This move could decide the fate of a high-profile case. <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/tag\/supreme-court\" target=\"_blank\" rel=\"noopener\">Supreme Court<\/a> As an example, elections are known as <i><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/restoring-america\/fairness-justice\/key-provision-of-constitution-in-play-as-supreme-court-hears-election-case\" target=\"_blank\" rel=\"noopener\">Moore v. Harper<\/a><\/i>.<\/p>\n<p>Experts suggest that the new 5-2 Republican-appointed majority at the state court may indicate that the justices are planning to override last year&#8217;s decision against Republican-drawn maps. The GOP leadership in the state appealed the decision to the U.S. Supreme Court, asking the nine justices for their opinions on a controversial legal theory that alarms Democratic election lawyers.<\/p>\n<p><b><u><a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/scotus-signals-it-could-punt-on-hot-button-election-law-case\" target=\"_blank\" rel=\"noopener\">SUPREME COURT SIGNALS THAT IT COULD PUNT ON HOTBUTTON ELECTION LAW CAUSE MOORE V.HARPER<\/a><\/u><\/b><\/p>\n<p>Republicans not only wanted the Supreme Court to restore redistricting map, but they also demanded that the court adopt so-called <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/supreme-court-independent-state-legislature-theory\" target=\"_blank\" rel=\"noopener\">independent state legislature<\/a> Theory: This would prohibit state courts from reviewing legislative actions in relation to federal elections, and allow legislators unlimited power over voting rules or redistricting.<\/p>\n<p>Democratic election lawyers like <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/why-elias-is-pleased-north-carolina-rehear-gop-election-map-case\" target=\"_blank\" rel=\"noopener\">Marc Elias<\/a> The ISL theory has been rejected by the Supreme Court. Republicans argued that it would lead to new restrictions that could hinder fair elections. Republicans argued that it would allow activist state courts to make decisions about legislative matters.<\/p>\n<p>During December arguments the U.S. Supreme Court&#8217;s 3-1 Republican-appointed majority <a class=\"Link\" href=\"https:\/\/www.washingtonexaminer.com\/policy\/courts\/scotus-unconventionally-split-on-lawmakers-bid-to-alter-election-authority\" target=\"_blank\" rel=\"noopener\">Appearances were sympathetic<\/a> North Carolina&#8217;s GOP attempted to overturn the state court decision, but seemed hesitant to embrace ISL theory.<\/p>\n<p>The Supreme Court asked all parties to the case to provide feedback by March 20, on whether the highest court had jurisdiction. <i><a class=\"Link\" href=\"https:\/\/www.nccourts.gov\/documents\/appellate-court-opinions\/harper-v-hall\" target=\"_blank\" rel=\"noopener\">Harper v.
