Nancy Skinner (D. Berkeley), introduced Senate Bill 274 that said such suspensions lead students to drop out and exacerbate learning losses at a moment when many are still behind from the COVID-19 epidemic.<\/p>\n<p>Skinner stated that such suspensionsdisproportionately affect Black male students. (Rich Pedroncelli\/AP Photo)<\/figure>\n<p>The new bill builds on Skinner\u2019s 2019 now-passed legislation, which permanently banned willful defiance suspensions statewide for grades TK\u20135 and those for grades 6\u20138 until 2025.<\/p>\n<p>The new bill would permanently prohibit them for all grades, TK\u201312, by the fall of 2024.<\/p>\n<p>It would also ban suspension or expulsion of students due to tardiness or other truancy.<\/p>\n<p>\u201cThe punishment for missing school should not be to miss more school,\u201d Skinner, \u201cStudents, especially those with behavioral issues, need to be in school where teachers and counselors can help them succeed.\u201d<\/p>\n<p>Some others, however, argue that students who are disruptive in the classroom make it difficult for teachers to teach and for students to learn.<\/p>\n<p>Davina Keiser was a former educator who taught in the Long Beach Unified Schools District for 40 years. She told the Epoch Times disruptive behavior was a problem. \u201cdetrimental to the learning of everybody else in the classroom.\u201d<\/p>\n<p>\u201cIt\u2019s almost like a license for the rest of the kids to go ahead and misbehave,\u201d She spoke.<\/p>\n<p>Keiser continues to serve as a substitute teacher in the District and is also the president for the education nonprofit <a href=\"https:\/\/www.delreyeducation.org\/about\">Del Rey Education<\/a>.<\/p>\n<p>\u201cAs teachers, I wanted students to know that there are boundaries, and they have to stay within those,\u201d She spoke.<\/p>\n<p>The proposed policy reflects a nationwide trend of replacing disciplinary actions with what\u2019s called a \u201crestorative justice\u201d approach\u2014which focuses on mediation over punishment.<\/p>\n<figure id=\"attachment_4149948\" class=\"wp-caption aligncenter\"><a href=\"https:\/\/img.theepochtimes.com\/assets\/uploads\/2021\/12\/10\/GettyImages-1235166060.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"lazy size-medium wp-image-4149948\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" data-src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/02\/GettyImages-1235166060-600x399-1.jpg\" alt=\"Epoch Times Photo\" width=\"600\" height=\"399\" \/><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-4149948\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/02\/GettyImages-1235166060-600x399-1.jpg\" alt=\"Epoch Times Photo\" width=\"600\" height=\"399\" \/><\/noscript><\/figcaption><\/a> Students walk to their classes at a Los Angeles middle school on Sept. 10, 2021. (Robyn Beck\/AFP via Getty Images)<\/figure>\n<p>This may encourage more rebellion, as students know there is no punishment for being disruptive in classes, stated Lance Christensen vice president of education policy at the California Policy Center.<\/p>\n<p>Disruptive students who have not been disciplined could continue their disruptive ways \u201cact out in larger measure later,\u201d He told The Epoch Times.<\/p>\n<p>\u201cWhen these bills take away the tools for dealing with those who are willfully defiant, all they do is just move the violence to a higher level and escalate the violence,\u201d He said. \u201c[Y]ou cannot just throw the baby out with the bathwater and get rid of a discipline policy that works.\u201d<\/p>\n<p>The root of the issue, Christensen said, is often the student\u2019s family and home life.<\/p>\n<p>Students with disintegrated families, or families conflicted with other problems, often don\u2019t teach their children to respect authority and how to behave in a classroom and participate in a positive way.<\/p>\n<p>\u201cThat\u2019s a whole set of social ills that would take more than a piece of legislation to fix,\u201d Christensen said.<\/p>\n<p>He additionally said if such legislation is being considered because of data related to race, that\u2019s ill-guided.<\/p>\n<p>\u201cIf a kid is willfully defiant, the race or the color of their skin shouldn\u2019t matter at all,\u201d He said.<\/p>\n<p>Keiser agreed.<\/p>\n<p>\u201cI always felt like it didn\u2019t matter if a student is an ethnic minority or not,\u201d She spoke. \u201cWe\u2019re supposed to provide equal opportunity for all students.
