Ron DeSantis was signed into law April 19, 2021. This measure was created in response to the riots in 140 cities in 20 states after George Floyd&#8217;s death in Minneapolis, Minnesota in 2020.<\/p>\n<p>Property Claim Services calculates property damages caused by natural disasters in the United States. They estimated that $1 billion to 2 billion of the damage resulted from the riots between April and July 2020. This is the largest insurance payout in American history. <a href=\"https:\/\/www.axios.com\/2020\/09\/16\/riots-cost-property-damage\">Axios<\/a> reported.<\/p>\n<p>The legislation was introduced by DeSantis on September 21, 2020.<\/p>\n<p>\u201cOur right to peacefully assemble is one of our most cherished as Americans, but throughout the country, we\u2019ve seen that right being taken advantage of by professional agitators, bent on sowing disorder and causing mayhem in our cities,\u201d DeSantis said.<\/p>\n<p>\u201cI will not allow this kind of violence to occur here in Florida,\u201d DeSantis asserted. \u201cThe legislation announced today will not only combat rioting and looting but also protect the men and women in law enforcement that wake up every day to keep us safe. I look forward to working with the Florida Legislature next session to sign this proposal into law.\u201d<\/p>\n<h2>What the law means to Floridians<\/h2>\n<p>The law also makes it a third degree felony to cause bodily harm to others. \u201cto obstruct traffic during an unpermitted protest, demonstration, or violent or disorderly assembly\u201d that consists of seven or more people, and provides civil immunity from liability for drivers who cause injury or death in an effort to flee for safety from a mob, according to a fact sheet released by the governor\u2019s office.<\/p>\n<p>A new law charges people with harassing or inciting others in public places such as restaurants. People who damage or deface monuments or public property will be charged as a second-degree felon. The mandatory minimum sentence for striking a policeman with a projectile or physical blow will be six months.<\/p>\n<p>The law also dictates that people\u00a0arrested for such violations must \u201cbe held in custody\u201d They will not appear in court until they make their first appearance.<\/p>\n<p>On Sept. 9, 2021, the U.S. District Court for the Northern District of Florida issued a\u00a0preliminary injunction\u00a0against the law (<a href=\"https:\/\/democracy4all.org\/wp-content\/uploads\/2021\/09\/The-Dream-Defenders-v.-DeSantis.pdf\">pdf<\/a>).<\/p>\n<p>Now the 11th Circuit is asking the Florida Supreme Court\u00a0to interpret the new meaning of \u201cpublic disturbance\u201d as amended in state law.<\/p>\n<p>In her\u00a0Jan. 10 opinion (<a href=\"https:\/\/media.ca11.uscourts.gov\/opinions\/pub\/files\/202113489.cert.pdf\">pdf<\/a>Circuit Judge Jill Pryor stated the following: \u201cthe proper interpretation of the statutory definition is a novel issue of state law that the Florida Supreme Court has yet to address. After careful consideration, we exercise our discretion to certify a question to that court to determine precisely what conduct the definition prohibits.\u201d<\/p>\n<p>Atlanta&#8217;s 11th Circuit is asking the Florida Supreme Court for clarifications. \u201cwillfully participate in a violent public disturbance involving an assembly of three or more persons.\u201d<\/p>\n<p>\u201cIs it something more than \u2018three or more persons acting with a common intent to assist each other in violent and disorderly conduct resulting in injury to another person, damage to property, or imminent danger of injury to another person or damage to property\u2019?\u201d Pryor asked.<\/p>\n<p>Pryor also wants information \u201cwhat conduct is required for a person to \u2018willfully participate in a violent public disturbance.&#8217;\u201d<\/p>\n<p>\u201cCan a person \u2018willfully participate in a violent public disturbance\u2019 without personally engaging in violence and disorderly conduct or advocating for violence and disorderly conduct?\u201d She was curious. \u201cIf so, what level of \u2018participat[ion]\u2019 is required?