Greg Abbott spoke out Thursday following a Federal Court&#8217;s rejection of the program.<\/p>\n<p>&#8220;Yesterday, another federal court announced what Texans\u2014and Americans\u2014have known all along: President Biden&#8217;s open border policies are,\u00a0in the words of Judge Wetherell, \u2018akin to posting a flashing Come In We&#8217;re Open sign on the southern border,'&#8221; Abbott, a Republican said it in a statement.<\/p>\n<p>The federal government&#8217;s program of releasing illegal immigrants into the United States rather than holding them until their cases are resolved violates federal law,\u00a0U.S. District Judge T. Kent Wetherell, a Trump appointee, ruled on March 8.<\/p>\n<p>&#8220;The evidence establishes that Defendants have effectively turned the Southwest Border into a meaningless line in the sand and\u00a0little more than a speedbump for aliens flooding into the country,&#8221; Wetherell stated in\u00a0<a href=\"https:\/\/www.documentcloud.org\/documents\/23698888-catch-and-release-opinion-and-order\" target=\"_blank\" rel=\"noopener\">The ruling<\/a>.<\/p>\n<p>Abbott attacked Biden&#8217;s response to the ruling.\u00a0<a href=\"https:\/\/www.theepochtimes.com\/program-that-releases-illegal-immigrants-into-us-being-used-more-watchdog-report_4556372.html\" target=\"_blank\" rel=\"noopener\">Alternatives to Detention<\/a>\u00a0program,\u00a0which has\u00a0released more than 1 million illegal immigrants into the U.S. interior.<\/p>\n<p>&#8220;President Biden&#8217;s catch-and-release agenda, which violates his constitutional duty to enforce federal immigration laws, has catalyzed an unprecedented crisis of illegal immigration at our southern border and throughout our nation,&#8221; Abbott stated.<\/p>\n<figure id=\"attachment_4934048\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/03\/localimages\/El-Paso-1200x800.jpg\" rel=\"attachment wp-att-4934048\"><figcaption><\/figcaption><\/a> Border Patrol agent instructs illegal immigrant who crossed Rio Grande into El Paso Texas. (John Moore\/Getty Images)<\/figure>\n<h2>\u2018Dereliction of Duty&#8217;<\/h2>\n<p>The governor&#8217;s office issued a statement urging Biden to enforce the existing immigration laws. &#8220;aggressively&#8221; Prosecution of illegal border crossings from ports of entry. Abbott&#8217;s office noted that Congress has explicitly mandated that certain illegal immigrants be prosecuted at the border. &#8220;shall&#8221; be taken into custody<\/p>\n<p>Wetherell stated in the new ruling that the phrase &#8220;<a href=\"https:\/\/www.theepochtimes.com\/biden-administrations-catch-and-release-border-policy-struck-down-by-us-judge_5109407.html\">shall be detained<\/a>&#8221; in the\u00a0Immigration and Nationality Act mandates the requirement that\u00a0immigrants who arrive at the border without proper documents are subject to quick removal without a hearing or review.<\/p>\n<p>Immigration officials are subject to Supreme Court precedent &#8220;broad discretion&#8221; When enforcing immigration law, it is important to follow all laws established by Congress.<\/p>\n<p>Abbott&#8217;s office condemned what it called Biden administration&#8217;s actions &#8220;lawlessness&#8221; President&#8217;s &#8220;dereliction of duty&#8221; It is important to understand what it is called &#8220;record-breaking levels of illegal immigration.&#8221;<\/p>\n<p>&#8220;In 2023 alone, this surge of illegal immigration will saddle Texas taxpayers with an estimated financial burden of $13.3 billion,&#8221; Abbott noted.<\/p>\n<p>The statement stated that each illegal immigrant will cost Texas taxpayers more than $4,400.<\/p>\n<p>Nationally, the associated costs directly related to illegal immigrants run in the hundreds of millions every day, expected to cost U.S. taxpayers\u00a0$150.7 billion in fiscal year 2023,\u00a0according to\u00a0<a href=\"https:\/\/gcc02.safelinks.protection.outlook.com\/?url=https%3A%2F%2Fwww.fairus.org%2Fsites%2Fdefault%2Ffiles%2F2023-03%2FFiscal%2520Burden%2520of%2520Illegal%2520Immigration%2520on%2520American%2520Taxpayers%25202023%2520WEB_0.pdf&#038;data=05%7C01%7Csheridan.nolen%40gov.texas.gov%7Cf9d5130b721741d2365208db20e9ab6d%7C54cb5da6c7344242bbc25c947e85fb2c%7C0%7C1%7C638139960193921660%7CUnknown%7CTWFpbGZsb3d8eyJWIjoiMC4wLjAwMDAiLCJQIjoiV2luMzIiLCJBTiI6Ik1haWwiLCJXVCI6Mn0%3D%7C2000%7C%7C%7C&#038;sdata=DxwY1sgHs6HuGySFarIfVWqrxt%2B7lgq2klakDrP4zJY%3D&#038;reserved=0\" data-auth=\"NotApplicable\">A recent report from the Federation for American Immigration Reform<\/a>.<\/p>\n<p>&#8220;In total, the gross cost of illegal immigration now total $183 billion, up more than 35.7 percent since 2017. The cost incurred per illegal alien (including their U.S.-born children) has increased as well, now totaling $8,776 annually,&#8221; The report says so.<\/p>\n<p>The report stated that illegal immigrants are responsible for medical care, tuition, incarceration and federal welfare. (YukiIwamura\/AFP via Getty Images).<\/figure>\n<h2>Ruling<\/h2>\n<p>Florida Attorney General Ashley Moody (a Republican)\u00a0<a href=\"https:\/\/www.theepochtimes.com\/unmitigated-crisis-florida-sues-biden-administration-over-release-of-illegal-immigrants_4020891.html\" target=\"_blank\" rel=\"noopener\">In 2021, sued the government<\/a>\u00a0Concerning its catch-and release policy, the plaintiffs argued it was in violation of federal law.<\/p>\n<p>Biden administration officials claimed they were entitled to the discretion under Supreme Court precedent, which gives immigration officials the right to act as they please &#8220;broad discretion&#8221; In the execution of immigration laws.<\/p>\n<p>But Wetherell noted the federal government is still required to adhere to laws established by Congress, specifically the\u00a0Immigration and Nationality Act.
