The incident reportedly occurred just as a small reading group in the class was about to learn about art.<\/p>\n<p>\u201cShe was going to confiscate it, and that\u2019s when he shot,\u201d the mother of one child in the class told <a href=\"https:\/\/www.washingtonpost.com\/dc-md-va\/2023\/01\/08\/richneck-elementary-school-shooting-newport-news-virginia\/\">The Washington Post<\/a>.<\/p>\n<p>The former director of the Virginia Department of Juvenile Justice cited what he called the \u201cinfancy defense\u201d to dismiss the idea that the child, placed in police custody, could be prosecuted.<\/p>\n<p>\u201cAs a practical matter, it would be next to impossible to prosecute a 6-year-old, no matter how serious,\u201d Andrew Block told the Post. \u201cThe bigger barrier, presuming the prosecution could overcome that, is all defendants have to be competent to stand trial. \u201cThat means you have to understand the nature of legal proceedings against you and assist in your own defense. There\u2019s no way a 6-year-old would meet that criteria.\u201d<\/p>\n<p>A parent of one of the first-grade students told <a href=\"https:\/\/www.dailymail.co.uk\/news\/article-11613793\/Teacher-25-deliberately-shot-chest-six-year-old-boy.html\" target=\"_blank\" rel=\"noopener\">The Daily Mail<\/a> that Zwerner \u201cscreamed at her kids to run away\u201d after she was shot. Sebastian Gonzalez-Hernandez continued, \u201cEven after she\u2019d been shot she was thinking about the safety of her children. My son didn\u2019t see what happened; he heard the gunshot go off, and turned around to see Miss Zwerner on the floor.\u201d<\/p>\n<p>\u201cShe is an amazing teacher, so dedicated,\u201d he added. \u201cMy son absolutely loves her, and we\u2019re devastated about what\u2019s happened. We are all thinking of her and hoping that she gets better soon.\u201d<\/p>\n<p>John Eley III, a former member of the Newport News School Board,\u00a0<a href=\"https:\/\/www.cbsnews.com\/news\/abby-zwerner-virginia-teacher-police-say-shot-by-6-year-old-student-identified\/\" target=\"_blank\" rel=\"noopener\">visited<\/a> Zwerner in the hospital and met several members of her family who also serve as teachers. \u201cThe family was all educators and said she was excited about doing the job,\u201d he said. \u201cThe custodians and other teachers spoke about how she\u2019s a good teammate, she\u2019s a team player, she loves her children, she\u2019s just an all-around good teacher.\u201d<\/p>\n<p>Richneck Principal Briana Foster Newton <a href=\"https:\/\/www.foxnews.com\/us\/virginia-teacher-shot-6-year-old-identified-parents-demand-action\" target=\"_blank\" rel=\"noopener\">reacted<\/a> to the incident by stating, \u201cMy heart is aching for our school community. The tragic event that occurred on Friday impacts all of us deeply.
