Chauvin\u2019s attorney, William Mohrman, told the court that his client\u2019s trial should not have been held in Minneapolis.<\/p>\n<p>\u201cOur primary argument here is that this case could not be tried in Minneapolis because of the pretrial publicity which was pervasive \u2026 and also just the physical pressure on the courthouse,\u201d According to Mohrman, <a href=\"https:\/\/www.npr.org\/2023\/01\/18\/1149726017\/derek-chauvin-appeal-murder-george-floyd\" target=\"_blank\" rel=\"noopener\">NPR<\/a>.<\/p>\n<p>The attorney wrote in a brief filed to the Minnesota Court of Appeals that the trial\u2019s intense publicity, the public unrest and riots surrounding Floyd\u2019s death, a $27 million settlement paid by the city of Minneapolis to Floyd\u2019s family, and other factors justified moving the trial. Mohrman also accused the prosecutors of misconduct. According to <a href=\"https:\/\/www.foxnews.com\/us\/derek-chauvin-appeals-conviction-in-george-floyd-murder-arguing-trial-wasnt-fair\" target=\"_blank\" rel=\"noopener\">Fox News<\/a>.<\/p>\n<p>Attorney for Minnesota Neal Katyal said Chauvin\u2019s trial was \u201cone of the most transparent and thorough \u2026 in our nation\u2019s history.\u201d He said that Mohrman\u2019s arguments \u201cdo not come close\u201d to justifying tossing Chauvin\u2019s convictions. \u201cThe evidence of Chauvin\u2019s guilt was captured on video for the world to see,\u201d According to NPR, he said that.<\/p>\n<p>Chauvin has also been sentenced to 21 years in prison for violating Floyd\u2019s civil rights. If he were to appeal his convictions over Floyd\u2019s death successfully, the former officer would remain in prison under the civil rights charge. He avoided the life sentence he faced if convicted. It allowed him to be released from a Minnesota State Prison where he was at higher risk and transferred to a federal prison.<\/p>\n<p>Chauvin was convicted for Floyd&#8217;s murder after he and other officers tried to arrest him in May 2020. Video of the arrest showed Floyd resisting officers\u2019 commands until they subdued him on the ground. Chauvin then kneeled on Floyd\u2019s shoulders and neck for roughly nine minutes.
