case never hardened criminals as victims of racism, reportedly built his case on a novel theory about a campaign-finance violation. <\/p>\n<p>Apparently, that\u2019s the only way he could avoid running afoul of a statute of limitations and also create at least one felony rap out of misdemeanor-level violations.\u00a0<\/p>\n<p>He should have stuck with his initial refusal to bring the case because it was weak, which is why federal prosecutors and the Federal Election Commission declined to pursue it. <\/p>\n<p>Instead, berated as a coward by far-left militants, Bragg bent to the mob and kept a campaign promise to get Trump.\u00a0<\/p>\n<p>He shares the motivation with his chief witness, <a href=\"https:\/\/nypost.com\/2023\/03\/22\/2018-letter-shows-michael-cohen-lying-to-federal-officials\/\">Michael Cohen<\/a>. <\/p>\n<p>The former Trump lawyer is a notorious liar who spent three years in federal prison for tax evasion and other charges and has been on a revenge mission to get his former boss. <\/p>\n<p>Cohen vowed to work with prosecutors and do whatever it took to save himself, according to his former lawyer.\u00a0<\/p>\n<figure class=\"wp-block-image size-large\"><button class=\"button button--modal-trigger\" aria-label=\"Open the image in a modal.\" data-modal-image=\"26405862\"> \t<svg class=\"icon-plus\" fill=\"#fff\" xmlns=\"http:\/\/www.w3.org\/2000\/svg\" viewbox=\"0 0 1033 1000\" width=\"1em\" height=\"1em\"><path d=\"M380 at least as important that Trump is also <a href=\"https:\/\/nypost.com\/2023\/03\/26\/trump-texas-rally-falls-quiet-after-he-mocks-ron-desantis\/\">a current candidate<\/a> for president.\u00a0<\/p>\n<p>Look at it this way: The Democratic Party of <a href=\"https:\/\/nypost.com\/2023\/03\/31\/gop-calls-for-biden-charges-after-trump-indictment\/\">President Biden<\/a> and Alvin Bragg aims to lock up the man who was Biden\u2019s Republican opponent in 2020 and <a href=\"https:\/\/nypost.com\/2023\/03\/19\/team-biden-prepares-for-onslaught-of-criticism\/\">could be again in 2024<\/a>. <\/p>\n<p>Those facts alone would horrify the Founders and every generation of patriots since.\u00a0<\/p>\n<p>That\u2019s why the taint surrounding the case doesn\u2019t just leave a smell of politics. Hochul<\/a>. <\/p>\n<p>Recall that Zeldin vowed to fire Bragg on Day One on the grounds that the prosecutor was refusing to do his job of enforcing the criminal codes.\u00a0<\/p>\n<p>Bragg not only survived, he has finally found someone he believes deserves conviction and prison.\u00a0<\/p>\n<aside class=\"single__inline-module alignleft\">\n<div class=\"inline-module federal probes overseen by a special prosecutor. <\/p>\n<p>Maybe Bragg figured the glory would go to the Dem avenger who got the first scalp.\u00a0<\/p>\n<p>Those cases have their own weaknesses, but each already has more credibility than Bragg\u2019s wild stab at fame.\u00a0<\/p>\n<p>The Georgia case centers on a widely circulated phone call where Trump was recorded asking the Republican secretary of state to \u201cfind\u201d him enough votes to overturn the results of the 2020 presidential election <a href=\"https:\/\/nypost.com\/2021\/01\/03\/trump-tells-georgia-officials-to-find-votes-to-defeat-biden\/\">and award him<\/a>, not Biden, Georgia\u2019s 16 electoral votes. <\/p>\n<p>If he didn\u2019t, Trump suggested, the secretary and his lawyer could be guilty of \u201ca criminal offense.\u201d\u00a0<\/p>\n<h2>Classified hypocrisy\u00a0<\/h2>\n<p>Of the two federal cases, both under special prosecutor Jack Smith, one involves the <a href=\"https:\/\/nypost.com\/2023\/03\/31\/donald-trump-hammers-out-defense-at-mar-a-lago-for-indictment\/\">cache of classified documents<\/a> Trump allegedly kept at Mar-a-Lago. <\/p>\n<p>The history of the back-and-forth between Trump\u2019s lawyers and the National Archives, which owns the documents, is tangled, but the Justice Department\u2019s decision to conduct an FBI raid to execute a search warrant leaves a clear impression of partisan overreach.\u00a0<\/p>\n<p>A comparison of how Biden has been treated in connection documents.\u00a0<\/p>\n<p>He even gave the highly unusual permission for Biden\u2019s own lawyers to conduct some searches. <\/p>\n<p>It\u2019s not clear the lawyers had security clearances themselves, suggesting a reckless level of favoritism.\u00a0<\/p>\n<p>While there have been leaks and numerous court reports about the Trump probes, there\u2019s total radio silence about Biden\u2019s case. <\/p>\n<p>And don\u2019t forget that key information about the president\u2019s cache was withheld from the public until after the November midterms, a move that amounts to election meddling by <a href=\"https:\/\/nypost.com\/2023\/03\/01\/ag-garland-fentanyl-unleashed-on-purpose-in-us-by-cartels\/\">Attorney General Merrick Garland<\/a>.\u00a0<\/p>\n<p>In fact, partisan bias at the Department of Justice and the FBI is the only possible explanation for the wildly disparate approaches to the document cases.\u00a0<\/p>\n<p>The second federal Trump case centers on the <a href=\"https:\/\/nypost.com\/2023\/04\/01\/qanon-shaman-jacob-chansley-spotted-at-halfway-house\/\">Jan. 6 Capitol riot<\/a> and whether he broke any laws in connection with it. <\/p>\n<p>The political taint in this one is fundamental, in that the probe grows out of Pelosi\u2019s rigged House committee investigation that conveniently lasted for the first two years of Biden\u2019s term, including the midterm elections. <\/p>\n<p>Garland, a bitter partisan hack, picked up the Pelosi baton and handed it off to Smith after the first Biden classified documents were interest. <\/p>\n<p>But any conflict occurred the minute the Trump probe began because Garland works for Biden.\u00a0<\/p>\n<p>Even more egregious, the AG reserved for himself the power to make the final decisions, including whether to seek criminal charges against either man. <\/p>\n<p>That\u2019s hardly a minor detail given the way Garland has protected the president and his son, Hunter Biden, from federal charges in the family\u2019s influence-peddling schemes.\u00a0<\/p>\n<p>So the deck is heavily stacked against Trump, a fact that helps explain why no previous incumbent party and having two political consequences. <\/p>\n<p>First, it is turning his would-be GOP opponents into defenders, with Florida <a
