They killed three people and left hundreds injured. The brother was killed in a shootout between police and the bomber, but the bomber surviving was found and taken into custody.<\/p>\n<p>The Boston Marathon bomber\u2019s attorney, Daniel Habib, is now asking a federal appeals court to intervene and throw out the death sentence first handed down by a federal jury in 2015 and <a href=\"https:\/\/www.dailywire.com\/news\/supreme-court-reinstates-death-sentence-for-boston-marathon-bomber\" target=\"_blank\" rel=\"noopener\">reimposed<\/a> Last year, the Supreme Court. Habib told the First Circuit Court of Appeals that his client\u2019s sentence should be lifted because of issues the Supreme Court did not consider in its March 2022 ruling, such as two jurors accused of lying during jury selection, according to the <a href=\"https:\/\/apnews.com\/article\/massachusetts-state-government-legal-proceedings-crime-boston-f32276fbfccb77fca2a08ae831d7f4df\" target=\"_blank\" rel=\"noopener\">Associated Press<\/a>.<\/p>\n<p>Habib claimed that one juror denied posting on social media about bomber but had posted a post calling defendant a &#8220;terrorist&#8221;. \u201cpiece of garbage.\u201d Another juror claimed that no one of his Facebook friends had posted about trial. However, a friend had encouraged the juror to. \u201cplay the part\u201d To be a juror and convict the defendant.<\/p>\n<p>William Glaser, Justice Department attorney, admitted that some jurors made inaccurate statements but did not claim that the evidence suggested that jurors had acted in bad faith.<\/p>\n<p>\u201cThere is no indication in this record that the inaccuracies were the kind of knowing dishonesty that would lead to disqualification,\u201d According to the AP Glaser claimed.<\/p>\n<p>The First Circuit judges appeared to entertain Habib\u2019s argument. \u201cDon\u2019t we need to know why it was inaccurate before we know whether it was evidence of some bias or an innocent mistake?\u201d Judge William Kayatta stated, &#8220;According to <a href=\"https:\/\/www.reuters.com\/legal\/court-appears-open-boston-marathon-bombers-new-challenge-death-sentence-2023-01-10\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a>.<\/p>\n<p>The Boston Marathon bomber was <a href=\"https:\/\/www.nytimes.com\/2015\/04\/09\/us\/dzhokhar-tsarnaev-verdict-boston-marathan-bombing-trial.html\" target=\"_blank\" rel=\"noopener\">Convicted<\/a> After a 2015 trial, his defense team did not make much effort to defend him. He was charged with 30 counts. The defense attorney admitted his client\u2019s guilt to some of the charges and called just four witnesses who together gave five hours of testimony. Over the course of fifteen days, 92 witnesses were called by the prosecution.<\/p>\n<p>The First Circuit <a href=\"https:\/\/www.dailywire.com\/news\/federal-court-overturns-death-sentence-for-boston-marathon-bomber-dzhokhar-tsarnaev\" target=\"_blank\" rel=\"noopener\">Returned<\/a> the bomber\u2019s death sentence in 2020. The defendant\u2019s legal team had at the time pushed for the jury\u2019s verdict to be overturned as well.<\/p>\n<p>\u201cThis case should not have been tried in Boston. [The bomber] admitted heinous crimes, but even so \u2014 perhaps especially so \u2014 this trial demanded scrupulous adherence to the requirements of the Constitution and federal law.
