John Sarbanes (D-MD), the bill seeks to impose federal control over elections, subverting individual states\u2019 laws on issues such as voter identification, mail-in voting, and absentee ballots.\u00a0<\/span><\/p>\n<p><span>The constitutional justification of such sweeping reforms is dubious. Article I of the United States Constitution states that \u201cthe Times, Places and Manner of holding Elections for Senators and Representatives, shall be prescribed in each state by the Legislature thereof.\u201d As the<\/span> <a href=\"https:\/\/www.heritage.org\/constitution\/#!\/articles\/1\/essays\/19\/election-regulations\"><span>Heritage Foundation<\/span><\/a> <span>details, the nation\u2019s founding document grants state legislatures primary jurisdiction over elections and only presents the United States Congress with secondary control.<\/span><\/p>\n<p><span>In an attempt to justify tightening the federal government\u2019s grip over American elections, the bill invokes the notion of \u201cstructural racism\u201d several times. For example, the introduction states that \u201cvoting restrictions, redistricting, and other electoral practices and processes continue to disproportionately impact communities of color in the United States and do so as a result of both intentional racial discrimination, structural racism, and the ongoing structural socioeconomic effects of historical racial discrimination.\u201d<\/span><\/p>\n<p><span>The For The People Act would undermine election integrity and drastically shift power over elections to the federal government \u2014 largely to the benefit of the Democratic Party.<\/span><\/p>\n<p><strong>Eliminating Voter ID Provisions<\/strong><\/p>\n<p><span>The For The People Act seeks to eliminate many voter identification provisions.<\/span><\/p>\n<p><span>The bill alleges that \u201cstates and localities have eroded access to the right to vote through restrictions on the right to vote including excessively onerous voter identification requirements.\u201d It therefore dictates that a state \u201cmay not require an individual to provide any form of identification as a condition of obtaining an absentee ballot.\u201d\u00a0<\/span><\/p>\n<p><span>Rep. Byron Donalds (R-FL) explained in a<\/span> <a href=\"https:\/\/www.foxnews.com\/opinion\/democrats-hr1-for-people-unconstitutional-rep-byron-donalds\"><span>Fox News<\/span><\/a> <span>op-ed that his home state has \u201cbeen able to offer solicited absentee voting with proper safeguards such as signature verification, requiring voter I.D., and maintaining up-to-date voter rolls to ensure that the only ballots are from eligible citizens.\u201d He called House Democrats\u2019 attempt to roll back such safeguards \u201ca blatant assault on the Constitution.\u201d<\/span><\/p>\n<p><span>Following the reforms enacted by Florida, many states \u2014 including<\/span> <a href=\"https:\/\/www.usnews.com\/news\/best-states\/georgia\/articles\/2021-02-23\/georgia-senators-pass-bill-to-require-id-for-absentee-voting\"><span>Georgia<\/span><\/a><span>, which dealt with a vote<\/span> <a href=\"https:\/\/www.foxnews.com\/politics\/2600-uncounted-ballots-found-recount-efforts-georgia\"><span>recount<\/span><\/a> <span>before falling into President Biden\u2019s column by a razor-thin margin \u2014 are pushing for stricter absentee ballot security in the first weeks of their new legislative sessions.<\/span><\/p>\n<p><span>Fox News anchor Tucker Carlson<\/span> <a href=\"https:\/\/www.foxnews.com\/politics\/tucker-democrats-sweeping-for-the-people-act-would-enshrine-fraud\"><span>noted<\/span><\/a> <span>that the bill\u2019s loosening of election security measures could lead to massive ballot harvesting schemes.<\/span><\/p>\n<p><span>\u201cUnder H.R. 1, [people] could freely go house to house and apartment to apartment collecting unknown thousands of ballots and then dump them all in a ballot dropbox,\u201d commented Carlson on January 25. \u201cNo one would have any idea if those ballots had been tampered with at any point along the way or would there be any way to prove it if they had been tampered with.\u201d<\/span><\/p>\n<p><span>Despite the voter identification rollbacks in the Democrats\u2019 legislation, polls reveal that an overwhelming majority of Americans desire election security measures.<\/span> <a href=\"https:\/\/news.gallup.com\/poll\/194741\/four-five-americans-support-voter-laws-early-voting.aspx\"><span>Gallup<\/span><\/a> <span>found in 2016 that 80% of Americans support requiring all voters to provide photo identification in order to cast a ballot.<\/span><\/p>\n<p><strong>Perpetuating Vote-By-Mail<\/strong><\/p>\n<p><span>Following the COVID-19 pandemic, many state governments allowed for the usage of mail-in voting to avoid the spread of the virus. The Democrats\u2019 bill, however, would make such provisions permanent.