You Going To Believe the Media  \u2014 or Evidence?<\/h2>\n<p>In their Thursday tale, the Times trio opened by declaring that Special Counsel Durham\u2019s investigation into Crossfire Hurricane \u201cfailed to find wrongdoing in the origins of the Russia inquiry.\u201d To supposedly prove their existence, \u201cRussia inquiry unraveled\u201d narrative, it was declared so by the authors.\u00a0<\/p>\n<p>\u201cMr. Durham\u2019s work is coming to an end without uncovering anything like the deep state plot alleged by Mr. Trump and suspected by Mr. Barr,\u201d The Times declared, informing readers that the probe was closed. \u201cwent unsuccessfully down one path after another\u2026\u201d<\/p>\n<p>The Times doesn\u2019t have a clue what Durham \u201cuncovered,\u201d Knowing only what defense lawyers and other unnamed attorneys know \u201csources\u201d Several aspects of the probe were revealed. But with the release of Durham\u2019s report forthcoming, the authors seek to prime the public to believe it will be a flop.\u00a0<\/p>\n<p>But it doesn\u2019t take access to inside information or Durham\u2019s final report to know that the special counsel\u2019s office uncovered \u201cwrongdoing in the origins of the Russia inquiry.\u201d The criminal <a href=\"https:\/\/thefederalist.com\/2022\/10\/18\/danchenko-case-exposes-another-fbi-dirty-secret-politics-prompted-crossfire-hurricane\/\" target=\"_blank\" rel=\"noreferrer noopener\">Case<\/a> Igor Danchenko (Russian national source for the Steele dossier) was reprimanded for allegedly making false statements. \u201cconfirmed that Crossfire Hurricane was never properly predicated and that instead, politics prompted the targeting of Donald Trump\u2019s presidential campaign.\u201d<\/p>\n<p>In 2008, I learned that \u201cDanchenko allegedly <a href=\"https:\/\/thefederalist.com\/2022\/10\/18\/danchenko-case-exposes-another-fbi-dirty-secret-politics-prompted-crossfire-hurricane\/\" target=\"_blank\" rel=\"noreferrer noopener\">told<\/a> a colleague he knew people who would buy classified information,\u201d the FBI \u2014 rather than open a \u201cfull investigation\u201d into Danchenko \u2014 initiated only a \u201cpreliminary investigation.\u201d The FBI has only converted the \u201cpreliminary investigation\u201d \u201cinto a \u2018full investigation\u2019 after learning that the defendant (1) had been identified as an associate of two FBI counterintelligence subjects and (2) had previous contact with the Russian Embassy and known Russian intelligence officers.\u201d\u00a0<\/p>\n<p>However, the FBI opened an office in \u201cfull investigation\u201d The more abstract claim that George Papadopoulos (then-Trump campaign advisor) suggested that the Russians had dirt about Hillary Clinton in May 2016 was what led to Trump&#8217;s acceptance.\u00a0<\/p>\n<p>The FBI\u2019s failure to launch an investigation into Clinton crony Charles Dolan likewise confirms that the initial targeting of Trump suffered from political influence. With court permission, the public can access the Danchenko case evidence. <a href=\"https:\/\/thefederalist.com\/2022\/10\/18\/danchenko-case-exposes-another-fbi-dirty-secret-politics-prompted-crossfire-hurricane\/\" target=\"_blank\" rel=\"noreferrer noopener\">Filings<\/a> Dolan was questioned by witnesses who revealed two FBI agents. \u201chad previously worked for a firm that managed a PR campaign for the Kremlin.\u201d Dolan\u2019s connections to Russian President Vladimir Putin\u2019s press secretary and a sub-source for the Steele dossier also raised red flags.\u00a0<\/p>\n<p>Dolan was then interviewed by FBI agents. They attempted to launch an FBI investigation into Clinton pal Clinton, but bureau top-ranking officials stopped them. While since then Dolan appears to have been vindicated, the disparity in treatment of Dolan and Trump \u2014 when the former had much more extensive contacts with Russia than did Trump \u2014 confirms the FBI launched Crossfire Hurricane without a proper predicate.