Bragg, Manhattan District Attorney, has indicated to Donald Trump&#8217;s legal team the possibility of him facing criminal charges for his role in hush-money payments to Stormy Daniels during 2016.<\/p>\n<p>The New York Times <a href=\"https:\/\/www.nytimes.com\/2023\/03\/09\/nyregion\/trump-potential-criminal-charges-bragg.html\" target=\"_blank\" rel=\"noopener\">reported<\/a> Trump has been given the opportunity to testify in front of the grand jury which is hearing evidence in the case.<\/p>\n<p>&#8220;The Manhattan District Attorney&#8217;s threat to indict President Trump is simply insane,&#8221; A Trump spokesperson said this in a statement. &#8220;It&#8217;s an embarrassment to the Democrat prosecutors, and it&#8217;s an embarrassment to New York City.&#8221;<\/p>\n<p>According to the report, Trump was offered the opportunity to testify &#8220;almost always indicates an indictment is close&#8221; And that it would be &#8220;unusual&#8221; District attorneys must give potential defendants this notification &#8220;without ultimately seeking charges against&#8221; them.<\/p>\n<p>Five years have elapsed since the criminal investigation into Trump&#8217;s $130,000 hush-money payment to Daniels. Daniels claims that she had an affair. This case concerns a payment made by former Trump attorney Michael Cohen to Daniels, which was during the election. Cohen pleaded guilty to felony charge.<\/p>\n<p>Daniels&#8217; representatives reached out to the National Enquirer regarding her story. However, the publication refused to buy the exclusive rights. Cohen and Daniels were represented by the publisher.<\/p>\n<p>Trump&#8217;s problem is with Cohen&#8217;s company for the hush money. The expense was categorized as a legal expense. Cohen&#8217;s retainer agreement was cited by the company. Cohen was not able to provide legal services and there was no retainer agreement. The reimbursement did not relate to Cohen&#8217;s legal services. Thus, the company could be facing a criminal misdemeanor for falsifying business records.<\/p>\n<p>According to the report, prosecutors could make the misdemeanor a felony if they can prove Trump&#8217;s guilt. &#8220;\u2018intent to defraud&#8217; included an intent to commit or conceal a second crime.&#8221;<\/p>\n<p>Prosecutors claim that the second crime was that $130,000 of hush money was an illegal donation to Trump&#8217;s campaign. The money was used to stop stories for Trump&#8217;s benefit.<\/p>\n<p>Trump would be sentenced to a maximum of four year imprisonment if convicted.
