This represented Becky Pepper Jackson, a middle-school student of transgender who was prevented from running with the cross-country girls team. ACLU claims the law is in violation of Title IX (federal statute that prohibits discrimination based on sex) and 14th Amendment.<\/p>\n<p>The West Virginia law was deemed constitutional by a district court in August. Title IX protects against sexual discrimination.<\/p>\n<p>ACLU appealed to the U.S. Court of Appeals, 4th Circuit. They requested an injunction. This means that the law is currently halted as the case continues.<\/p>\n<p>&#8220;We know that we should win on the merits. We know that the original district court judge put in place an injunction that ultimately changed his mind and agreed with us that the law is constitutional,&#8221; Morrisey stated, and ADF added that the Supreme Court is why Morrisey believes it will. &#8220;ultimately lift the injunction.&#8221;<\/p>\n<p>Armistead was willing to join the lawsuit on her behalf and for other female athletes.
