The prosecution and expected arrest of a former president \u2014 and likely presidential challenger \u2014 is a serious thing, made all the more outrageous by the nakedly political nature of New York D.A. Alvin Bragg\u2019s mission. Bragg appears to be ginning up a criminal probe out of a possible campaign finance issue that federal prosecutors had already declined to pursue.<\/p>\n<p>While the alliance of media and Democrat operatives who have been on a mission to bring Trump down since before the 2016 election rejoice over the unprecedented move, it\u2019s worth revisiting the myriad times that their ilk decried Trump\u2019s 2016 campaign pledge to have his attorney general \u201cget a special prosecutor to look into\u201d Hillary Clinton\u2019s malfeasance, and subsequent chants of \u201cLock her up!\u201d at campaign rallies.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-2058541253\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div  class=\"fdrlst__b89e9-534ae64125be1edcae258f50c2c57e3d fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-534ae64125be1edcae258f50c2c57e3d\"><\/div>\n<p>Here are just 20 examples.<\/p>\n<p>\u201cNot a healthy sign in a democracy when the case against your opponent is that she should be imprisoned,\u201d <a href=\"https:\/\/twitter.com\/RyanLizza\/status\/755579285381980160\" target=\"_blank\" rel=\"noreferrer noopener\">worried<\/a> Ryan Lizza, then of The New Yorker, in 2016.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>In a tweet about the \u201clock her up\u201d chant, then-Politico writer Julia Ioffe <a href=\"https:\/\/twitter.com\/juliaioffe\/status\/755577766888603649\" target=\"_blank\" rel=\"noreferrer noopener\">asked<\/a>, \u201cSince when do Americans advocate jailing political opponents?\u201d <\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>\u201cIn a democracy, you can\u2019t threaten to jail your opponents,\u201d <a href=\"https:\/\/talkingpointsmemo.com\/livewire\/president-obama-trump-democracy-jailing-clinton?utm_content=buffer9e8d3&#038;utm_medium=social&#038;utm_source=twitter.com&#038;utm_campaign=buffer\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> former President Barack Obama in 2016. \u201cWe have fought against those kinds of things.\u201d<\/p>\n<div  class=\"fdrlst__b89e9-cc81a130defd87c7164e612a2a1f439f fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-cc81a130defd87c7164e612a2a1f439f\"><\/div>\n<p>\u201cTrump threatened to jail Clinton if elected. These countries might do the same,\u201d <a href=\"https:\/\/www.cnn.com\/2016\/10\/10\/politics\/countries-that-jail-opposition-second-presidential-debate\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">headlined<\/a> a CNN piece comparing Trump\u2019s comment to \u201cauthoritarian regimes.\u201d The article further quoted CNN\u2019s Dana Bash saying \u201cwhat makes this country different from countries with dictators in Africa or Stalin or Hitler or any of those countries with dictators and totalitarian leaders is when they took over, they put their opponents in jail.\u201d<\/p>\n<p>\u201cA line was crossed that I don\u2019t know has been crossed in my lifetime, maybe ever, he threatened to jail his opponent!\u201d CNN\u2019s Van Jones said, calling Trump\u2019s comments a \u201cnew low in American democracy.\u201d<\/p>\n<p>\u201cDo you realize what would happen though if another country\u2019s election \u2014 we would criticize, our State Department would say \u2018that\u2019s not a democratic election,\u2019\u201d <a href=\"https:\/\/twitter.com\/MoveOn\/status\/785687657917612032?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">argued<\/a> MSNBC\u2019s Chuck Todd.<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"kUyO7mD9CqiLxhKzl40WjfvM3Znd5rBEaFHwPAR8gs6T2S\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">We thought we had seen it all. But now <a href=\"https:\/\/twitter.com\/realDonaldTrump?ref_src=twsrc%5Etfw\">@realDonaldTrump<\/a> is promising to imprison political opponents. <a href=\"https:\/\/twitter.com\/hashtag\/debate?src=hash&#038;ref_src=twsrc%5Etfw\">#debate<\/a> <a href=\"https:\/\/t.co\/4dXdWG3diH\">pic.twitter.com\/4dXdWG3diH<\/a><\/p>\n<p>\u2014 MoveOn (@MoveOn) <a href=\"https:\/\/twitter.com\/MoveOn\/status\/785687657917612032?ref_src=twsrc%5Etfw\">October 11, 2016<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>\u201cTrump\u2019s threat to imprison his political opponent is a threat to imprison ALL his opponents -and lethal to democracy,\u201d warned GQ\u2019s Keith Olbermann, comparing Trump to Russian President Vladimir Putin.