The House Judiciary Committee  <a class=\"Link\" href=\"https:\/\/twitter.com\/gekaminsky\/status\/1600887496702709760?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1600887499726802946%7Ctwgr%5Ea393ad4fd9ed7e52eec8c0f17b6a1d515d3c077c%7Ctwcon%5Es2_&#038;ref_url=https%3A%2F%2Fwww.washingtonexaminer.com%2Fnews%2Fjim-jordan-subpoenas-connection-fbi-stripping-gun-rights\" target=\"_blank\" rel=\"noopener\">held one<\/a>  in December 2022 that saw Democrats and Republicans debating legislation sponsored by Rep.  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/pramila-jayapal\">Pramila Jayapal<\/a>  (D-WA) that would let people add themselves to the FBI&#8217;s National Instant Criminal Background Check System, thereby forfeiting their gun rights.  <\/p>\n<p><b>No congressional authorization<\/b> <\/p>\n<p>The forms GOA uncovered apparently added people to this system.  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/house-judiciary-committee\">Judiciary Committee<\/a>  members, including Reps. Dan Bishop (R-NC) and Thomas Massie (R-KY),  <a class=\"Link\" href=\"https:\/\/twitter.com\/gekaminsky\/status\/1600887496702709760?ref_src=twsrc%5Etfw%7Ctwcamp%5Etweetembed%7Ctwterm%5E1600887499726802946%7Ctwgr%5E601fbd6292a1cad9aa97b6695a2ebbc83931fa14%7Ctwcon%5Es2_&#038;ref_url=https%3A%2F%2Fwww.washingtonexaminer.com%2Fnews%2Fjim-jordan-subpoenas-connection-fbi-stripping-gun-rights\" target=\"_blank\" rel=\"noopener\">harped on the apparent contradiction during<\/a>  the December hearing, arguing Democratic attempts to carve a legal pathway for people to waive their gun rights demonstrate the FBI went rogue. <\/p>\n<p>&#8220;What we&#8217;re looking at is evidence that the FBI went off on their own and wrote the bill and implemented the bill that you are trying to pass here today, or did pass, and will try to pass on the floor,&#8221; Massie had said.  <\/p>\n<p>John Kennedy, a Massie spokesman, declined to comment on Friday when asked by the <i>Washington Examiner<\/i> what future actions the congressman may take to investigate the forms.  <\/p>\n<div class=\"Enhancement\" data-align-center>\n<div class=\"Enhancement-item\">\n<figure class=\"Figure\">              <picture><source type=\"image\/webp\"  width=\"1240\"      height=\"805\"     data-image-size=\"articleImage\"              \/><source width=\"1240\"      height=\"805\"     data-image-size=\"articleImage\"              \/><\/picture><figcaption>\n<div class=\"Figure-content\">\n<div class=\"Figure-caption\">(AP Photo\/Carolyn Kaster)<\/div>\n<div class=\"Figure-credit\">(AP Photo\/Carolyn Kaster)<\/div>\n<\/div>\n<\/figcaption><\/figure>\n<\/p><\/div>\n<\/p><\/div>\n<p>Signatories of the forms were asked by the bureau to identify as either a \u201cdanger\u201d to themselves or others or also lacking \u201cmental capacity adequately to contract or manage\u201d their lives, the <i>Daily Caller<\/i>  <a class=\"Link\" href=\"https:\/\/dailycaller.com\/2022\/09\/06\/fbi-second-amendment-nics\/\" target=\"_blank\" rel=\"noopener\">reported<\/a> . While federal  <a class=\"Link\" href=\"https:\/\/www.law.cornell.edu\/uscode\/text\/44\/3507#a_3\" target=\"_blank\" rel=\"noopener\">law<\/a>  holds that agencies must obtain approval from the Office of Management and Budget before gathering information from the public, it&#8217;s unclear if there&#8217;s statutory justification for the forms, considering they were not assigned a &#8220;control number&#8221; and  <a class=\"Link\" href=\"https:\/\/pra.digital.gov\/clearance-process\/\" target=\"_blank\" rel=\"noopener\">held<\/a>  for public comment, according to Second Amendment lawyers.  <\/p>\n<p>Further, the Gun Control Act of 1968, a federal  <a class=\"Link\" href=\"https:\/\/uscode.house.gov\/view.xhtml?req=granuleid:USC-prelim-title18-section922&#038;num=0&#038;edition=prelim\">law<\/a>  regulating firearms, does not mention citizens being able to self-identify as unfit to own guns. But subsequent reports by outlets including the <i>Washington Examiner<\/i> provided evidence of them being used on U.S. citizens \u2014 with documents signed in states like Massachusetts, Michigan, and Maine. Signatory names were redacted by the FBI, making it unclear whether they&#8217;ve since retained their gun rights or quietly waged legal battles.  <\/p>\n<p>The first batch of signed forms GOA obtained was accompanied with FBI records showing signatories included those who made violent threats in online chat rooms, in person, and on  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/social-media\">social media<\/a> . But records since reviewed by the <i>Washington Examiner<\/i> provide little indication of signatory backgrounds or their actions that culminated in the government making contact.  <\/p>\n<p>However,  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/fbi-secret-service-plea-agreement-stripping-defendant-of-gun-rights-secretly\">a March report<\/a>  by the <i>Washington Examiner<\/i> uncovered that the FBI worked behind closed doors to provide the forms to medical centers in New Hampshire,  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/delaware\">Delaware<\/a> , Massachusetts, and Oklahoma. In turn, these centers, some of which are mental health clinics, fed forms to patients and sent completed records back to the government.  <\/p>\n<p>That the FBI coordinated with private and public medical centers  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/watchdogs-raise-concerns-fbi-stripping-gun-rights-citizens\">has raised concerns<\/a>  among watchdog groups. What&#8217;s also been scrutinized is that the bureau handed forms over to the Secret Service and ICE,  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/secret-service-ice-fbi-secret-strip-gun-rights-emails\">a revelation in a December 2022<\/a>  <i>Washington Examiner<\/i> report.  <\/p>\n<p>Secret Service and ICE, two agencies under the  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/department-of-homeland-security\">Department of Homeland Security<\/a> , emailed back and forth between 2018 and 2019 about the forms. The agencies obtained signatures from citizens and forwarded forms to the bureau, which proved concerning to a former top DHS official under President  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/donald-trump\">Donald Trump<\/a> .  <\/p>\n<p><b>&#8216;Deep state&#8217; mentality<\/b> <\/p>\n<p>&#8220;They were doing it when they had to know their leadership would have opposed it,&#8221; Ken Cuccinelli, ex-acting DHS deputy secretary and former  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/virginia\">Virginia<\/a>  attorney general, had told the <i>Washington Examiner<\/i>. &#8220;It really speaks to the rogue nature of the &#8216;deep state&#8217; mentality.&#8221; <\/p>\n<div class=\"Enhancement\" data-align-center>\n<div class=\"Enhancement-item\">\n<figure class=\"Figure\">              <picture><source type=\"image\/webp\"  width=\"1162\"      height=\"832\"     data-image-size=\"articleImage\"              \/><source width=\"1162\"      height=\"832\"     data-image-size=\"articleImage\"              \/><\/picture><figcaption>\n<div class=\"Figure-content\">\n<div class=\"Figure-credit\">Screenshot\/Secret Service and FBI communications\/Freedom of Information Act\/Gun Owners of America<\/div>\n<\/div>\n<\/figcaption><\/figure>\n<\/p><\/div>\n<\/p><\/div>\n<p>Cuccinelli&#8217;s &#8220;deep state&#8221; notion was echoed by the likes of House Judiciary Chairman <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/jim-jordan\"> Jim Jordan<\/a>  (R-OH), who leads the newly created weaponization of the federal government subcommittee. The body is investigating the alleged &#8220;politicization&#8221; of federal agencies. <\/p>\n<p> <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/jim-jordan-subpoenas-connection-fbi-stripping-gun-rights\">Jordan claimed in December 2022<\/a>  he was eyeing subpoenas in connection to the forms, while his spokesman, Russell Dye,  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/ex-fbi-agents-sound-alarm-on-bureaus-involvement-in-secret-plea-agreement-gun-rights\">said on Friday<\/a> , &#8220;This is something we are absolutely looking into.&#8221; Dye&#8217;s comment was tucked into a Friday story  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/ex-fbi-agents-sound-alarm-on-bureaus-involvement-in-secret-plea-agreement-gun-rights\">on FBI whistleblowers sounding the alarm<\/a>  over the bureau being linked to a covert 2019 plea agreement conditioned by the U.S. government that stripped a defendant of their gun rights, per a March 17 <i>Washington Examiner<\/i>  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/news\/fbi-secret-service-plea-agreement-stripping-defendant-of-gun-rights-secretly\">report<\/a> . <\/p>\n<p>Rep.  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/marjorie-taylor-greene\">Marjorie Taylor Greene<\/a>  (R-GA) and 14 GOP members called on the bureau and Justice Department in October 2022  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/fbi-and-doj-must-remove-records-on-people-pressured-into-waiving-away-gun-rights-republicans-say\">to provide evidence that the form<\/a>  is no longer being used. The lawmakers also demanded Attorney General  <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/merrick-garland\">Merrick Garland<\/a>  remove all signatory records from the NICS database.  <\/p>\n<p><b> <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/\">CLICK HERE TO READ MORE FROM THE WASHINGTON EXAMINER<\/a> <\/b> <\/p>\n<p>Republicans were particularly vocal last Congress on their purported desire to investigate the FBI over the forms, though it remains unclear where those inquiries stand.
