It is at least the third time the FBI has searched Biden\u2019s effects as part of the investigation, and one of those searches was done so discreetly it wasn\u2019t public knowledge until months after the fact. <\/p>\n<p>In addition to his home, classified documents were also found at the Penn-Biden center, the president\u2019s Chinese-funded think tank. The Justice Department has also graciously trusted Biden\u2019s personal attorneys \u2014 who did not have security clearances \u2014 to sift through his papers and identify any potentially incriminating documents without DOJ supervision.<\/p>\n<p>These searches of Biden\u2019s home and private papers came just a few months after the FBI raided former President Donald Trump\u2019s home at Mar-a-Lago for the identical crime of mishandling classified documents. Biden&#8217;s situation is <a href=\"https:\/\/mobile.twitter.com\/BasedMikeLee\/status\/1618682312274874371\" target=\"_blank\" rel=\"noreferrer noopener\">It could be worse<\/a> since he allegedly retained classified documents from his Senate tenure, which doesn\u2019t have any declassification authority that comes with the presidency. But now after weeks of breathless speculation about how the Justice Department prosecution could be used to keep Trump from running for president again, the media are at pains to explain why Trump\u2019s crimes are somehow worse than Biden\u2019s.<\/p>\n<p>And so the media haven\u2019t coalesced so much as collapsed around a central narrative: Biden\u2019s violations of the law are somehow excused because he\u2019s fully cooperating with the FBI investigation. As Exhibit A, here\u2019s <a href=\"https:\/\/www.nytimes.com\/2023\/02\/01\/us\/politics\/fbi-biden-rehoboth.html\" target=\"_blank\" rel=\"noreferrer noopener\">The New York Times article<\/a> on the latest FBI search of Biden\u2019s home:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>WASHINGTON \u2014 The F.B.I. is conducting a search of President Biden\u2019s vacation home in Rehoboth Beach, Del., the president\u2019s personal lawyer said on Wednesday morning, as investigators continue looking into his possession of classified documents.\u00a0<\/p>\n<p>This search was conducted with the support of the president and his legal staff, as well as two others at locations related to Mr. Biden. It was unclear whether any documents had been found at the beach home.\u00a0<\/p>\n<p>\u201cToday, with the president\u2019s full support and cooperation, the D.O.J. is conducting a planned search of his home in Rehoboth, Del.,\u201d Bob Bauer, Mr. Biden\u2019s personal lawyer, said in statement.\u201cUnder D.O.J.\u2019s standard procedures, in the interests of operational security and integrity, it sought to do this work without advance public notice, and we agreed to cooperate.\u201d<\/p>\n<\/blockquote>\n<p>They are also downplaying the fact that a sitting president was at the centre of a lengthy FBI investigation. This mere fact was routinely cited as disqualifying when Trump was president, regardless of how meritless the FBI\u2019s Russia-collusion investigation proved to be. But you almost have to admire the chutzpah of framing the entire story around Biden\u2019s exculpatory excuses, replete with a generous quote from Biden\u2019s lawyer explaining as much. <\/p>\n<p>Note the shaming of claiming that all this was done \u201cunder D.O.J.\u2019s standard procedures\u201d as if the FBI repeatedly, albeit reluctantly, digging through a sitting president\u2019s house for evidence of crimes is just another day at the office. <\/p>\n<p>Then there\u2019s the declaration that \u201cit sought to do this work without advance public notice, and we agreed to cooperate.\u201d There\u2019s a big difference between \u201cwithout advance public notice\u201d and being given no notice at all when armed federal agents show up over the same crime and start going through your wife\u2019s underwear drawer. Similarly, you can detect a subtle difference between the way The New York Times runs ostensible press releases from Biden\u2019s lawyer in the third paragraph, versus media outlets running with <a href=\"https:\/\/www.washingtonexaminer.com\/opinion\/so-was-that-nuclear-document-at-mar-a-lago-classified\" target=\"_blank\" rel=\"noreferrer noopener\">Leaks by the feds that could be considered illegal or grossly misleading about what they discovered in their surprise raid<\/a> Trump \u00a0<\/p>\n<p>Prior to Mar-a-Lago being raided, Trump\u2019s attorneys had been communicating with the DOJ about their concerns that Trump might be illegally retaining classified documents. Was Trump&#8217;s legal team uncooperative or cooperative? How would we know if Biden is cooperating more than Trump in parallel investigation of mishandling classified information? \u201cCooperation\u201d in this context appears to be solely defined by Biden\u2019s mouthpieces: a largely unaccountable federal agency that previously investigated Trump on demonstrably false charges and the credulous media.