The administration claimed that the plan was legal under the HEROES Law of 2003. This law was enacted during Iraqi war to provide relief to military personnel and their families. It temporarily freezes student loans in times of national emergency or war.<\/p>\n<p>Chief Justice John Roberts <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-11803605\/Supreme-Court-conservatives-question-Biden-power-wipe-student-debt.html?ns_mchannel=rss&#038;ns_campaign=1490&#038;ito=social-twitter_mailonline\">It was pointed out<\/a> In 2020, Trump&#8217;s administration was stopped by the high-court from unilaterally ending Obama&#8217;s DREAMers program. U.S. U.S.<\/p>\n<p>However, the law&#8217;s authors, officially called the Higher Education Relief Opportunities for Students Act, were Congressmen Howard &#8220;Buck&#8221; John Kline (R\u2013MN) and McKeon (R\u2013CA), both Marines veterans of 25 years, did not intend their legislation to be used for blanket cancellation of loans.<\/p>\n<p>Although the HEROES Act did not authorize loan forgiveness, it gave the secretary of education the authority to freeze loan payments for students whose education had been interrupted by military service.<\/p>\n<p>According to an Anonymous source, Biden&#8217;s plan infringed the HEROES act in multiple ways. <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-506\/253844\/20230202171222704_Brief%20PLF%20Reps.%20Boehner%20Kline%20and%20McKeon%20Student%20Loans%20FINAL%20222023%20pdfa.pdf\">Amicus brief<\/a> Pacific Legal Foundation. The act does not authorize loan forgiveness in total.
