Tell me what Article V of the Constitution does.\u201d<\/p>\n<p>Bjelkengren responded after a short pause. \u201cArticle V is not coming to mind at the moment.\u201d<\/p>\n<p><a href=\"https:\/\/constitution.congress.gov\/browse\/article-5\/\" target=\"_blank\" rel=\"noopener\">Article V<\/a> Describes the process and procedures surrounding proposed amendments, including how they can be passed and ratified before being added to the U.S. Constitution.<\/p>\n<p>\u201cHow about Article II?\u201d Kennedy tried again.<\/p>\n<p>\u201cNeither is Article II,\u201d was\u00a0Bjelkengren\u2019s response.<\/p>\n<p><a href=\"https:\/\/constitution.congress.gov\/browse\/article-2\/\" target=\"_blank\" rel=\"noopener\">Article II<\/a>\u00a0of the Constitution defines the Executive Branch of the U.S. Government: how the president is elected \u2014 and by whom; the qualifications for and duties of the office; what the president\u2019s powers are; who succeeds the president; and the impeachment process.<\/p>\n<p>\u201cOkay,\u201d Kennedy responded, scratching his head before continuing. \u201cDo you know what purposivism is?\u201d<\/p>\n<p>\u201cIn my 12 years as an assistant attorney general and my nine years serving as a judge, I was not faced with that precise question,\u201d She spoke. \u201cWe are the highest trial court in Washington State, so I\u2019m frequently faced with issues that I\u2019m not familiar with, and I thoroughly review the law. I research and apply the law to the facts presented to me.\u201d<\/p>\n<p>\u201cWell, you\u2019re going to be faced with it if you\u2019re confirmed, I can assure you of that,\u201d Kennedy warned.<\/p>\n<p><a href=\"https:\/\/www.merriam-webster.com\/dictionary\/purposivism\" target=\"_blank\" rel=\"noopener\">Purposivism<\/a>According to Merriam Webster, the definition of a &#8220;person&#8221; is: \u201cany of various theories of nature or of human and animal behavior that regard purpose or conscious intent as a basal fact.\u201d<\/p>\n<p>Biden nominated Bjelkengren to serve as U.S. District Court Judge in the Eastern District of Washington \u2014 <a href=\"https:\/\/www.murray.senate.gov\/at-senator-murrays-recommendation-president-biden-nominates-judge-charnelle-bjelkengren-to-serve-as-u-s-district-court-in-the-eastern-district-of-washington\/\" target=\"_blank\" rel=\"noopener\">on the advice<\/a> U.S. Senator Patty Murray (D\u2013WA).<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Federal District Court nominee Charnelle Marie Bjelkengren appeared to struggle with the most basic of questions during her Thursday morning hearing before the Senate Judiciary Committee, failing to recall the purpose of both Article V and Article II of the United States Constitution.
