We urge you to reverse your decision.\u201d<\/p>\n<p>The letter\u2019s signers also argued that the FDA\u2019s decision would not stop them from enforcing state laws against administering abortion pills.<\/p>\n<p>\u201cThough the FDA has abdicated its responsibility to protect women\u2019s health, we have not. To be crystal clear, you have not negated any of our laws that forbid the remote prescription, administration, and use of abortion-inducing drugs,\u201d The attorneys general wrote.<\/p>\n<p>Other than Alabama, other states included in the letter were Alaska, Arkansas and Florida, Georgia.<\/p>\n<p>The Daily Wire, last week <a href=\"https:\/\/www.dailywire.com\/news\/alabama-women-can-be-prosecuted-for-taking-abortion-pills-ag-says\" target=\"_blank\" rel=\"noopener\">reported<\/a> on Marshall\u2019s comments that women could be prosecuted for taking abortion pills in Alabama. Marshall made the remarks despite the state\u2019s Human Life Protection Act which criminalizes abortion providers and prevents prosecution against women who have abortions.<\/p>\n<p>\u201cThe Human Life Protection Act targets abortion providers, exempting women \u2018upon whom an abortion is performed or attempted to be performed\u2019 from liability under the law,\u201d Marshall stated that Marshall was a\u00a0<a href=\"https:\/\/www.al.com\/news\/2023\/01\/women-can-be-prosecuted-for-taking-abortion-pills-says-alabama-attorney-general.html\" target=\"_blank\" rel=\"noopener\">statement<\/a>\u00a0AL.com. \u201cIt does not provide an across-the-board exemption from all criminal laws, including the chemical-endangerment law\u2014which the Alabama Supreme Court has affirmed and reaffirmed protects unborn children.\u201d<\/p>\n<p>Marshall and other leaders of state reacted after a recent <a href=\"https:\/\/www.fda.gov\/drugs\/postmarket-drug-safety-information-patients-and-providers\/information-about-mifepristone-medical-termination-pregnancy-through-ten-weeks-gestation\" target=\"_blank\" rel=\"noopener\">update<\/a> FDA announced that major pharmacy chains will be allowed to supply two medications, misoprostol (prescribed for medical abortions), through the FDA. CVS and Walgreens, the nation\u2019s two largest pharmacy franchises, have since noted plans to participate in the new program from the FDA.<\/p>\n<p>At most, the FDA will not allow for the change. <a href=\"https:\/\/www.guttmacher.org\/state-policy\/explore\/medication-abortion\" target=\"_blank\" rel=\"noopener\">18 states<\/a> That requires a physician who is authorized to perform a medication abortion to physically be present at the time that the drug is administered. Telemedicine is prohibited from prescribing abortion medication.<\/p>\n<p>The medications used to induce abortions, Mifeprex and its generic Mifepristone Tablets, are approved by the FDA for up to 10 weeks gestation, as a woman\u2019s health risk reportedly increases after that time.<\/p>\n<p>\u201cThough there are risks to a woman of using these drugs at any point in pregnancy, abortion-inducing drugs are riskiest when used later in pregnancy.
