Walshe was also charged for disinterment without proper authority of a body dead and misleading police officers in their investigation.<\/p>\n<p>During the arraignment, prosecutors read a list of shocking internet searches Walshe allegedly made using his son\u2019s iPad \u2014 and according to defense attorney\u00a0Mark Bederow, those searches could cause him problems on at least two fronts.<\/p>\n<p>\u201cIf these allegations are true, it\u2019s stunning how dumb as dirt this guy appears to be. It\u2019s unbelievable,\u201d Bederow said the\u00a0<a href=\"https:\/\/nypost.com\/2023\/01\/19\/brian-walshe-is-a-dumb-as-dirt-alleged-criminal-lawyers\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a>, saying that the searches could be used as evidence that he had committed a crime even though authorities still had not found his wife\u2019s body.<\/p>\n<p>But in addition to being used as evidence that a crime was committed, Bederow said, the searches could be used to prove that Walshe was thinking clearly \u2014 thus making it far more difficult for him to use diminished mental capacity as a defense.<\/p>\n<p>\u201cHis internet searches \u2014 as sick as they may be \u2014 are rational in a cogent thought type of way. There appears to be a lot of planning and it appears to be well thought out,\u201d Bederow explained.<\/p>\n<p>Among Walshe\u2019s potentially damning alleged Google <a href=\"https:\/\/nypost.com\/2023\/01\/18\/brian-walshe-arrives-at-court-to-face-murder-charges\/\" target=\"_blank\" rel=\"noopener\">searches<\/a> These were the results:<\/p>\n<p>how to stop a body from decomposinghow long before a body starts to smellhow\u00a0long does DNA last?dismemberment and\u00a0the best ways to dispose of a\u00a0bodyhacksaw best tool\u00a0to dismembercan you be charged\u00a0with murder without a body?can you identify a body with broken teeth?<\/p>\n<p>Former New York prosecutor \u2014 and current criminal defense attorney \u2014 Duncan Levin <a href=\"https:\/\/nypost.com\/2023\/01\/19\/brian-walshe-is-a-dumb-as-dirt-alleged-criminal-lawyers\/\" target=\"_blank\" rel=\"noopener\">told the Post<\/a> that while the case could certainly move forward without a body, the evidence against the alleged killer would likely be stronger if and when Ana Walshe\u2019s body was found.<\/p>\n<p>\u201cIt\u2019s too early to tell what holes there may be in any of the evidence. Obviously from what we know, there is an extremely strong circumstantial case against Brian Walshe,\u201d Levin added, \u201cWithout the body, it\u2019s not a slam-dunk case for the prosecution.
