Under Section 1 of Article III of the New Mexico Constitution, however, a sitting member of the Legislature may not \u2018exercise any powers properly belonging\u2019 to either the executive or judicial branch,\u201d The motion begins.<\/p>\n<p>The motion <a href=\"https:\/\/variety.com\/2023\/film\/news\/alec-baldwin-rust-disqualify-special-prosecutor-andrea-reeb-1235515795\/\" target=\"_blank\" rel=\"noopener\">Claim<\/a> that the separation of powers defined in the New Mexico State constitution does not allow for Reeb to continue in her role as special prosecutor \u2014 a role to which she was appointed last year by the First Judicial District Attorney in Santa Fe \u2014 if she wished to serve as a legislator.<\/p>\n<p>\u201cDoing so vests two core powers of different branches \u2014 legislating and prosecuting \u2014 in the same person and is thus barred by the plain language of Article III of the New Mexico Constitution,\u201d Motions states that her political opinions could influence her actions as a prosecutor by combining them.<\/p>\n<p>\u201cWere the arrangement here approved by the courts, future District Attorneys could seek to curry favor with legislators who control their budgets by appointing them to high-profile cases \u2014 distorting the legislative process,\u201d The motion continues.<\/p>\n<p>Control of the budget appears to be a sticking point in the filing \u2014 particularly the fact that the state legislature has already been asked by Governor Michelle Lujan Grisham to approve a budget of $317,700 to be used for the prosecution \u2014 since Reeb could potentially be casting a vote on her own budget.<\/p>\n<p>Baldwin\u2019s lawyers went on to claim that even if Reeb were to refrain from voting on that specific issue, her colleagues could vote in favor of it in an effort to gain her support on other issues.<\/p>\n<p>Reeb stated in a previous statement that she would not allow her political views to affect her work as a prosecutor. \u201cEverybody\u2019s equal under the law. It doesn\u2019t matter if he\u2019s a liberal Democrat and I\u2019m a conservative Republican. My job has always been to prosecute crimes and hold defendants accountable and help victims.
