This decision was partly based on an 19th century ruling. <a href=\"https:\/\/www.dailywire.com\/topic\/slavery\" target=\"_blank\" rel=\"noopener\">Slavery<\/a> law according to a recent report\u00a0<\/span><\/p>\n<p><span>The decision was part of a dispute that a couple divorcing from each other sought to have control over two frozen embryos they had created during their marriage by Jason Heidemann and Honeyhline Heidemann, the Associated Press. <\/span><a href=\"https:\/\/apnews.com\/article\/embryos-slavery-chattel-custody-virginia-82e1f36ecbcf35ec4659e8e2c3443c4f\"><span>reported<\/span><\/a><span> This week.\u00a0<\/span><\/p>\n<p><span>&#8220;Upon independent research, this court was unable to find any Virginia law prohibiting the purchase or sale of human embryo, nor has either party cited a federal law prohibiting the activity,&#8221; Richard Gardiner, Fairfax County Circuit Judge <a href=\"https:\/\/www.fairfaxcounty.gov\/circuit\/sites\/circuit\/files\/assets\/documents\/pdf\/opinions\/cl-2021-15372-honeyhline-heidemann-v-jason-heidemann.pdf\" target=\"_blank\" rel=\"noopener\">Write<\/a> In a ruling related the battle for embryos. &#8220;As there is no prohibition on the sale of human embryos, they may [be] valued and sold, and thus may be considered \u2018goods or chattels&#8217; within the meaning of Code \u00a7 8.01-93.&#8221;<\/span><\/p>\n<p><span>Honeyhline had hoped to use the embryos after the split. Jason, however, has tried to stop her from using them, claiming that she would not be able to implant the embryos. &#8220;would force Mr. Heidemann to procreate against his wishes and therefore violate his constitutional right to procreational autonomy.&#8221;<\/span><\/p>\n<p><span>According to a 2015 contract the couple had drawn up they &#8220;own any stored embryos jointly.&#8221;<\/span><\/p>\n<p><span>Although Gardiner did not make a decision regarding Jason&#8217;s claim of procreational autonomy, he did rule the embryos could be considered property. Part of his ruling was based on an 1800s Virginia law that regulates embryos. &#8220;goods and chattel,&#8221; This included slaves at that time.\u00a0<\/span><\/p>\n<p><span>&#8220;I would like to think that the bench and the bar would be seeking more modern precedent,&#8221; Solomon Ashby, president and CEO of the Old Dominion Bar Association.\u00a0<\/span><\/p>\n<p><span>A frozen embryo of a human being is usually obtained very quickly after fertilization, before the unborn child can develop much.\u00a0<\/span><\/p>\n<p><span>Some conservatives have been more popular in recent months. <\/span><a href=\"https:\/\/www.axios.com\/2022\/11\/29\/republicans-abortion-fertility-ivf-pence\"><span>Have you thought of<\/span><\/a><span> or supported increased protection of embryos and the prohibition of their disposal.
