It\u2019s worked quite well since few election attorneys now dare to represent Kari Lake and other conservative candidates who lost their races due to\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/townhall.com\/columnists\/rachelalexander\/2022\/12\/26\/the-dismissal-of-kari-lakes-election-lawsuit-shows-voter-disenfranchisement-no-longer-matters-n2617566\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">massive voter disenfranchisement<\/span><\/a><span data-preserver-spaces=\"true\">. The left filed a complaint against John Eastman, a top conservative lawyer, last year for representing Donald Trump in his 2020 challenge efforts. On Thursday, the State Bar of California heard the complaint.\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/discipline.calbar.ca.gov\/portal\/DocumentViewer\/Index\/xv_FicSci6H9VoCsxKkcVVqIlxBVZgX1T4U7NWRSzvWtgW8H1kv4DPfgbBfHMGMod0MPwiqkG7yhlp42frDgZtjouvz-_10p41IMUugMBRY1?caseNum=SBC-23-O-30029&#038;docType=Initial%20Pleading%2FResponse&#038;docName=Notice%20of%20Disciplinary%20Charges&#038;eventName=Notice%20of%20Disciplinary%20Charges&#038;docTypeId=268&#038;isVersionId=False&#038;p=0\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Announcement<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0It is trying to disbar him.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The 65 Project filed a\u00a0<\/span><a class=\"editor-rtfLink\" href=\"http:\/\/the65project.com\/wp-content\/uploads\/2022\/07\/John-Eastman.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Complaint<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0against Eastman, a law professor who once clerked for Supreme Court Justice Clarence Thomas and founding director of the Claremont Institute\u2019s Center for Constitutional Jurisprudence, with the U.S. Supreme Court, and the States United Democracy Center (SUDC) filed a\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/statesuniteddemocracy.org\/resources\/california-bar-complaint-against-john-eastman\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Complaint<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0California Bar. The SUDC consists of liberal Republicans and progressive activists like Janet Napolitano. According to the Bar, Eastman told Trump and Vice President Mike Pence not to certify the election. But that\u2019s completely false. Eastman reviewed all legal options available to them, but he didn&#8217;t recommend any. In fact, he was quite negative about this option.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Eastman \u201c<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/76c05e51-fbfb-4137-af75-ddb411cf368d.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">determined<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0that, in light of the acknowledged illegality and serious allegations of fraud, one possible option was for the Vice President to accede to requests from numerous state legislators to postpone certification for a brief period to allow the claims of fraud and illegality to be assessed by the state legislatures.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">He was.n\u2019t trying to overturn the election or cause an insurrection, as the Bar characterizes it. He was\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/ea72b09c-279b-4a7a-ab8c-16992584fac4.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Advice<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0On \u201cwhether the electoral votes that had been certified were legally certified after state election officials violated numerous provisions of state election law that had been adopted by the legislatures of the several states at issue, violations that unconstitutionally intruded on the legislatures\u2019 plenary power to direct the manner of choosing electors.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">In fact \u201cEastman himself\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/ea72b09c-279b-4a7a-ab8c-16992584fac4.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">advised<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0the Vice President during the Oval Office meeting on January 4, 2021, that it would be foolish to unilaterally reject electoral votes absent certificate of alternatives from state legislators, even if he had such constitutional authority.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Bar accused Eastman defaming historical sources and stated that he \u201cknew or was grossly negligent\u201d In \u201cnot knowing\u201d The law review articles that he cited were \u201cfundamentally flawed.\u201d Eastman did not believe that there were any problems with the law review articles. They go through rigorous editing and reviewing before they are published.\u00a0<\/span><\/p>\n<p>The Bar stated that \u201cno reasonable attorney with expertise in constitutional or election law would have concluded that the Vice President was legally authorized to take the actions respondent proposed.\u201d But that\u2019s not true. Based on historical precedents, almost every conservative election lawyer believes that it is possible.\u00a0<\/p>\n<p><span data-preserver-spaces=\"true\">Eastman\u2019s attorney Randall Miller sent a 100-page\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/ea72b09c-279b-4a7a-ab8c-16992584fac4.