The Court ordered Santa Clara County to allow churches to hold indoor worship services.<\/p>\n<p>Last week, five churches in the county challenged the county\u2019s public health orders which ban indoor church services, asking the Ninth Circuit for an emergency stay. When that effort failed, the churches applied for an emergency writ of injunction with Supreme Court Justice Elena Kagan, as she is assigned to the West Coast for emergency motions. She told the county to issue a response and referred the case to the Supreme Court.<\/p>\n<p>\u201cThe churches pointed to the Supreme Court\u2019s recent rulings in two cases \u2013\u00a0<a href=\"https:\/\/www.scotusblog.com\/case-files\/cases\/roman-catholic-diocese-of-brooklyn-new-york-v-cuomo\/\">one lifting New York\u2019s COVID-related limits on attendance<\/a>\u00a0at worship services and the other\u00a0<a href=\"https:\/\/www.scotusblog.com\/2021\/02\/divided-court-allows-indoor-worship-services-to-resume-in-california\/\">granting requests by southern California churches<\/a>\u00a0to resume indoor worship services \u2013 to support their contention that the Santa Clara County order must also fall,\u201d Amy Howe noted at <a href=\"https:\/\/www.scotusblog.com\/2021\/02\/court-clears-way-for-indoor-worship-services-in-northern-california\/\">SCOTUSblog<\/a>.<\/p>\n<p>The justices ruled the county\u2019s restrictions should be put on hold until the appeals process was over, <a href=\"https:\/\/www.supremecourt.gov\/orders\/courtorders\/022621zr_1bo2.pdf\">writing<\/a>:<\/p>\n<blockquote>\n<p>The application for injunctive relief presented to Justice Kagan and by her referred to the Court is granted pending disposition of the appeal in the United States Court of Appeals for the Ninth Circuit and disposition of the petition for a writ of certiorari, if such writ is timely sought. The Ninth Circuit\u2019s failure to grant relief was erroneous. This outcome is clearly dictated by this Court\u2019s decision in <em>South Bay United Pentecostal Church<\/em> v. <em>Newsom.<\/em><\/p>\n<\/blockquote>\n<p>Nebraska GOP senator Ben Sasse responded to the ruling, asserting, \u201cGavin Newsom can get a reservation at the French Laundry but he can\u2019t rewrite the First Amendment. States that intentionally target religious liberty have been slapped down by the courts again and again. The message is clear: This pandemic doesn\u2019t rewrite the Constitution,\u201d as <a href=\"https:\/\/freebeacon.com\/coronavirus\/supreme-court-deals-another-blow-to-embattled-newsom\/\">The Washington Free Beacon<\/a> reported.<\/p>\n<p>In February, the Court ruled for South Bay United Pentecostal Church of San Diego after lower courts had ruled that California\u2019s restrictions on worship, singing, and chanting in churches appeared to be legally justified,\u00a0theLos Angeles Ti reported. \u00a0The Daily Wire <a href=\"https:\/\/www.dailywire.com\/news\/california-to-revise-church-restrictions-after-supreme-court-ruling\/\">reported<\/a> on February 7:<\/p>\n<blockquote>\n<p><em>Under California\u2019s blueprint for reopening, counties in the \u201cpurple-tier\u201d status cannot hold indoor church service. According to\u00a0<a href=\"https:\/\/covid19.ca.gov\/safer-economy\/\">state data<\/a>, more than 40 million people live in purple-tier counties. Under the court decision, California can limit church capacity at up to 25%. However, within the court\u2019s majority, the justices differed as to the extent California appears to have discriminated against houses of worship.<\/em><\/p>\n<p><em>Justices Neil Gorsuch and Clarence Thomas argued in a concurring opinion that the 25% threshold should be scrapped as well, along with the limits on singing.
