(Photo by Anna Moneymaker\/Getty Images)\t\t\t<\/figcaption><\/figure>\n<\/p><\/div>\n<div>\n<p>President Joe Biden cannot order employees of the federal government to receive the coronavirus vaccine, a federal appeals court ruled this week.<\/p>\n<div>\n<p><a href=\"https:\/\/winred.tomcotton.com\/tom-cotton\/claim-yours-ots-fbeacon-ads-30?utm_source=rc&#038;utm_medium=fbeaconads&#038;utm_campaign=2023marchots\" target=\"_blank\" rel=\"noopener\"> \t\t\t\t \t\t\t<\/a> \t\t<\/p>\n<p><a href=\"https:\/\/winred.tomcotton.com\/tom-cotton\/claim-yours-ots-fbeacon-ads-30?utm_source=rc&#038;utm_medium=fbeaconads&#038;utm_campaign=2023marchots\" target=\"_blank\" rel=\"noopener\"> \t\t\t\t \t\t\t<\/a> \t\t<\/p>\n<\/p><\/div>\n<p>The Fifth U.S. Circuit Court of Appeals in New Orleans rejected an argument that, like a CEO of a company, Biden can order his employees to get vaccinated, <a href=\"https:\/\/apnews.com\/article\/vaccine-requirement-biden-covid-fifth-circuit-74ae504966aaf5239a42cc3e677182b4\" target=\"_blank\" rel=\"noopener\">according<\/a> to the Associated Press. The order upholds a previous preliminary injunction that blocks the mandate. Biden and his lawyers have fought to reinstate it, despite nearly 98 percent of federal employees being vaccinated as of January 2022.<\/p>\n<p>The White House is still defending the order, saying in a statement that &#8220;vaccination remains one of the most important tools to protect people from serious illness and hospitalizations.&#8221; Yet the Biden administration is allowing the COVID-19 emergency order to end on May 11.<\/p>\n<p>The ruling comes after years of the Biden administration criticizing Republican governors for lax pandemic measures and avoiding vaccine requirements. Yet a new <a href=\"https:\/\/www.axios.com\/2023\/03\/24\/why-america-uniquely-vulnerable-covid\" target=\"_blank\" rel=\"noopener\">study<\/a> released by the Lancet found no connection between a governor\u2019s political affiliation and the number of COVID-related deaths, with the highest death rates in Washington, D.C., New Mexico, and Arizona.<\/p>\n<div>\n<p><a href=\"https:\/\/winred.tomcotton.com\/tom-cotton\/tik-tok-beacon-ads?utm_source=rc&#038;utm_medium=fbads&#038;utm_campaign=bantiktok\" target=\"_blank\" rel=\"noopener\"> \t\t\t\t \t\t\t<\/a> \t\t<\/p>\n<p><a href=\"https:\/\/winred.tomcotton.com\/tom-cotton\/tik-tok-beacon-ads?utm_source=rc&#038;utm_medium=fbads&#038;utm_campaign=bantiktok\" target=\"_blank\" rel=\"noopener\"> \t\t\t\t \t\t\t<\/a> \t\t<\/p>\n<\/p><\/div>\n<p>It\u2019s not the first time the Biden administration has fought to install outdated pandemic measures. As late as January, it was fighting to <a href=\"https:\/\/freebeacon.com\/biden-administration\/biden-admin-fights-to-reverse-ruling-that-blocked-airline-mask-mandate\/\" target=\"_blank\" rel=\"noopener\">reinstate<\/a> the mask mandate on airplanes.
