But the stunt reflects the authoritarian outlook that\u2019s been normalized on the contemporary left. Since the date the decision was made, which was 13 years ago, <em><a href=\"https:\/\/www.law.cornell.edu\/supct\/html\/08-205.ZS.html\" target=\"_blank\" rel=\"noreferrer noopener\">Citizens United<\/a><\/em> Unregulated speech was seen as a threat and this rallying cry was heard by many. Barack Obama is known for his infamous, and <a href=\"https:\/\/www.cato.org\/commentary\/citizens-united-misunderstood\" target=\"_blank\" rel=\"noreferrer noopener\">inaccurately<\/a>he rebuked the judges during his State of the Union speech for upholding the First Amendment. Democrats have repeatedly blamed this decision for the alleged corrosion. \u201cdemocracy.\u201d<\/p>\n<p>Democrats try to obscure the fact\u00a0that their\u00a0position is objectively pro-censorship.\u00a0Remember that <em>Citizens United<\/em> revolved around the federal government\u2019s banning the showing of a documentary critical of 2008 presidential candidate Hillary Clinton before the Democratic primary elections. McCain-Feingold at the time made it illegal for corporations (groups freely associating citizens), and unions (ditto), to engage in. \u201celectioneering\u201d A month or two months prior to a primary election. Oral arguments were made by the then-Solicitor General, United States, now Supreme Court Justice Elena Kagan <a href=\"https:\/\/reason.org\/commentary\/elena-kagan-ban-books\/\" target=\"_blank\" rel=\"noreferrer noopener\">contended<\/a> That the federal government could ban books \u201cexpress advocacy.\u201d <\/p>\n<p>Recall also that \u201ccampaign finance\u201d laws \u2014 speech codes \u2014 were written by politicians and defended by political media who were encumbered by any limitations on their own free expression. These unacceptable laws prevented citizens from coming together to pool their resources and engage in the most essential form of expression, just before an election. <\/p>\n<p>Schiff\u2019s amendment would overturn <em>Citizens United<\/em>The First Amendment and the Constitution empower both federal and state governments to adopt legislation. \u201creasonable, viewpoint-neutral\u201d Speech restrictions \u201cinfluences\u201d elections. <\/p>\n<p>For one thing, blanket, politically neutral restrictions on political speech \u2014 even if we trusted that politicians could neutrally dispense them \u2014 are <em>still<\/em> There are no restrictions on freedom of expression It doesn\u2019t matter one whit if they are \u201creasonable\u201d Or \u201cneutral.\u201d The principle of free speech isn\u2019t contingent on fairness or outcome, or the form the speech takes. It is a fundamental right. <em>Inbuilt<\/em> The Constitution protects our right, and does not prescribe what the state should do. It\u2019s amazing that this has to be said.<\/p>\n<p>Moreover, do Democrats trust Kevin McCarthy\u2019s conception of \u201creasonable\u201d? Because I don\u2019t. Hakeem Jeffries and that I also don&#8217;t trust. <a href=\"https:\/\/thefederalist.com\/2023\/01\/18\/mccarthy-has-plenty-of-good-reasons-to-boot-democrats-from-committee-seats-especially-adam-schiff\/\" target=\"_blank\" rel=\"noreferrer noopener\">weasel<\/a> Schiff, who is a former participant in censoring dissent. Lois Lerner might. <a href=\"https:\/\/www.nytimes.com\/2013\/05\/11\/us\/politics\/irs-apologizes-to-conservative-groups-over-application-audits.html\" target=\"_blank\" rel=\"noreferrer noopener\">tell you<\/a>Any law giving bureaucrats the power to define political speech will not be enforced arbitrarily and will undoubtedly be abused. Only \u201cviewpoint-neutral\u201d position on speech is that it\u2019s none of the state\u2019s business.<\/p>\n<p>Moreover, the amendment is not neutral. Section 4 of Schiff\u2019s proposal offers an exemption to the \u201cpress.\u201d Who is the press? It&#8217;s not difficult to see how bureaucrats would make that determination. Schiff knows that most large communication companies already work for Democrats and aren\u2019t any more neutral activists.
