Chip Roy (R.Texas), filed Jan. 9.<\/p>\n<p>\u201cSomething needs to be done. We don\u2019t think the Biden administration is doing anything, or the Senate is doing anything\u201d Chmielenski said that the border was secured to The Epoch Times. \u201cFirst and foremost, we\u2019ve got to deal with the <a href=\"https:\/\/www.theepochtimes.com\/t-border-crisis\">border crisis<\/a>.\u201d<\/p>\n<p>Arlington, Virginia-based <a href=\"https:\/\/www.numbersusa.org\/\">NumbersUSA<\/a> describes itself as \u201cthe leading grassroots organization fighting to cut legal and illegal immigration \u2026 [with] 8 million participants nationwide.\u201d It has been battling to \u201cscuttle the amnesty proposals of the Trump, Obama, and Bush administrations\u201d since its 1997 founding.<\/p>\n<h2>Border Bill Awaits Hearings, Faces Resistance<\/h2>\n<p>Roy\u2019s bill, HR 29, which had 64 co-sponsors as of Feb. 5, is set to be heard before the House Homeland Security and Judiciary committees but isn\u2019t among measures being fast-tracked to the chamber floor. No dates are set for committee hearings.<\/p>\n<p>Roy <a href=\"https:\/\/www.theepochtimes.com\/rep-chip-roy-defends-border-bill-absolutely-doesnt-ban-asylum_5010098.html?ea_src=ai&#038;ea_med=search\">told The Epoch Times<\/a> in January that McCarthy assured Republican holdouts during the week-long negotiation that allowed him to ascend to chamber leadership that immigration-related bills would get to the floor, including his \u201cTexas border plan.\u201d<\/p>\n<p>Roy said the bill is a simple proposal, especially for lawmakers who support border security and the <a href=\"https:\/\/www.theepochtimes.com\/search\/?q=Title+42+health+order&#038;t=ai\">Title 42 public health order<\/a>\u00a0that allows the United States Border Patrol to quickly expel some illegal aliens. \u201cYou\u2019re either for it or you\u2019re against it,\u201d he said.<\/p>\n<p>The bill requires the Department of Homeland Security (DHS) to suspend entry of any non-U.S. national without valid documents if it doesn\u2019t have the capacity to detain them while their status is being sorted out or the ability to return them to a foreign country contiguous to the United States.<\/p>\n<p>There\u2019s nothing new in the bill except that Roy\u2019s measure allows states to seek legal action to force the DHS to enforce the existing law.<\/p>\n<p>The Biden administration isn\u2019t enforcing the Trump-era \u201cRemain in Mexico\u201d policy while also decreasing detention space, meaning aliens who entered the United States illegally are allowed to enter before their cases are adjudicated.<\/p>\n<p>Under this \u201ccatch-and-release\u201d system, illegal aliens are provided a trackable phone and a court date that\u2019s often months or even years later.<\/p>\n<p>While the \u201cRemain in Mexico\u201d program was enforced under the Trump administration, illegal immigration dropped by about 75 percent, according to U.S. Customs &#038; Border Protection (CBP).<\/p>\n<p>Despite the U.S. Supreme Court\u00a0<a href=\"https:\/\/www.theepochtimes.com\/supreme-court-orders-biden-admin-to-reinstate-remain-in-mexico-policy_3964011.html\">ordering<\/a>\u00a0the Biden administration to reinstate the policy in August 2022, no illegal aliens have been placed in the program, according to CBP\u00a0<a href=\"https:\/\/www.cbp.gov\/newsroom\/stats\/custody-and-transfer-statistics-fy22\">statistics.<\/a><\/p>\n<p>Roy said Congress\u2019s \u201cdefault position\u201d should be \u201coperational control of the border\u201d but his measure has drawn fierce opposition from a coalition of 253 nongovernmental organizations who say it would \u201cshut our border to all asylum-seekers, no matter how strong their cases might be.\u201d<\/p>\n<p>If adopted, the coalition said in a letter to Congress, the policy would \u201creturn refugees of all nationalities and ages, including children, directly to harm and death.\u201d<\/p>\n<h2>\u2018Credible Fear\u2019 Claims Clogging System<\/h2>\n<p>But Chmielenski said the asylum system, as currently interpreted, is broken and should be scrapped until Congress addresses comprehensive immigration reform.<\/p>\n<p>\u201cPeople can claim as a first step \u2018credible fear\u2019 of returning to their country. For the most part, [immigration officials] accept illegal aliens\u2019 claims at face value and put them in asylum proceedings,\u201d he said.