<\/p>\n<div  class=\"fdrlst__b89e9-f8e2fefc637935b6f85d51b22cdd0b47 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-f8e2fefc637935b6f85d51b22cdd0b47\"><\/div>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\"> <span class=\"Pq4HHG3FtduknzxCN0m26wXkjByDovWfJSnR8cefQbSroYLUACVEy70pRi3Xh7pI\"><\/p>\n<blockquote class=\"twitter-tweet\" data-width=\"500\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">Trump&#8217;s threat to imprison his political opponent is a threat to imprison ALL his opponents -and lethal to democracy <a href=\"https:\/\/t.co\/n9YmK8OCz9\">https:\/\/t.co\/n9YmK8OCz9<\/a><\/p>\n<p>\u2014 Keith Olbermann (@KeithOlbermann) <a href=\"https:\/\/twitter.com\/KeithOlbermann\/status\/785590071076524032?ref_src=twsrc%5Etfw\">October 10, 2016<\/a><\/p><\/blockquote>\n<p><script async src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script><\/span> <\/div>\n<\/figure>\n<p>MSNBC\u2019s Joy Reid <a href=\"https:\/\/twitter.com\/JoyAnnReid\/status\/1153030998231306246?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">called<\/a> the \u201cLock her up\u201d chant \u201cpeak authoritarianism,\u201d opining that \u201ccountries that lock up whoever dared to run against the autocrat are the kinds we used to send election monitors to.\u201d<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>The New York Times ran a <a href=\"https:\/\/www.nytimes.com\/2016\/11\/13\/us\/politics\/trump-clinton-jail.html?partner=rss&#038;emc=rss&#038;smid=nytpolitics&#038;smtyp=cur\" target=\"_blank\" rel=\"noreferrer noopener\">piece<\/a> quoting a top Democrat lawyer saying it would \u201cbe mimicking the tin-pot dictators of historical disgrace\u201d for the Trump administration to prosecute Clinton. <\/p>\n<p>\u201cThreat to Jail Clinton Smacks of \u2018Tin-Pot Dictators,\u2019 Experts Say,\u201d ran another New York Times <a href=\"https:\/\/www.nytimes.com\/2016\/10\/11\/us\/politics\/donald-trump-hillary-clinton-special-prosecutor.html?smid=tw-nytnational&#038;smtyp=cur\" target=\"_blank\" rel=\"noreferrer noopener\">headline<\/a>, quoting another \u201cexpert\u201d who threw around the \u201ctin-pot dictator\u201d phrase.<\/p>\n<p>\u201cIn America, we don\u2019t send our political opponents to jail,\u201d <a href=\"https:\/\/twitter.com\/TheDemocrats\/status\/785478673323339776?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a> an official Democratic National Committee Twitter account.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>Former ambassador to Russia Michael McFaul <a href=\"https:\/\/twitter.com\/McFaul\/status\/755580176122023936\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a>, \u201cDictatorships lock up the opposition, not democracies.\u201d<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>\u201cThe zeal to not only beat but imprison one\u2019s opponents has never been the basis for a presidential campaign,\u201d <a href=\"https:\/\/twitter.com\/JRubinBlogger\/status\/755827898074992640?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">posted<\/a> now-Washington Post writer Jen Rubin.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>\u201cIn the USA we do not threaten to jail political opponents,\u201d former Obama Attorney General Eric Holder <a href=\"https:\/\/twitter.com\/EricHolder\/status\/785319092722868224?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. (Yes, the same Eric Holder who <a href=\"https:\/\/thefederalist.com\/2020\/02\/21\/obama-ag-eric-holder-threatens-journalist-for-criticizing-doj-shut-the-h-ll-up\/\" target=\"_blank\" rel=\"noreferrer noopener\">spied<\/a> on a Fox News journalist, told another journalist to \u201cshut the h-ll up,\u201d and was eventually held in contempt of Congress, was worried about the \u201cabuse\u201d of \u201cthe power of the office.)<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>CNN\u2019s Christiane Amanpour <a href=\"https:\/\/thefederalist.com\/2019\/04\/03\/christiane-amanpour-lock-hate-speech-fbi-shut\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> former FBI Director James Comey that \u201clock her up\u201d was \u201cdangerous potentially, that it could\u2019ve created violence, that it\u2019s kind of hate speech.\u201d<\/p>\n<p>\u201cTrump said America has turned into a 3rd world country. Threatening to jail political opponents would qualify,\u201d <a href=\"https:\/\/twitter.com\/JimPethokoukis\/status\/785290240449650688?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a> James Pethokoukis, now a CNBC contributor.