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Response<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0to the Bar\u2019s initial investigation, with hundreds of pages of attachments. In it, Miller cited numerous examples in our country\u2019s history where the Vice President deliberately chose to count or not count electoral votes. Thomas Jefferson, Vice President, demanded that the electoral votes from Georgia were counted in 1801, despite the fact that they had been incorrectly certified. Richard Nixon, in 1961, demanded that the Kennedy electors be counted rather than the Nixon electors. This despite the fact that the Nixon electors were the ones who had been certified to vote. And so on.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Eastman mentioned several legal experts, some from the 1800s who had concluded the same.\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/constitution.congress.gov\/constitution\/amendment-12\/\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Twelfth Amendment<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0This gives the Vice President this discretionary option. The Bar and others tried to use statements made by two people critical of this position, but Eastman pointed out that wasn\u2019t taking into account their complete statements. Former Fourth Circuit Judge J. Michael Luttig\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/ea72b09c-279b-4a7a-ab8c-16992584fac4.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"><\/span><\/a><span data-preserver-spaces=\"true\">\u00a0That was January 4, 2021. \u201cJohn is a brilliant constitutional scholar. Whatever John is telling the President has some basis in the law.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Similarly, Vice President Pence\u2019s General Counsel, Greg Jacob, advised Pence that legal scholars disagreed about the scope of authority the Vice President had under the Twelfth Amendment. He also\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/ea72b09c-279b-4a7a-ab8c-16992584fac4.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"><\/span><\/a><span data-preserver-spaces=\"true\">, \u201cThere is some historical evidence that [Vice Presidents] Adams and Jefferson both resolved issues over the validity of electoral votes in their favor.\u201d<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Bar also pursued Eastman for his involvement with various Trump election lawsuits. Eastman\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/p\/response-to-california-bar-investigation\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"><\/span><\/a><span data-preserver-spaces=\"true\">\u00a0the Bar\u2019s complaint \u201cis filled with distortions, half-truths, and outright falsehoods.\u201d The complaint repeated the abusive language used in irresponsible hack MSM journalists like one who wrote for The New Republic.\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/newrepublic.com\/article\/170232\/john-eastman-disbarment-coup-plot\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Characterized<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0Eastman \u201cplotting to illegally overturn a presidential election.\u201d\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The Bar\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/discipline.calbar.ca.gov\/portal\/DocumentViewer\/Index\/xv_FicSci6H9VoCsxKkcVVqIlxBVZgX1T4U7NWRSzvWtgW8H1kv4DPfgbBfHMGMod0MPwiqkG7yhlp42frDgZtjouvz-_10p41IMUugMBRY1?caseNum=SBC-23-O-30029&#038;docType=Initial%20Pleading%2FResponse&#038;docName=Notice%20of%20Disciplinary%20Charges&#038;eventName=Notice%20of%20Disciplinary%20Charges&#038;docTypeId=268&#038;isVersionId=False&#038;p=0\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\"><\/span><\/a><span data-preserver-spaces=\"true\">\u00a0Eastman was involved in vague, but alarming-sounding ethical violations. \u201cmoral turpitude, dishonesty, and corruption.\u201d Those are catchall terms in state bars\u2019 Rules of Professional Conduct that are frequently used to target conservative attorneys when the bars can\u2019t get them on anything else. The Bar\u2019s investigations are kept confidential unless the attorney is considered a \u201cthreat to the public,\u201d Which they absurdly claimed Eastman to be.\u00a0<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">Federal prosecutors are also investigating Eastman. They seize his phone last June. Some of the\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/johneastman.substack.com\/api\/v1\/file\/76c05e51-fbfb-4137-af75-ddb411cf368d.pdf\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Top legal minds<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0Support him in the country, including self-description \u201cleft-libertarian\u201d Harvey Silverglate, Author of\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/www.amazon.com\/Three-Felonies-Day-Target-Innocent-ebook\/dp\/B00505UZ4G\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Three felonies a day: How the Feds Target the Incogent<\/span><\/a><span data-preserver-spaces=\"true\">.<\/span><\/p>\n<p><span data-preserver-spaces=\"true\">The only way left-wing Bar can disbar Eastman is to lie about his actions and ignore all the evidence. Nobody with half a brain believes Eastman called for an insurrection. However, with fake news coverage of proceedings, the Bar might get away with dismantling one of the participants.\u00a0<\/span><a class=\"editor-rtfLink\" href=\"https:\/\/fedsoc.org\/contributors\/john-eastman\" target=\"_blank\" rel=\"noopener\"><span data-preserver-spaces=\"true\">Most trusted<\/span><\/a><span data-preserver-spaces=\"true\">\u00a0The country has a number of conservative legal minds. This is a shocking dismantling and reorganization of the rule law.
