Scott Perry (R.Pa.). The FBI took the device from Perry, the conservative chairman of House Freedom Caucus, while he was on vacation with his family. <\/p>\n<p>Perry, a six-term lawmaker, voted to delay President Joe Biden\u2019s electoral certification in 2021. He claimed that his phone records were protected by the Constitution&#8217;s speech &#038; debate clause. This clause gives legislators immunity from executive intimidation through politicized investigations. Perry claimed that his records were created during routine legislative work to ensure integrity in the 2020 presidential election. Perry&#8217;s claims were rejected by Judge Howell. Howell was first appointed to the federal bench in 2010 by President Barack Obama. &#8220;astonishing.&#8221; <\/p>\n<p>&#8220;What is plain is the clause does not shield Rep. Perry&#8217;s random musings with private individuals touting an expertise in cybersecurity or political discussions with attorneys from a presidential campaign, or with state legislators concerning hearings before <em>them<\/em> about possible local election fraud or actions <em>they<\/em> could take to challenge election results in Pennsylvania,&#8221; Howell, who was also the<a href=\"https:\/\/thefederalist.com\/2019\/10\/28\/judge-rules-democrats-can-get-their-hands-on-special-counsel-grand-jury-docs\/\" target=\"_blank\" rel=\"noreferrer noopener\"> Supervise judge<\/a> For the Mueller investigation grand jury, wrote December <\/p>\n<p>Although Howell&#8217;s ruling was made two months ago by Perry, federal investigators were unable to access Perry&#8217;s messages. The D.C. Circuit Court has a three-judge panel. Circuit Court agreed to stop Howell&#8217;s January decision. The Circuit Court heard the case and held a public session Thursday. It was just one day before Howell unveiled her December ruling. <\/p>\n<p>Perry&#8217;s office refused to respond to The Federalist&#8217;s request to interview. <\/p>\n<p>Perry was one the four House Select Committee members that were subpoenaed last January 6. Other subpoenaed members include Kevin McCarthy (House Speaker), Jim Jordan (Ohio Rep.) and Andy Biggs (Arizona Rep.). None of them complied with the panel\u2019s requests. <\/p>\n<p>Rep. Jamie Raskin, D. Maryland, concluded the probe as the Republican majority was poised to take over the lower chamber. <a href=\"https:\/\/thefederalist.com\/2022\/12\/19\/j6-committee-asks-justice-department-to-neutralize-political-opponents-with-criminal-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">Announcement<\/a> The panel recommended that their GOP colleagues be referred to the Justice Department in order to pursue criminal charges. <\/p>\n<p>&#8220;An insurrection is a rebellion against the authority of the United States. \u2026 [The Constitution] uses participation in insurrection by office-holders as automatic grounds for disqualification from ever holding public office again,&#8221; Raskin stated, revealing the true purpose behind the investigation from the beginning.<\/p>\n<p>The Select Committee of Jan. 6 was disbanded. However, the FBI continues its investigation with U.S. attorney Jack Smith as special counsel. Perry&#8217;s communications and interactions with the Justice Department and White House have been the focus of the investigation.