\u00a0<\/p>\n<p>Further evidence confirms numerous aspects of the assertion. \u201cdeep state plot\u201d The Times declared it unproven. Kevin Clinesmith <a href=\"https:\/\/thefederalist.com\/2020\/08\/24\/fbi-lawyers-guilty-plea-suggests-spygate-corruption-goes-way-higher\/\" target=\"_blank\" rel=\"noreferrer noopener\">Change<\/a> An email was sent to conceal the fact that Carter Page had been a source of the CIA. The FBI used a defensive approach to cover the truth. <a href=\"https:\/\/thefederalist.com\/2020\/07\/23\/declassified-documents-show-fbi-used-defensive-briefing-in-2016-to-spy-on-donald-trump\/\" target=\"_blank\" rel=\"noreferrer noopener\">Briefing<\/a> Former DOJ prosecutor Michael Sussmann used his deep-state to spy on Trump <a href=\"https:\/\/thefederalist.com\/2022\/06\/06\/9-big-things-we-learned-from-the-michael-sussmann-prosecution\/\" target=\"_blank\" rel=\"noreferrer noopener\">Contacts<\/a> With the FBI and CIA to supply them with fake Russia-collusion scandals for Clinton and her backers, there is plenty of evidence already publically available of a deep state plot.<\/p>\n<p>The notes of John Brennan, then-CIA Director, reveal that he <a href=\"https:\/\/www.foxnews.com\/politics\/dni-brennan-notes-cia-memo-clinton\" target=\"_blank\" rel=\"noreferrer noopener\">Briefed<\/a> Former President Obama, July 28, 2016, intelligence detailing \u201cHillary Clinton\u2019s purported \u2018plan\u2019 to tie then-candidate Donald Trump to Russia as \u2018a means of distracting the public from her use of a private email server\u2019 ahead of the 2016 presidential election.\u201d The Obama administration ignored that intelligence briefing, with the targeting of the Trump campaign not even paused in response to the CIA\u2019s intel.\u00a0<\/p>\n<p>Apparently, The New York Times\u2019 month-long investigation of Durham didn\u2019t include looking at the evidence publicly available.\u00a0<\/p>\n<h2>2. Russia Collusion Wasn\u2019t Real<\/h2>\n<p>Next, the Times article tried to rewrite history by portraying Trump-Russia collusion in real life and claiming the contrary as conspiracy theories.\u00a0<\/p>\n<p>Robert Mueller, Special Counsel to Russia, concluded that there was no collusion and did not charge any Trump associates with conspiring. \u201cthe reality was more complex,\u201d The Old Gray Lady is certain. \u201cIn fact, the report\u00a0detailed \u2018numerous links between the Russian government and the Trump campaign,\u2019\u201d\u00a0the Times stressed \u2014 a point the authors themselves reiterated, speaking of \u201cthe 2016 Trump campaign\u2019s myriad if murky links to Russia\u2026\u201d<\/p>\n<p>It\u2019s almost as if Savage, Goldman, and Benner were just teleported to present time and hadn\u2019t lived through the twin revelations of the last six-plus years. First, there was nothing nefarious about any of Trump\u2019s links to Russia. Second, Hillary Clinton, who had no connections to Russia, paid through her lawyers a Russian national and suspected agent for the Steele dossier lies. This led to the now-debunked Russia collusion conspiracy.\u00a0<\/p>\n<p>Nonetheless, the Times reporters wrote as if the Russia, Russia, Russia refrain would still hypnotize the American public \u2014 and not just about 2016. Instead, Savage, Goldman and Benner presented another theory about Russian malfeasance. This one corrupting Durham.<\/p>\n<p>\u201cMr. Durham used Russian intelligence memos \u2014 suspected by other U.S. officials of containing disinformation \u2014 to gain access to emails of an aide to George Soros,\u201d According to the Times, Those memos, according to the Times\u2019 unnamed sources, \u201cwere part of a trove provided to the C.I.A. by a Dutch spy agency\u201d This was the case. \u201cinfiltrated the servers of its Russian counterpart.\u201d\u00a0<\/p>\n<p>These memos were \u201cwritten by Russian intelligence analysts\u201d Discussed \u201cpurported conversations involving American victims of Russian hacking,\u201d According to the Times, They also \u201cincluded descriptions of Americans discussing a purported plan by Mrs. Clinton to attack Mr. Trump by linking him to Russia\u2019s hacking and releasing in 2016 of Democratic emails.\u201d<\/p>\n<p>According to the Times the memos were \u201csaid to make demonstrably inconsistent, inaccurate or exaggerated claims,\u201d Some U.S. analysts have expressed their opinion that \u201cRussia may have deliberately seeded them with disinformation.