Jackson Women\u2019s Health\u00a0Organization<\/em>\u00a0That \u201cthe Constitution does not confer a right to abortion\u201d The attacks on legal protection of the unborn did not cease. Moving forward\u00a0<a href=\"https:\/\/www.dailysignal.com\/2023\/01\/05\/south-carolina-supreme-court-strikes-down-states-heartbeat-abortion-law\/\" target=\"_blank\" rel=\"noreferrer noopener\">most challenges<\/a>\u00a0will use the same arguments but shift the venue to the state courts. Launching are also abortion lawyers\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-politics-health-indiana-state-government-reproductive-rights-7308b2edc8a8ac62446d821abc5fae59\" target=\"_blank\" rel=\"noreferrer noopener\">less conventional attacks<\/a>Pro-life laws, which include the violation of the right to freely practice religion under state constitutions and statutes, are all examples.<\/p>\n<p>For example, last year saw a Florida Jewish congregation and clergy from other religious organizations.\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-health-religion-lawsuits-florida-6e115c5c1f23eff92161d136940ae91e\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a>\u00a0Florida\u2019s ban on abortion after 15 weeks of pregnancy. Ohio&#8217;s Jewish congregations\u00a0<a href=\"https:\/\/ohiocapitaljournal.com\/2022\/07\/12\/jewish-community-to-join-aclu-abortion-providers-in-lawsuit-against-ohios-six-week-abortion-ban\/\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a>\u00a0that state\u2019s ban on abortions after a fetal heartbeat can be detected. Several Jewish women are also involved in abortions.\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-2022-midterm-elections-health-kentucky-legislature-26ecd225013231ee8766248633d289a3\" target=\"_blank\" rel=\"noreferrer noopener\">challenged<\/a>\u00a0Kentucky\u2019s near-total ban on abortion. In each of these cases, the argument is that the law prohibits abortions that the plaintiffs\u2019 religion allows.<\/p>\n<p>Similar suit\u00a0<a href=\"https:\/\/apnews.com\/article\/abortion-lawsuits-indiana-religion-american-civil-liberties-union-655bff81c7f4d7c02554559b7fdc1b01\" target=\"_blank\" rel=\"noreferrer noopener\">in Indiana<\/a>American Civil Liberties Union (ACLU), in support of Hoosier Jews for Choice clients, argued that abortion is required by the Jewish faith under certain circumstances. The plaintiffs claim that Indiana\u2019s ban on almost all abortions violates its\u00a0<a href=\"https:\/\/www.indianahouserepublicans.com\/sea-101-religious-freedom-restoration-act-rfra-resource-page\/\" target=\"_blank\" rel=\"noreferrer noopener\">Religious Freedom Restoration Act<\/a>\u00a0(RFRA), which bans the government \u201csubstantially burden[ing] a person\u2019s exercise of religion\u201d If it isn&#8217;t, \u201cleast restrictive means\u201d You can help to further your cause \u201ccompelling governmental interest.\u201d Indiana\u2019s law is modeled on the federal RFRA, enacted in 1993 \u2014 and its legal standard, known as \u201cstrict scrutiny,\u201d It is the most complex area of law.<\/p>\n<p>Congress overwhelmingly passed RFRA, and President Bill Clinton signed it into law in reaction to the\u00a01990 decision <a href=\"https:\/\/supreme.justia.com\/cases\/federal\/us\/494\/872\/#tab-opinion-1958252\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Employment Division v. Smith<\/em><\/a>. The Supreme Court affirmed a weak legal standard which allows the government frequent interference with religious practice. States such as Indiana have begun to enact their own RFRAs, following the Supreme Court&#8217;s decision.\u00a0<a href=\"https:\/\/www.oyez.org\/cases\/1996\/95-2074\" target=\"_blank\" rel=\"noreferrer noopener\">decided<\/a>\u00a01997 was the last year that the federal RFRA couldn&#8217;t be applied to the States.<\/p>\n<p>Plaintiffs in the Indiana case claim that Judaism was the source of the Indiana lawsuit \u201ca fetus attains the status of a living person only at birth\u201d And that \u201cJewish law stresses the necessity of protecting the life and physical and mental health of the mother prior to birth as the fetus is not yet deemed to be a person.\u201d Indiana&#8217;s abortion ban prohibits nearly all abortions. The plaintiffs claim that Jewish teaching would allow or require them. This is what the lawsuit claims to be a \u201csubstantial burden\u201d on religions that are not justifiable under strict scrutiny.<\/p>\n<p> Legal Problems <\/p>\n<p>These types of lawsuits face many significant obstacles. First, the fact that one\u2019s religious beliefs allow doing something does not automatically convert doing it into an exercise of religion. A law that prohibits religious believers from doing something does not automatically make it a prohibited activity. \u201csubstantial burden\u201d on religious exercise.