<\/p>\n<p>As a result, \u201cthere are more than 1 million of these claims on the docket\u2014a 1 million-claim backlog\u2014and a five- to 10-year wait to get before an immigration judge.\u201d<\/p>\n<p>What makes the policy so frustrating, he said, is a majority of those claiming \u201ccredible fear\u201d as a reason for staying in the United States are rejected once they get before an immigration judge\u2014if they show up.<\/p>\n<p>House Republicans must end this \u201ccatch-and-release\u201d and \u201climit the Biden administration\u2019s use of <a href=\"https:\/\/www.cbp.gov\/travel\/us-citizens\/advance-parole\">advance parole<\/a>,\u201d Chmielenski said, by restoring the Trump administration policy \u201cto make them wait in Mexico.\u201d<\/p>\n<p>NumbersUSA maintains Roy\u2019s bill \u201cis a good start but definitely not the gold standard\u201d of legislation it wants to be enacted, Chmielenski said.<\/p>\n<p>When asked what the \u201cgold standard\u201d would be, he said, \u201cOne of the significant things that the bill does not deal with is the whole issue with asylum,\u201d which Roy insists will remain intact as currently defined.<\/p>\n<h2>Adopt \u2018Legal Workforce Act\u2019 ASAP<\/h2>\n<figure id=\"attachment_4035252\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/02\/Rep.-Ken-Calvert-1200x800-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"lazy wp-image-4035252 size-large\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" data-src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/02\/Rep.-Ken-Calvert-1200x800-1.jpg\" alt=\"Epoch Times Photo\" width=\"640\" height=\"427\"   style=\"display:none\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4035252 size-large\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/02\/Rep.-Ken-Calvert-1200x800-1.jpg\" alt=\"Epoch Times Photo\" width=\"640\" height=\"427\" \/><\/noscript><\/figcaption><\/a> Rep. Ken Calvert\u2019s (R-Calif.) proposed <a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/319?s=1&#038;r=6\">Legal Workforce Act<\/a>, which would \u201cmake mandatory and permanent requirements related to using an electronic employment eligibility verification system.\u201d<\/p>\n<p>HR 319, which has six co-sponsors, is to be heard before the House Judiciary Committee, the Ways and Means Committee, and the Education and the Workforce Committee. No hearing dates are set.<\/p>\n<p>\u201cAmerican jobs should only go to people legally authorized to work in our country,\u201d Calvert said in a statement accompanying the bill\u2019s introduction. \u201cThe passage of the \u2018Legal Workforce Act\u2019 would represent a crucial step towards fixing our broken immigration system. Until we have a mandatory workforce verification system\u2013like E-Verify\u2013in place, immigrants will have an incentive to come into our country through illegal means. We want and need immigrants to come to our nation to contribute to our economic success, but we must also remain a sovereign nation governed by the rule of law.\u201d<\/p>\n<p>Chmielenski said Calvert\u2019s proposed Legal Workforce Act has \u201cactually been endorsed by the U.S. Chamber of Commerce, the National Restaurant Association, and National Home Builders Association. These are organizations that tend to oppose additional mandates on employers.\u201d<\/p>\n<p>Right now, according to the National Conference of State Legislatures, 22 states impose some form of \u201cmandatory E-Verify rather than just requiring I-9,\u201d he said, which puts the onus on employers to \u201cbecome document experts. E-Verify is a touchy subject in the states but [mandatory E-Verify] would replace a patchwork of laws from state-to-state and go a long way\u201d to addressing the nation\u2019s immigration issues.<\/p>\n<p>Such a measure \u201chas wide support from a vast majority of Americans\u201d and \u201cbusinesses themselves support one uniform law rather than having to play by different rules\u201d in different states,\u201d Chmielenski said.<\/p>\n<p>Ultimately, NumbersUSA wants Congress to engage in comprehensive immigration reform, which hasn\u2019t been addressed since 1986 under the Reagan administration, he said.<\/p>\n<p>But first things first, especially when confronted with a border crisis and what\u2019s politically feasible in the here and now, Chmielenski said, lauding House Republicans for \u201cat least saying\u00a0 they will make this issue a priority.\u201d<\/p>\n<p>Essentially, Roy\u2019s bill \u201cputs a marker out there and says we are taking this seriously.