<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>Former Democrat Sen. Barbara Boxer <a href=\"https:\/\/twitter.com\/BarbaraBoxer\/status\/785326862620766208?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">remarked<\/a>, \u201cPutin and dictators jail their opponents.\u201d<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>\u201cWhen Donald Trump threatened to put Hillary Clinton in jail, he provided the American public with an insight into how the world\u2019s autocrats get rid of their opponents,\u201d <a href=\"https:\/\/www.newyorker.com\/news\/news-desk\/donald-trumps-political-prisoners?mbid=social_twitter\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a> Masha Gessen in The New Yorker.<\/p>\n<p>\u201c[I]n America, we defeat election opponents, we don\u2019t jail them!\u201d <a href=\"https:\/\/twitter.com\/NickKristof\/status\/785290246544060417?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">tweeted<\/a> The New York Times\u2019 Nicholas Kristof. (Yesterday, Kristof <a href=\"https:\/\/www.nytimes.com\/2023\/03\/30\/opinion\/president-trump-indictment-democracy.html\" target=\"_blank\" rel=\"noreferrer noopener\">published<\/a> a piece in the Times titled \u201cI Worry About a Failed Prosecution of Trump, but I Worry More About No Prosecution,\u201d in case you\u2019re wondering whether he still feels that way.)<\/p>\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full\"><\/figure>\n<\/div>\n<p>It\u2019s worth noting, of course, that Trump never did throw Hillary in jail, quite likely because he understood what the optics would do to the country. Clinton <a href=\"https:\/\/thefederalist.com\/2022\/09\/06\/hillary-keeps-shamelessly-lying-about-her-emails\/\" target=\"_blank\" rel=\"noreferrer noopener\">lies<\/a> to this day about those top secret emails sent from her private server, and the Justice Department let her team get away with destroying evidence with BleachBit and hammers \u2014 Comey euphemistically told Congress that they \u201ccleaned their devices in such a way as to preclude complete forensic recovery.\u201d The Federal Election Commission <a href=\"https:\/\/thefederalist.com\/2022\/03\/30\/election-watchdog-fines-clinton-campaign-for-lying-about-steele-dossier-in-finance-filings\/\" target=\"_blank\" rel=\"noreferrer noopener\">slapped<\/a> her wrist with a puny fine for <a href=\"https:\/\/www.wsj.com\/articles\/hillary-clinton-did-it-robby-mook-michael-sussmann-donald-trump-russia-collusion-alfa-bank-11653084709\" target=\"_blank\" rel=\"noreferrer noopener\">personally<\/a> approving the destructive Trump-Russia <a href=\"https:\/\/thefederalist.com\/2022\/03\/18\/spygate-101-a-primer-on-the-russia-collusion-hoaxs-years-long-plot-to-take-down-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">hoax<\/a>, in which the Clinton campaign\u2019s law firm hired an investigative firm that, in turn, commissioned the Steele dossier, which wreaked havoc on American politics for years and rightly destroyed many Americans\u2019 trust in the media and intelligence agencies. Next to that, the alleged campaign finance violations for which Trump has presumably been indicted pale.<\/p>\n<p>My colleague Mollie Hemingway\u2019s comments in 2016 about the \u201cLock her up!\u201d chants remain equally prescient today. \u201cIt is true that mobs shouldn\u2019t cry out for imprisonment, particularly before a trial,\u201d she <a href=\"https:\/\/thefederalist.com\/2016\/07\/20\/why-rnc-convention-calls-to-lock-her-up-are-entirely-reasonable\/\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>. \u201cBut it\u2019s also true that mobs shouldn\u2019t be forced to cry out for justice because their institutions are doing such a horrible job of applying law fairly.\u201d<\/p>\n<p>The institutions have only gotten more horrible at that job. The <a href=\"https:\/\/thefederalist.com\/videos\/hemingway-america-cant-survive-a-two-tiered-justice-system\/\" target=\"_blank\" rel=\"noreferrer noopener\">two-tiered<\/a> justice system reaches from the disparate treatment of presidential candidates to the Justice Department\u2019s decision to normalize surprise raids on the homes of pro-life pastors while downplaying acts of domestic terrorism against pregnancy clinics.<\/p>\n<p>In that 2016 piece, Hemingway lamented the country\u2019s descent \u201cinto one ruled by men, instead of one ruled by laws that apply to everyone, from the most powerful and wealthy to most poverty-stricken and oppressed.\u201d Her words could have been written today and are just as sobering.