\u201d<\/p>\n<p>\u201cTo obtain a conviction, does the State have to prove beyond a reasonable doubt that the defendant intended to engage or assist two or more other persons in violent and disorderly conduct?\u201d Pryor also asked. \u201cIf not, what must the State prove regarding intent?\u201d<\/p>\n<p>Lastly, Pryor wants Florida\u2019s high court to clarify whether a person can be \u201cguilty of the crime of riot if the person attends a protest\u201d This eventually leads to \u201ca violent public disturbance in which three or more people\u201d Help each other to destroy property.<\/p>\n<h2>Stopping Traffic, Beating Bystanders<\/h2>\n<p>During the <a href=\"https:\/\/www.theepochtimes.com\/t-2020-riots\">2020 riots<\/a>There are a total of? people\u00a0<a href=\"https:\/\/concealednation.org\/2020\/05\/rioters-attack-vehicles-after-blocking-highway-traffic-would-lethal-self-defense-be-justified\/\">blocked traffic<\/a> Threatened drivers, which includes a <a href=\"https:\/\/www.breitbart.com\/law-and-order\/2020\/11\/01\/blm-protesters-block-car-of-disabled-man-harass-and-threaten-him-in-kentucky\/\">disabled man<\/a> Kentucky<\/p>\n<p>Black Lives Matter (BLM), a far-left extremist organization, and Antifa rioters forced a man to wreck his truck in Oregon. <a href=\"https:\/\/nypost.com\/2020\/08\/17\/blm-mob-beat-white-man-unconscious-after-making-him-crash-truck\/\">dragged him from his vehicle<\/a> To knock him unconscious. A truck driver was struck unconscious in Minneapolis. <a href=\"https:\/\/www.rt.com\/usa\/527052-trucker-blm-charges-dropped\/\">trying to escape<\/a> In an attempt to escape, a mob drove his truck through the crowd. They surround his vehicle and drag him out. He was taken into custody and charged with felony threat of violence. The charges were eventually dropped.<\/p>\n<p>There have been <a href=\"https:\/\/nypost.com\/2020\/09\/24\/breonna-taylor-protesters-threaten-to-knock-out-restaurant-patrons\/\">several instances<\/a> BLM protesters <a href=\"https:\/\/nypost.com\/2021\/04\/21\/blm-protesters-scream-at-diners-outside-nyc-restaurant\/\">surrounding and threatening people<\/a> Outdoor dining areas in Florida and Texas as well as historic monuments throughout the country were available for you to enjoy. <a href=\"https:\/\/www.artnews.com\/art-news\/news\/monuments-black-lives-matter-guide-1202690845\/\">defaced, toppled, and destroyed<\/a>.<\/p>\n<p>There were more than 2,000 police officers <a href=\"https:\/\/www.foxnews.com\/us\/police-chief-officers-injured-riots\">injured during the protests<\/a> and riots in 2020, according to the\u00a0Major Cities Chiefs Association.<\/p>\n<p>Hundreds of rioters were released\u00a0or had their <a href=\"https:\/\/www.the-sun.com\/news\/3123181\/hundreds-blm-rioters-looters-vandals-charges-dropped\/\">charges dismissed<\/a>.<\/p>\n<h2>Protecting the Taxpayer and Citizen<\/h2>\n<p>The new law contains measures that ensure the protection of Florida\u2019s citizens and their tax dollars.<\/p>\n<p>The law\u2019s prohibition of \u201cDefund the Police\u201d If they take law enforcement services out of their budgets, it is forbidden for any local government body to receive state aid or grants.<\/p>\n<p>The law does not apply \u201csovereign immunity,\u201d In cases of gross negligence in protecting property and citizens, it is possible for victims of crimes related to violent protests to sue their local government.<\/p>\n<p>It also terminates the state benefits of anyone convicted of participating in a violent protest as well as making them ineligible\u00a0to hold state or local government jobs, and prohibits bond or bail until their first appearance in court.<\/p>\n<div class=\"author_wrapper\">\n<div class=\"one_author_block round\">\n<div class=\"top_row\">\n\t\t\t\t\t<a href=\"https:\/\/www.theepochtimes.com\/author-patricia-tolson\"><img decoding=\"async\" src=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wp-content\/uploads\/2022\/10\/Patricia-Tolson.jpg\" alt=\"Patricia Tolson\"   style=\"display:none\"><\/a>\n\t\t\t\t\t<\/div>\n<div class=\"bio\">Patricia Tolson is an award-winning national investigative journalist with over 20 years&#8217; experience.
