When it forced vaccine mandates on its employees, it was essentially accusing them of being a. \u201cstate actor\u201d \u2014 which would make it subject to the Constitution\u2019s \u201cequal protection clause,\u201d lawyers wrote.<\/p>\n<p>This theory highlights the extent to which Biden&#8217;s administration has relied upon corporations to implement policies that are not constitutional for the government. <a href=\"https:\/\/www.dailywire.com\/news\/twitter-fbi-agent-thinks-fewer-blacks-voted-after-2012-because-of-russians-not-obamas-departure\" target=\"_blank\" rel=\"noopener\">social media censorship<\/a> To <a href=\"https:\/\/www.dailywire.com\/news\/jetblue-wont-hire-the-unvaxxed-but-hired-violent-felon-to-fly-planes\" target=\"_blank\" rel=\"noopener\">airline<\/a> employee vaccine mandates.<\/p>\n<p>\u201cThe Constitution provides that the government, and state actors cannot take life, liberty or property without due process and equal protection of the law,\u201d The suit was said. \u201cThere is no dispute that the Defense Department was looking to partner with private business in its effort to vaccinate. At what point does partnership go beyond independent entities working voluntarily toward a shared mission to entwinement, such that they can be considered a state actor?\u201d<\/p>\n<p>\u201cHad the government instituted a requirement that all professional athletes and personnel of leading media outlet are required to receive a vaccination, without rights to exemption, such an action would be subject to an equal protection challenge for its treatment of professional athletes and leading media differently than other similarly situated persons,\u201d It said. \u201cA state actor performing such a function is subject to an equal protection challenge on the same basis.\u201d<\/p>\n<p>Beth Faber, a former employee of ESPN, filed the lawsuit. ESPN was subject to Disney\u2019s vaccine policies because it is owned by Disney, and both companies are named in the suit.<\/p>\n<p>(After Williams was fired by ESPN, she made plans to create <a href=\"https:\/\/www.dailywire.com\/news\/allison-williams-launches-sports-docuseries-breakaways-on-dailywire\" target=\"_blank\" rel=\"noopener\">sports documentaries<\/a> The Daily Wire. All companies employing more than 100 people must be vaccinated according to the government&#8217;s requirement. <a href=\"https:\/\/www.dailywire.com\/news\/read-it-supreme-courts-massive-blow-against-bidens-vaxx-mandate\" target=\"_blank\" rel=\"noopener\"><\/a> In the courts after The Daily Wire challenged them.<\/p>\n<p>According to the lawsuit: \u201cThe September 9, 2021 termination of Beth Faber, exactly on, and of Allison Williams shortly after, the date of President Biden\u2019s announcement of a business mandate, are more than just symbolic, they are part of a very orchestrated and choreographed partnership.\u201d<\/p>\n<p>Six days later Bob Chapek (then-Disney CEO) took part in a <a href=\"https:\/\/deadline.com\/2021\/09\/joe-biden-walt-disney-vaccine-bob-chapek-1234833923\/\" target=\"_blank\" rel=\"noopener\">White House meeting<\/a> Joe Biden discusses the topic of vaccine mandates. \u201cChapek\u2019s presence at the Biden Administration\u2019s business summit reflects the active involvement of the highest level of management,\u201d It continued.<\/p>\n<p>\u201cThe very same day that the Biden Administration \u2018called on leaders in the private and public sector to implement vaccine requirements, saying it will push millions more Americans to get vaccinated,\u2019 Bob Chapek responded to Biden\u2019s call. Biden had stated, or ordered, \u2018If you\u2019re a business leader, a nonprofit leader, a state or local leader, who has been waiting for full FDA approval to require vaccinations, I call on you now to do that. Require it,\u2019\u201d The suit was said.<\/p>\n<p>ESPN denied Faber\u2019s and Williams\u2019 requests for religious exemptions, the suit said.<\/p>\n<p>According to the lawsuit, there was a revolving door between Disney and the White House. \u201cKristina Schake, who headed the Covid-19 vaccine education campaign of the Biden Administration, was selected by Disney as its new executive vice president of global communications. Disney\u2019s own website refers to her as \u2018working at the nexus of government, media, business, entertainment, and technology.\u2019 The close nexus continues, of course, when she works on the private side of the house,\u201d It said.<\/p>\n<p>\u201cThe close nexus also includes Disney\u2019s naming of former Pentagon Press Secretary Geoff Morrell, \u2018to the newly created position of chief corporate affairs officer, overseeing corporate communications, government relations and global public policy,\u2019\u201d It continued.<\/p>\n<p>It was also claimed that Disney had long-standing ties to both the Defense Department and the Department of Health and Human Services. Operation Warp Speed was the government&#8217;s vaccine program.<\/p>\n<p>The suit claimed that the Defense Department owned land at Disney World and that the Department had announced in April 2022 that it would host its Warrior Games at the resort. According to the suit, the Department provided crucial support for the Marvel franchise like \u201cIron Man,\u201d now one of Disney\u2019s most lucrative.<\/p>\n<p>The company\u2019s ties to the security state go back to its founding, the suit says, noting that founder Walt Disney himself was an FBI informant who let notorious Bureau Director J. Edgar Hoover have access to Disney scripts, and that the company generated wartime marketing materials during World War II.<\/p>\n<p>According to the suit, powerful corporations have become so big that they look almost like states.
