He then boasted in television interviews that he will not be charged criminally. Baldwin, who was the film&#8217;s lead actor and producer. \u201cRust,\u201d Haughtily blaming his employees for not checking whether his gun was loaded in live ammunition, he said. He could be sentenced to a mandatory five-year term if he is convicted by a jury of the most serious felony.<\/p>\n<p>\u201cThe fact that Baldwin went on an immediate public campaign to exonerate himself and went on <a href=\"https:\/\/abcnews.go.com\/Entertainment\/alec-baldwin-rust-shooting-responsible\/story?id=81490389\" target=\"_blank\" rel=\"noreferrer noopener\">ABC News<\/a> and said he didn\u2019t do anything wrong \u2014 that definitely factored into the prosecutor\u2019s decision,\u201d Dennis Postiglione from Austin is suing Baldwin on defamation and for other charges on behalf the family of a fallen Marine.<\/p>\n<p>\u201cBaldwin just killed someone he knew. And he did all of these interviews, didn\u2019t cry, and thumbed his nose at the state \u2014 saying he would not be charged,\u201d Postiglione said. \u201cIf that had been you or me, I think charges would have come a lot sooner.\u201d<\/p>\n<p>Postiglione stated that the movie star has the right to due process. He was also entitled to the presumption and innocence. \u201cBaldwin is controversial and combative, but that doesn\u2019t mean he\u2019s automatically guilty.\u201d<\/p>\n<p>Baldwin\u2019s lawyer Luke Nikas did not respond to a request for comment, but in a public statement said his client, \u201crelied on the professionals with whom he worked, who assured him the gun did not have live rounds. We will fight these charges, and we will win.\u201d<\/p>\n<p>Baldwin will be charged as both an actor and producer for being aware of safety concerns regarding the low-budget film. Mary Carmack-Altwies, New Mexico First Judicial District Attorney, stated that Baldwin was being charged. \u201cWe are saying \u2014 here in New Mexico \u2014 that everyone is equal under the law,\u201d She shared her story <a href=\"https:\/\/www.cnn.com\/2023\/01\/19\/us\/santa-fe-alec-baldwin-rust-charged\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">CNN<\/a> On Thursday.<\/p>\n<p> The Scene of the Crime <\/p>\n<p>Baldwin was practicing a scene in a desert church on Oct. 21, 2021. Baldwin is said to have pulled a.45 Colt single action revolver from the holster, pulled the trigger, and pointed the gun at Hutchins. The bullet from the real ammunition went into Hutchins, came out her back, and lodged in Director Joel Souza\u2019s shoulder. Baldwin then reportedly walked away from the church.