\u201d<\/p>\n<p>After 50 former intelligence officers falsely framed the Hunter Biden laptop as Russian disinformation, it requires some gall for The New York Times to imply that Durham\u2019s supposed reliance on intercepted Russian emails provided by Dutch intelligence was inappropriate because some unidentified \u201canalysts\u201d And \u201cofficials\u201d Some claim that they may contain Russian disinformation. <\/p>\n<p>The Times\u2019 attack on Durham\u2019s supposed use of the emails provided by the Dutch intelligence service is likewise laughable given the legacy outlet\u2019s pushing of the Russia-collusion hoax based on the Steele dossier, which literally included Russian disinformation provided by Danchenko.\u00a0<\/p>\n<p>The Times not only framed the long-ago disproven Trump-Russia collusion theory in a genuine way, but also portrayed those who were outraged by the scandal as conspiracy theorists. The inquiry by the special counsel \u201cfuel[ed] partisan conspiracy theories that would never be charged in court,\u201d The article charged and presented the Barr, Durham, Trump and other responses as the problem. It was not Trump&#8217;s political targeting that caused his administration to be incapacitated.\u00a0<\/p>\n<p>To support its spin that Barr\u2019s appointment of Durham to investigate the investigators represented the true offense, the Times quoted Robert Luskin, identified in the article merely as a defense attorney who represented two witnesses interviewed by Durham. \u201cWhen did these guys drink the Kool-Aid, and who served it to them?\u201d Luskin spoke rhetorically to refer to Barr and Durham.\u00a0The Times, however, failed to explain why it would take a Jim Jones-type of persuasion to prompt Barr and Durham to question Luskin\u2019s <a href=\"https:\/\/www.foxnews.com\/politics\/stefan-halper-russiagate-trump-russia-hiding-why\">Client<\/a> Stefan Halper.<\/p>\n<p>The Times also sought to delegitimize the Durham investigation by portraying Barr as bullied into launching the probe by Trump\u2019s \u201cegging\u201d him on. Of course, that framing doesn\u2019t square with the authors\u2019 later description of Barr as \u201cdomineering,\u201d but what\u2019s a matter of consistency when you have a narrative to build?<\/p>\n<h2>3. No, Durham Didn\u2019t Launch a Criminal Investigation into Trump<\/h2>\n<p>Other outlets picked up the Times&#8217; main themes soon after it went live. \u201cBombshell,\u201d The Daily Beast <a href=\"https:\/\/www.thedailybeast.com\/trumps-russia-probe-led-to-criminal-investigation-on-trump-himself-nyt\" target=\"_blank\" rel=\"noreferrer noopener\">shrieked<\/a> Under its headline \u201cTrump\u2019s Russia Probe Led to Criminal Investigation into Trump Himself: NYT.\u201d <\/p>\n<p>\u201cAccording to a Thursday report from\u00a0<em>The New York Times<\/em>, Barr and Durham received a tip from Italian authorities that resulted in the Justice Department quietly opening a criminal inquiry into Trump himself,\u201d The Daily Beast said so.\u00a0<\/p>\n<p>Forbes followed suit and emphasized the article&#8217;s coverage. \u201cTrump\u2019s Own Appointees Reportedly Opened Criminal Investigation Into Him As Part Of Durham Russia Probe.\u201d<\/p>\n<p>Even assuming the veracity of the Times\u2019 unnamed sources \u2014 something no one should do after the Russia-collusion hoax \u2014 there is no basis for saying Durham opened a criminal investigation into Trump because The New York Times <em>Never <\/em>This claim was made.<\/p>\n<p>Yes, Savage Goldman and Benner wanted their readers. <em>Think<\/em> Durham opened an unreported investigation into the former president. But they never actually made that representation. Instead they used wordsmithing as a way to tell the story.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cMr. Barr and Mr. Durham\u00a0never disclosed that their inquiry expanded in the fall of 2019, based on a tip from Italian officials, to include a criminal investigation into suspicious financial dealings related to Mr. Trump,\u201d The authors wrote and added later: \u201cOn one of Mr. Barr and Mr. Durham\u2019s trips to Europe, according to people familiar with the matter, Italian officials \u2014 while denying any role in setting off the Russia investigation \u2014 unexpectedly offered a potentially explosive tip linking Mr. Trump to certain suspected financial crimes.