<\/p>\n<p>Suffice to say, if you\u2019re not a sitting Democratic president, don\u2019t expect such deference \u2014 cooperation with the feds often doesn\u2019t end well for ordinary citizens seeking justice. Mark Houck, a pro-life activist, was interviewed earlier this week. <a href=\"https:\/\/www.inquirer.com\/news\/mark-houck-bucks-county-planned-parenthood-jury-acquitted-20230130.html\" target=\"_blank\" rel=\"noreferrer noopener\">Jury acquits in less than an hour<\/a> after being prosecuted for violating an obscure federal law \u2014 one with troubling First Amendment implications \u2014 that makes it a crime to \u201cinjure, intimidate or interfere with anyone providing abortion services.\u201d Houck protested often in front of abortion centers, as is his constitutional rights, and got into a physical altercation, with a Planned Parenthood volunteer escort.<\/p>\n<p>Houck said that the incident did not result in the blockage of access to the facility. However, he claims the volunteer was harassing his son. Houck was not charged with assault by Philadelphia authorities. Eventually, <a href=\"https:\/\/www.wsj.com\/articles\/justice-for-mark-houck-fbi-abortion-pro-life-planned-parenthood-face-act-not-guilty-crime-arrest-11675113079\" target=\"_blank\" rel=\"noreferrer noopener\">Planned Parenthood officials acknowledged the volunteer<\/a> Houck stated that he was going to his son&#8217;s aid after being spoken to. \u201cnumerous times\u201d Concerning violating their \u201cnon-engagement policy.\u201d Federal Judge eventually ruled in favor of the federal law being applied \u201cto be stretched a little thin here.\u201d<\/p>\n<p>However, some Republican senators were arrested on federal charges. <a href=\"https:\/\/www.judiciary.senate.gov\/imo\/media\/doc\/republican_senators_to_justice_deptfbiarrestofprolifeadvocate.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Investigated the scandalous prosecution of Houck<\/a>. It\u2019s quite clear that he did everything he reasonably could to cooperate with the federal investigation, in spite of the fact that the charges against him were vindictive and baseless from the start. This is what his cooperation brought him:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p><em>Matt Heffron was a former federal prosecutor and Mr. Houck retained him as an attorney. Mr. Heffron informed the committee that he communicated to Assistant U.S. Attorney Anita Eve twice via phone and left voice messages after she didn\u2019t pick up. After not receiving a return call, Mr. Heffron emailed Ms. Eve to note that he left voice messages on May 21, 2022, and June 7, 2022, and said in his email that if the Department intended to indict Mr. Houck, he would receive the summons on Mr. Houck\u2019s behalf and that he would appear voluntarily. Ms. Eve didn&#8217;t respond to Mr. Heffron&#8217;s request. The committee was informed by Mr. Heffron that he and Mr. Houck had been cooperative with the Justice Department. However, the Justice Department did not respond to their requests.<\/em><\/p>\n<p><em>Given their cooperation with federal law enforcement, the family did not expect to be awakened at 7 a.m. with reportedly over 20 FBI agents surrounding their home wearing armor\u00a0 plated tactical vests, ballistic helmets and holding ballistic shields and long guns.<\/em><\/p>\n<p><em>According to reports, Mrs. Houck stated that \u201c[t]hey said they were going to break in if [my husband] didn\u2019t open [the door]. And then they had about five guns pointed at my husband, myself, and basically at my kids.\u201d\u00a0According to reports, Mr. Houck was handcuffed when he opened the front door.\u00a0 Before being taken to jail, Mr. Houck is alleged to have asked his wife for a rosary and a sweatshirt.<\/em><\/p>\n<\/blockquote>\n<p>The Justice Department doesn&#8217;t care about \u201ccooperation\u201d \u2014 if it wants to prosecute you, it is going to prosecute you. Anyone who thinks it\u2019s meaningful that Biden is said to be cooperating with the investigation into him is either knowingly making excuses or willfully blind to just how political the Justice Department has become.<\/p>\n<hr class=\"wp-block-separator\" \/>\n<div class=\"article-author-description fst-italic\">\n Mark Hemingway, the Book Editor of The Federalist, was previously a senior writer at The Weekly Standard.
