It is possible that the final vote regarding her nomination will be taken as soon as next Wednesday.<\/p>\n<p>As a Second Circuit judge, Kahn would have a say in some of the influential judicial cases in the county\u2014and would bring to the court a controversial view of the First Amendment.<\/p>\n<p>Kahn, in a 2020 opinion, argued for the expansion of the &#8220;fighting words&#8221; exception to the First Amendment\u2014which bans speech likely to spark violence\u2014on the grounds that some groups are unlikely or unable to physically retaliate against insults. This means that they &#8220;must endure a higher level of offensive speech before being afforded legal remedies,&#8221; She wrote.
