The incident occurred in New Mexico. Each count carries an 18-month maximum sentence. However, prosecutors have added a firearms enhancement that will put Halyna Hutchins behind bars for five years.<\/p>\n<p>It is hard to see how Baldwin couldn\u2019t have been charged with at least involuntary manslaughter. The first rule of gun safety is you don\u2019t point a gun a something unless you intend to shoot it. Even if you believe the gun is unloaded, you don\u2019t point it directly at others.<\/p>\n<p>Baldwin didn\u2019t follow basic gun safety when he shot his cinematographer, Hutchins. Anyone who has been to the shooting range would know that this is something they should be taught. Baldwin, an actor who has appeared in many movies that used guns over the years, should have this explanation explained to him numerous times.<\/p>\n<p>Baldwin is a member of the Actors Equity Association.\u00a0<a href=\"https:\/\/www.actorsequity.org\/resources\/Producers\/safe-and-sanitary\/safety-tips-for-use-of-firearms\/\" target=\"_blank\" rel=\"noreferrer noopener\">clearly states<\/a>\u00a0Its website contains the rules for firearm use:<\/p>\n<p>\u201cTreat all guns as if they are loaded and deadly.\u201d<\/p>\n<p>\u201cNever point a firearm at anyone including yourself. Always cheat the shot by aiming to the right or left of the target character.\u201d<\/p>\n<p>\u201cCheck the firearm every time you take possession of it.\u201d<\/p>\n<p>\u201cLive ammunition may not be brought into the theatre.\u201d<\/p>\n<p>Baldwin\u2019s repeated claim that he never pulled the gun trigger is not credible, as an FBI forensic <a href=\"https:\/\/nypost.com\/2022\/08\/13\/fbi-confirms-alec-baldwin-pulled-trigger-in-fatal-rust-shooting\/\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a> released in August concluded the\u00a0firearm couldn\u2019t have gone off\u00a0unless someone pulled the trigger.\u00a0It would have no relevance if the firearm had gone off unless someone pulled the trigger. If he hadn\u2019t pointed his gun at her, it wouldn\u2019t have mattered if he had pulled the trigger. <\/p>\n<p>Baldwin has tried many times to avoid criminal charges by blaming other people. He was also responsible for the crew. He hired Hannah Gutierrez (a novice armorer), who was unsure of her competence. This decision was likely to save the production money but it also meant that there was a chance of something going wrong.<\/p>\n<p>Baldwin is clearly sorry for the tragedy.
