Version: 4.0.47--><p>Tech billionaire <a href=\"https:\/\/www.theepochtimes.com\/t-elon-musk\">Elon Musk<\/a>\u2019s lawyers have argued that the Tesla CEO is viewed in a negative light by more than 80 percent of prospective jurors in San Francisco in an effort to get his upcoming <a href=\"https:\/\/www.theepochtimes.com\/t-trial\">trial<\/a> Against a group Tesla shareholder moved out of the state.<\/p>\n<p>Lawyers for Musk argued in court documents that\u00a0questionnaires, which are not publicly available, completed by nearly\u00a0200\u00a0prospective jurors in San Francisco showed that\u00a082 percent of them have a negative opinion of Musk, Bloomberg <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-01-12\/musk-says-82-of-san-francisco-jury-pool-views-him-negatively\">reported<\/a>.<\/p>\n<p>Only two to three potential jurors admitted knowing someone who works for Twitter, The Associated Press. <a href=\"https:\/\/apnews.com\/article\/elon-musk-technology-texas-san-francisco-business-6ac6780b84fa446c43821e1fffeaf930\">reported.\u00a0<\/a><\/p>\n<p>This, his lawyers said, reinforced the fact that\u00a0the Northern California jury pool for the trial \u201cis biased against Mr. Musk,\u201d Much of what they said comes from his. \u201cuse of and honesty on Twitter.\u201d<\/p>\n<p>In previous court documents (<a href=\"https:\/\/www.scribd.com\/document\/619620133\/Musk-Tesla-Trial-Request-to-Transfer\">pdf<\/a>) filed in the California court on Jan. 6,\u00a0lawyers for\u00a0Musk stated that local media have \u201csaturated\u201d District with \u201cbiased and negative stories\u201d They have been talking about Musk for several months and fear that this could influence the jury.<\/p>\n<p>\u201cPrejudice can be presumed in this case,\u201d Musk\u2019s lawyers wrote. \u201cOver the past several months, the potential jury pool in the Northern District has been \u2018exposed to excessive and adverse pretrial publicity\u2019 concerning Mr. Musk\u201d This could lead to him losing his impartial jury rights and constitutional right for a fair trial.<\/p>\n<figure id=\"attachment_4932047\" class=\"wp-caption alignnone\"><a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/01\/musk-Twitter-GettyImages-1245718932-1200x765-1.jpg\"><img loading=\"lazy\" decoding=\"async\" class=\"lazy wp-image-4932047 size-large\" style=\"display: none;\" src=\"https:\/\/www.theepochtimes.com\/assets\/themes\/eet\/images\/white.png\" alt=\"Elon Musk's Twitter\" width=\"640\" height=\"408\" data-src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/01\/musk-Twitter-GettyImages-1245718932-1200x765-1.jpg\" \/><\/a><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4932047 size-large\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/01\/musk-Twitter-GettyImages-1245718932-1200x765-1.jpg\" alt=\"Elon Musk&#039;s Twitter\" width=\"640\" height=\"408\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>A phone displaying Elon Musk\u2019s Twitter page where he is conducting a survey about his future as the head of the company, in a photo illustration taken in Los Angeles on Dec. 18, 2022. (Chris Delmas\/AFP via Getty Images).<\/figure>\n<h2>Musk and the potential juror bias<\/h2>\n<p>According to Musk\u2019s lawyers, the negative press has \u201cfostered two distinct and highly prejudicial biases in the jury pool: (1) a bias concerning one of the key issues in this case: Mr. Musk\u2019s use of Twitter and (2) a personal and material bias against Mr. Musk by potential jurors who have been impacted by recent business decisions and staff reductions.\u201d<\/p>\n<p>Lawyers also cited negative attention from local politicians in San Francisco, including\u00a0its mayor, who they said has participated in protests against Musk.<\/p>\n<p>While the lawyers noted that Musk has been a\u00a0public figure for more than a decade and recognizes that being the subject of negative and even unfair media attention comes with the territory, they proposed that the court move the trial to the Western District of Texas.<\/p>\n<p>In 2021, Tesla relocated its headquarters to Texas.<\/p>\n<p>Despite insistence from Musk\u2019s lawyers that the trial be moved out of San Francisco,\u00a0federal judge Edward Chen on Friday rejected the claims that the jury pool is biased against Musk, asserting that a judge was able to assemble an unbiased jury for the criminal trial of failed Theranos Inc. founder Elizabeth Holmes, Bloomberg <a href=\"https:\/\/www.bloomberg.com\/news\/articles\/2023-01-13\/musk-s-bid-to-move-fraud-trial-out-of-san-francisco-is-rejected?sref=ExbtjcSG\">reports<\/a>.<\/p>\n<figure id=\"attachment_4872491\" class=\"wp-caption alignnone\"><figcaption class=\"wp-caption-text\"><noscript><img loading=\"lazy\" decoding=\"async\" class=\"wp-image-4872491 size-large\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2023\/01\/Elizabeth-Holmes-1200x800-1.jpg\" alt=\"Elizabeth Holmes\" width=\"640\" height=\"427\" \/><\/noscript><\/figcaption>&nbsp;<\/p>\n<p>Elizabeth Holmes, former CEO of Theranos, arrives at San Jose Federal Court in California on October 17, 2022. (Jeff Chiu\/AP Photo)<\/figure>\n<h2>Judge Draws Comparisons to\u00a0Elizabeth Holmes<\/h2>\n<p>Holmes was sentenced in November to 11 years and three months in prison after she was found guilty of\u00a0defrauding investors in the blood testing startup of millions of dollars. Similar to Musk, lawyers for\u00a0Holmes had argued that their client had received too much negative press that could influence the jury.<\/p>\n<p>Musk, whose trial is\u00a0scheduled to begin on Jan. 17, has been accused by\u00a0Tesla shareholders of fraudulently inflating Tesla stock and making false and misleading statements in an\u00a0Aug. 7, 2018,\u00a0<a href=\"https:\/\/twitter.com\/elonmusk\/status\/1026872652290379776\">tweet<\/a> In which he said: \u201cAm considering taking Tesla private at $420. Funding secured.\u201d<\/p>\n<p>The deal, however, never\u00a0materialized and shareholders claim they lost billions of dollars after Tesla\u2019s stock price became volatile.<\/p>\n<p>Musk was later forced to pay\u00a0a $40 million settlement with the Securities and Exchange Commission over the tweets.<\/p>\n<p>Judge Chen has already determined that Musk\u2019s buyout tweet was false, meaning the jury must now decide if the businessman acted\u00a0recklessly by posting it and whether it caused financial harm to Tesla shareholders.<\/p>\n<p>Musk has\u00a0stated that Saudi Arabia\u2019s sovereign wealth fund had agreed to support his attempt to take Tesla private, meaning his 2018 tweet was true. He and\u00a0his company have\u00a0said the statements did not violate the law.<\/p>\n<p>\u201cGoing back almost two years, the Saudi Arabian sovereign wealth fund has approached me multiple times about taking Tesla private,\u201d Musk said this in an Aug. 13, 2018.\u00a0<a href=\"https:\/\/www.tesla.com\/blog\/update-taking-tesla-private\" target=\"_blank\" rel=\"noopener\">blog post<\/a>. \u201cObviously, the Saudi sovereign fund has more than enough capital needed to execute on such a transaction,\u201d He added.<\/p>\n<p><em>This report was compiled by the Associated Press.<\/em><\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<p>Katabella is a journalist for The Epoch Times.
