Phillips appealed, arguing that the rejection of his cake order was based on a presumption. \u201cfirm and sincere religious beliefs and the right to be free from compelled speech that would violate those beliefs.<\/p>\n<p>The appeals court, however, concluded that the cake Scardina tried to order inherently \u201cexpressed no message.\u201d The judges agreed. \u201cexpressive conduct need not contain verbal speech or the written word to be entitled to First Amendment protection\u201d But concluded that \u201cnot all conduct constitutes speech.\u201d<\/p>\n<p> ADF already <a href=\"https:\/\/twitter.com\/ADFLegal\/status\/1618644485893926912?s=20&#038;t=fqXeME8aDEFwFG6HKsfSSg\" target=\"_blank\" rel=\"noreferrer noopener\">announced<\/a> its plans to appeal the court of appeals\u2019 decision. <\/p>\n<p>\u201cFree speech is for everyone. No one should be forced to express a message that violates their core beliefs,\u201d ADF Senior Counsel Jake Warner and Phillips\u2019s lawyer <a href=\"https:\/\/adflegal.org\/enough-is-enough\/donate?sourcecode=10026148_r800&#038;utm_source=pardot&#038;utm_medium=email&#038;utm_campaign=masterpiece\" target=\"_blank\" rel=\"noreferrer noopener\">said<\/a> In a statement \u201cOver a decade ago, Colorado officials began targeting Jack, misusing state law to force him to say things he does not believe. Then an activist attorney continued that crusade. This cruelty must stop.\u201d<\/p>\n<p>Phillips has been persecuted for his deep religious convictions regarding sex and marriage for more than ten years.<\/p>\n<p>Phillips won a partial win on a related issue in 2018, when Phillips was heard by the Supreme Court\u00a0<a href=\"https:\/\/www.supremecourt.gov\/opinions\/17pdf\/16-111_j4el.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">decided<\/a> The Colorado officials wanted to punish the cake decorator who refused to make a 2012 cake that celebrated a gay marriage. \u201ca clear and impermissible hostility toward [Phillips\u2019] sincere religious beliefs.\u201d <\/p>\n<p>The Supreme Court has an opportunity to reaffirm Christians\u2019 rights to refuse certain services on religious grounds in <em><a href=\"https:\/\/thefederalist.com\/2022\/12\/06\/303-creative-is-just-the-governments-latest-attempt-to-conflate-christian-sexual-ethics-with-racism\/\" target=\"_blank\" rel=\"noreferrer noopener\">303 Creative v.