\u201d<\/p>\n<\/blockquote>\n<p>The Times then claimed Barr directed Durham to\u00a0investigate the matter himself, noting that not only were charges never filed but that \u201cit remains unclear what level of an investigation it was, what steps he took, what he learned and whether anyone at the White House ever found out.\u201d This discussion was concluded by the article pronouncing that \u201cthe extraordinary fact that Mr. Durham opened a criminal investigation that included scrutinizing Mr. Trump has remained secret.\u201d<\/p>\n<p>Notice the Times\u2019 wording: It did not say Durham opened a criminal investigation into Trump<em>.<\/em> The Times didn&#8217;t mention earlier that Trump was being accused of criminality by an Italian tip. \u201cfinancial dealings.\u201d Instead, the transactions were \u201crelated to Mr. Trump\u201d Or were \u201clinked\u201d Trump\u00a0<\/p>\n<p>The Times didn&#8217;t provide details on the connection, nor did it claim complicity by any former president. \u201crelated\u201d And \u201clinked\u201d You will have to do the hard work of casting Trump as the victim of a criminal investigation.<\/p>\n<p>The New York Times blew its own trumpet by noting: \u201cit remains unclear what level of an investigation it was,\u201d meaning the Italian\u2019s supposed tip may have only prompted an assessment or a preliminary investigation, after which agents concluded there was nothing there.\u00a0It nonetheless sought to create a scandal in the mere giving of the tip and in Barr and Durham\u2019s follow-through. But the first means nothing, and the latter provides proof of Barr and Durham\u2019s integrity.\u00a0<\/p>\n<h2>4. Charging Sussmann and Danchenko Isn\u2019t an Indictment of Durham and Barr<\/h2>\n<p>Barr and Durham were targeted by the Times who promoted two contradictory narratives. At first, they called the special counsel probe a failure since the evidence was not obtained. \u201ccited in any case\u201d The conspiracy theories about Crossfire Hurricane and their supposed conspiracies were never proven to be true. \u201ccharged in court.\u201d However, just a few paragraphs later Savage, Goldman and Benner changed their minds and, relying only on unnamed resources, denounced special counsel for pursuing \u201cweak\u201d Sussmann vs. Clinton Campaign Attorney and Danchenko vs. Russian National<\/p>\n<p>Although Sussmann and Danchenko&#8217;s convictions were a loss for the special counsel team it does not mean that Durham and Barr will be indicted. If anything, Sussmann\u2019s acquittal stemmed in part from the fact that at the time of the indictment, Durham was missing the strongest piece of evidence against Sussmann: Sussmann\u2019s own text message to the then-FBI General Counsel James Baker in which Sussmann sought a meeting with Baker, but supposedly not on behalf of any client. Baker would only grudgingly provide that text message later to the special counsel\u2019s team \u2014 further indicating the idea of a deep state wasn\u2019t just a dream.\u00a0<\/p>\n<p>The Times tried to discredit Durham by presenting claims of prosecutorial disputes from unnamed sources. According to the Times, two lawyers in the special counsel\u2019s office argued against charging Sussmann. But that some of Durham\u2019s underlings disagreed with the charging decision says nothing of the broader investigation. For the Times to claim it does is laughable given the legacy outlet seemed unconcerned that multiple named FBI agents disagreed with many of Mueller\u2019s decisions, including his call not to launch an investigation into Clinton buddy Dolan.\u00a0<\/p>\n<h2>5. Using the Grand Jury\u2019s Authority Is Not Like Lying to Spy on An Innocent American\u00a0<\/h2>\n<p>The New York Times tried to discredit Durham as well by painting him in a negative light, comparing him to Crossfire Hurricane agents who used all manner of deception and misconduct to get a FISA court order for Carter Page surveillance.\u00a0<\/p>\n<p>According to the Times, Durham sought to obtain information about the emails of one purported victim of the DNC hack, Leonard Benardo, who is the executive vice president of George Soros\u2019 Open Society Foundation. After a federal judge denied Durham\u2019s request to \u201cseize information about Mr. Benardo\u2019s emails\u201d \u2014 what information and from whom was cryptically omitted \u2014 Durham reportedly \u201csidestepped\u201d The court \u201cby invoking grand-jury power to demand documents and testimony directly from Mr. Soros\u2019s foundation and Mr. Benardo about his emails.