<\/span><\/p>\n<p><span>As the legislation claims, \u201cCongress finds that it has the authority pursuant to section 5 of the Fourteenth Amendment to protect the right to vote,\u201d specifically by addressing \u201climited and unequal access to voting by mail.\u201d\u00a0<\/span><\/p>\n<p><span>Again leveraging accusations of racism, the bill states that \u201cminority communities wait longer in lines to vote, are more likely to have their mail ballots rejected, [and] continue to face intimidation at the polls.\u201d<\/span><\/p>\n<p><span>The legislation therefore amends the Help America Vote Act of 2002 by mandating that \u201cif an individual in a State is eligible to cast a vote in an election for Federal office, the State may not impose any additional conditions or requirements on the eligibility of the individual to cast the vote in such election by absentee ballot by mail.\u201d\u00a0<\/span><\/p>\n<p><span>A state \u201cmay not refuse to accept or process\u201d a mail-in ballot as long as it is postmarked before election day \u2014 a measure that could lead to additional elongated periods of vote counting similar to the one that followed the 2020 election.<\/span><\/p>\n<p><strong>Providing Federal Control Over Redistricting<\/strong><\/p>\n<p><span>In addition to subverting states\u2019 abilities to determine their own election laws, the For The People Act seeks to assert control over determining Congressional districts.<\/span><\/p>\n<p><span>\u201cCongress finds that the right of suffrage has been so diluted and debased by means of gerrymandering of districts,\u201d reads the legislation. \u201cCongress finds that it has authority pursuant to section 5 of the Fourteenth Amendment to remedy this debasement.\u201d<\/span><\/p>\n<p><span>The bill mandates that states \u201ccomply with the United States Constitution\u201d and \u201cprovide racial, ethnic, and language minorities with an equal opportunity to participate in the political process\u201d in their redistricting.\u00a0<\/span><\/p>\n<p><span>Likewise, the legislation forces states to appoint \u201cindependent redistricting commissions\u201d that ensure \u201cdiversity\u201d with respect to \u201cracial, ethnic, and language minorities.\u201d<\/span><\/p>\n<p><strong>Paving Ground For D.C. Statehood<\/strong><\/p>\n<p><span>Democratic politicians \u2014 including President Biden \u2014 broadly<\/span> <a href=\"https:\/\/twitter.com\/JoeBiden\/status\/1276285377595281408\"><span>support<\/span><\/a> <span>granting statehood to the nation\u2019s capital city, as it would all but certainly grant two more Senate seats to the Democratic caucus. The For The People Act seeks to lay groundwork for such an endeavor.<\/span><\/p>\n<p><span>As Rep. Donalds warns in his editorial, the bill \u201cburies the politically polarizing maneuver to make Washington, D.C., a state \u2014 which speaks to this bill\u2019s misguided and elitist motivations.\u201d<\/span><\/p>\n<p><span>Indeed, Rep. Sarbanes\u2019 press release mentions that the legislation \u201ccommits Congress to deliver full congressional voting rights and self-government for the residents of the District of Columbia, which only statehood can provide.\u201d<\/span><\/p>\n<p><span>The For The People Act claims that \u201cthere are no constitutional, historical, fiscal, or economic reasons why the Americans who live in the District of Columbia should not be granted statehood.\u201d It would establish a twelve-member \u201cCongressional Task Force on Voting Rights\u201d to investigate \u201cpolitical disenfranchisement of United States citizens in territories of the United States.\u201d\u00a0<\/span><\/p>\n<p><span>The chair of the task force would be chosen by the Speaker of the House \u2014 a position currently occupied by Rep. Nancy Pelosi (D-CA).<\/span><\/p>\n<p><span>In contrast to the Democrats\u2019 assertions, founding father James Madison \u2014 who authored the Constitution \u2014 wrote in<\/span> <a href=\"https:\/\/www.heritage.org\/report\/the-constitution-and-the-district-columbia\"><em><span>The Federalist<\/span><\/em><\/a> <span>Number 43 that \u201cthe indispensable necessity of compleat authority at the seat of Government car\u00adries its own evidence with it.\u201d\u00a0<\/span><\/p>\n<p><span>He argued that without an independent capital city, \u201cnot only the public authority might be insult\u00aded and its proceedings be interrupted, with impunity; but a dependence of the members of the general Government, on the State comprehending the seat of the Government for protection in the exercise of their duty, might bring on the national councils an imputation of awe or influence, equally dishonorable to the Government, and dissatisfactory to the other members of the confederacy.\u201d<\/span><\/p>\n<p><span>In other words, the existence of a \u201cfederal city\u201d is meant to stop any one state from inhibiting the function of the national government.\u00a0<\/span><\/p>\n<p><span>Contemporary Americans largely agree with the founding fathers\u2019 sentiment.