\u201d \u201cRather than fight in court, the foundation and Mr. Benardo quietly complied,\u201d According to the Times.<\/p>\n<p>Durham\u2019s use of the grand jury was \u201cparallel\u201d According to the Times, Page was the FBI&#8217;s target.\u00a0Nonsense.<\/p>\n<p>From the Times\u2019 telling of the story, Durham sought a warrant to seize information, and when that was denied, he used an alternative route via the grand jury. And Benardo did not challenge Durham\u2019s right to the information \u2014 something he could have done if he wished.<\/p>\n<p>In contrast, the federal government violated Page\u2019s constitutional rights by presenting four applications to the secret FISA court, each replete with material misrepresentations and omissions of fact. FISA court approved the FBI&#8217;s authorization to spy on Page and search his home. It also authorized him to listen in on Page&#8217;s phone conversations. These situations are not more similar than Planned Parenthood&#8217;s pro-life position.\u00a0<\/p>\n<p>The Times\u2019 readers won\u2019t likely realize that reality, though, because in Thursday\u2019s article, the authors framed the violation of Page\u2019s Fourth Amendment rights as something of an oopsie, describing the FISA abuse as merely involving \u201cbotched applications,\u201d premised on \u201cclaims from what turned out to be a dubious source, the Steele dossier.\u201d\u00a0<\/p>\n<p>So much for all the news that\u2019s fit to print.<\/p>\n<h2>6. No, Barr Isn\u2019t Unethical for Sipping Scotch<\/h2>\n<p>The final takeaway is embarrassing \u2014 the journalistic equivalent of the Old Gray Lady seeking attention with a display of cleavage and leg. The Times criticised Barr and Durham for often eating together and drinking Scotch. Oh, the horror.\u00a0<\/p>\n<p>And then there was Barr\u2019s purported profanity, when he reportedly \u201csummoned the head of the National Security Agency, Paul M. Nakasone, to his office,\u201d And \u201cdemanded that the N.S.A. cooperate with the Durham inquiry.\u201d Outrageous!\u00a0<\/p>\n<p>Barr reportedly told Nakasone that if NSA f-cked Nakasone, Barr would f ck the agency. However, the Times feigned decorum and repeated the episode with gentile phraseology. \u201ca sexual vulgarity.\u201d Barr had, however, warned him that he was about to commit suicide. \u201csix ways from Sunday\u201d All would be well if we all got back at the NSA<\/p>\n<p>The Times also criticized Barr for comments he made more than a year after leaving his position as attorney general, when Barr spoke with Fox News after Sussmann\u2019s acquittal. Jesse Watters was told by Barr that Durham had done something more than a conviction. \u201ccrystallized the central role played by the Hillary campaign in launching as a dirty trick the whole Russiagate collusion narrative and fanning the flames of it.\u201d Barr also commended Durham for being exposed \u201creally dreadful behavior by the supervisors and the FBI, the\u00a0<a href=\"https:\/\/www.foxnews.com\/politics\/gaetz-jordan-fbi-workspace-democratic-law-firm\" target=\"_blank\" rel=\"noreferrer noopener\">senior ranks of the FBI<\/a>\u2026\u201d<\/p>\n<p>Ignoring the Russiagate scandal, Savage, Goldman, and Benner instead pounced on Barr\u2019s \u201cfar more important\u201d Barr suggested the phraseology \u201cusing the courts to advance a politically charged narrative was a goal in itself.\u201d The trio, however, omitted the former attorney general\u2019s prefatory remarks stressing that Durham\u2019s team \u201cdid an exceptionally able job both digging out very important facts and presenting a compelling case to the jury.\u201d\u00a0<\/p>\n<p>Nothing in Barr\u2019s comments here or elsewhere since he became a private citizen suggest he has changed his view that prosecutions should be governed by prudence and not devolve into a tit-for-tat game. But the Times must present Barr as the bad guy, and Durham too, because the special counsel\u2019s report is forthcoming \u2014 and the messengers must be destroyed first.\u00a0<\/p>\n<hr class=\"wp-block-separator\" \/>\n<p>\n Margot Cleveland, The Federalist&#8217;s senior law correspondent, is Margot.
